GUILTY MI - April Millsap, 14, Armada, 24 July 2014 #1

I don't mean to go off-topic, but I thought I'd explain why some of these things (i.e. theories, suspicion) don't really set things in stone for me.


I was confronted by cops before when me and some friends were hanging out at one of their family's "shops." That was a place where one of my friend's dad would work on cars and would sleep if him and his wife were fighting. (I didn't know how to really describe the place.)

There had been a sexual assault of one of the patients at a nearby Nursing Home. The suspect (identified a few years later by DNA) apparently was affiliated with a "dark car." My black Volvo was parked out front of said shop.

Cops pulled up to the place (which was a little off the road) and questioned us.
We were up there so we could drink beer and not bother or be bothered by anyone. And the cops came to ask us about the rape of an elderly person.

Can you imagine how terrifying that is?



Another time, I almost got into trouble because someone stole from me.

A "friend" grabbed some of my checks once. Her and at least one of their friends went around cashing them to put up their nose.

One that was cashed said that it was for babysitting. I have no kids thus far and that was nearly two decades ago.

One of her friends that cashed one of my checks is blonde and not very tall (albeit a lot skinnier than me). I was going to get in trouble for "theft by deception" because I was short and my hair was bleached.
It felt like it was harder on me to prove that I didn't steal money from myself/bank than it was on them once we knew they did it.

Those are just a couple of reasons I don't trust the "hunches" of Law Enforcement. There's not any actual evidence that he committed this crime. Just location and criminal history. He has a dirt bike, but a dirt bike hasn't conclusively (without a doubt) been tied to April's murder

If he has been charged there will be probable cause statement. I am very interested to read those if the warrant is made public.

I don't understand how this works. Isn't the DA the one that asks the judge to sign an arrest warrant? how can they later say they are lacking on evidence?

If I remember James was not arrested on anything having to do with April. A search prompted by the investigation into her case led them to the home where marijuana grow was going on. They were licensed as a grow house but had too many plants.

They are apparently trying to get an arrest warrant signed relating to the murder of April but all we have is the reporter's tweet for now.

The detectives go to the DA, DA decides to charge or not and pursue warrant by having judge sign off.

To help keep this a bit straight, both the son James and the father James were charged on the marijuana in St Clair County Michigan. Father James made bail, but son James has not posted bail yet and still sits in jail in St Clair County Michigan. Son James has been named as the POI in the case.

April's murder occurred in Macomb County Michigan. So it would be Macomb County's prosecuting attorney's office they would have to go through on any murder charges. Eric Smith is the prosecuting attorney, he's not new to big cases, he handled the Stephen Grant/Tara Grant case. He is going to make sure there is absolutely enough to charge whoever for the murder.

If it's true they are on their 3rd attempt to get the warrant, it explains much to me. While I would love an arrest, I trust that the Prosecutors office in Macomb has turned them down to this point and have forced them to get all the T's and I's crossed. It can matter a great deal in exactly what the charges are and I for one want whoever is charged to get the max charges.

Thanks gam. You said exactly what I've been thinking. It was a lucky break they found the 57 pot plants and are able to keep JR in jail without having to worry about keeping tabs on him.

If the father owns the house the plants were found in, why is the son being held? Did he admit the plants were his?

The father bonded out. The son has thus far been unable. Neither case has been tried as yet. The family probably could only afford to bail out one of the two.

Don't know, but before they raided the house, I knew by reading the sons FB that he was selling pot. From reading through Mi laws on medical marijuana, the son would not be able to get a primary caregiver license, because he has a felony conviction within the last 10 years. So the most the son could have is 12 plants. I also don't believe that the father could have a primary caregiver license either, while his felony conviction was more then 10 years ago, there is another part in the law that applies as far as I can tell to the father. You can't have a conviction(no time limit on it)for a felony that is an assaultive crime and his conviction falls under assaultive crime. So he could only have 12 plants. Both of them should only have the qualifying patient license and not a primary caregiver license, so both can only grow 12 plants each for their own use and not for someone else. How they knew who's plants were who's, I don't know and nothing was said on it. Also nothing was in media on them not being able to have a primary caregiver license. Now I may have missed something in the law, because they have amended it a few times, but I don't see how either could have a primary caregiver license.

I don't see how they could have torn their home apart 2 seprate time with 2 warrants without very strong evidence. If he turns out not being the guy. The police with have a huge law suit on their hands.

A person of interest is in custody, but still there are no named suspects or charges in the murder of 14-year-old April Millsap, and that has some people in her small Armada community living with a degree of uncertainty.

The crime has impacted just about every part of life, including what used to be a simple walk to school for some children.

During one of their many practices, the Armada High School Dance Team agreed to dedicate their first dance at the Aug. 28 football game to slain Armada teen April Millsap.

“All of the girls are very caring about the community where they live and go to school,” dance team advisor Valerie Diederich said. She helps the girl’s fine tune their dances, guides and encourages them during practices, before and after performances at the games.

Also, organizers of the fifth annual Romeo 2 Richmond Half Marathon and 5K Race (R2R) will honor her on Sunday, Sept. 14 on the Macomb Orchard Trail in Armada.
