The domestic violence charges were dropped though.
The victim would not cooperate.

And he was not charged with assaulting an officer.
He was charged with obstructing an officer.

At that hearing, Marko was convicted on the obstruction charge and sentenced to probation. The domestic violence charged was dropped because Delano “was hesitant to proceed,” Collier said.

According to Dyer, Delano attended Friday’s court hearing, but returned that evening to her grandmother’s house in Portage, where Delano had been living in recent months. “Courtney was there when (the grandmother) went to bed, but then she must have snuck out” to meet up with Marko, Dyer said.

I know it is frustrating to see. She probably didn't believe it. I am sure my MIL didn't believe he would go that far either.

They probably didn't have enough evidence without her testimony to prosecute him successfully. And in all honesty if they had taken his gun he probably would have gotten one illegally, or beaten her to death, or run her over. Any of the other horrible endings we have seen to this story over and over again.

Lipsey honored a plea agreement in sentencing Marko to two concurrent terms of 25 to 50 years in prison on convictions of second-degree murder and assault on a pregnant individual causing miscarriage or stillbirth. Two firearms charges were dismissed.
