Remembering Chelsea around Halloween this year. She should have been making a creative costume and enjoying this time. Prayers to her family and friends. She is not forgotten.

Daniel Clay’s appeal has been ‘submitted on case call’ with a currently scheduled date of December 4th, 2018 in the Detroit Court. I can’t link to his specific Court of Appeals database record, but you can search for his name here:
Case Search
This is the MI COA case call schedule. It is frequently updated:
https://courts.michigan.gov/Courts/COA/clerksoffice/CaseCall/CaseCall_12_2018_Detroit.pdf
Inmates don’t usually attend these proceedings and they are not generally covered by press at least on video. There are many cases scheduled before a specific COA for a single day so I understand they move along pretty quickly. DC has 2 separate case numbers so his may take a bit longer than average. The COA will issue a decision later and that is more likely to be covered by the media.

Thank you loreet. An appeal .... ugh
You’re welcome. I have several felony murder cases I have been following so I’ve been checking the COA website frequently these last few months.

I don’t know if this is a comfort, but there will likely be just this one appeal. DC doesn’t have a fleet of private attornies holding this up in the COA for years and years on every possible point.

It seemed — from the outside anyway — that the police, attorneys, judges, and jury did a decent job with Chelsea’s murder investigation, DC’s arrest, prosecution, defense, and sentencing. Since our justice system is made up of human beings, sometimes they make mistakes. But generally to win an appeal, the errors have to be truly egregious. Otherwise the COA decision will say something like (I paraphrase) ‘yes the police/judge/attorney erred. But it makes no difference to this murderer’s sentence.’ The good news is that final resolution is within sight. Often an appeal hanging over a victim’s family is stressful. Also for the perpetrator’s family. A few more months and likely DC’s case will be permanently closed and then we know the rest. Life in Prison with absolutely no possibility of Parole.

Well, he surely does not have money to pay for many appeals, so this may be his only chance. I don't expect it to be changed either.

For the family, I hope this can be put behind them and let them try to go on without it hanging over them.

I couldn't get his name to bring anything up on their site. Thanks for the posts. Hope you will keep this updated if you come across more

Thank you for the article! It is no surprise but a relief that justice prevailed here. DC is absolutely where he belongs. For some reason the link from the article directly to the Michigan Court of Appeals Opinion isn’t working for me so I am posting a link I hope works:

http://publicdocs.courts.mi.gov/OPINIONS/FINAL/COA/20190108_C339659_48_339659.OPN.PDF

It details the extensive damage and harm DC caused to Chelsea’s body. She must have fought valiantly and suffered greatly at the hands of this murderer.

I can't help but think of Chelsea today. I will never forget this case, or her. RIP sweet girl.

It's hard to believe that almost two years have gone by since my last post here, and how things have changed. The world has been fighting to preserve life, and combat a deadly virus. We had no hint of that coming when I last posted. Just like when Chelsea put on her carefully hand-crafted Halloween costume for a fun night out. She had no idea what was coming her way.

Then I look a few posts up and see one from our dearest Spellbound, who has left us too. How we miss her. She was a great sleuthing partner here on Chelsea's thread, Julia Niswender's, and many others.

It gives me comfort to think of Spells holding a heavenly sleuthing meeting with Julia and Chelsea, and probably a few others too. I just keep my ears open for those little whispers, and of course my eyes open for roses from angels.

Thinking of Chelsea this time of year, her family, and the legacy of pure sweetness she left behind. Bless you Chelsea.
