8/5/22 Update: See post #914 for hearing info. State witness: Judge Jamie Powell-Horowitz, previously in 2019 a special investigator working for Attorney General's office. Defense filed Motion to Compel production of file materials from AG's office. The attorney for Galloway, said she won’t decide on calling witnesses to testify about leaked polygraph findings & their effects on the case until an Oakland County judge rules on her request for additional related information from prosecutors at the Attorney General’s Office. Attorney Ellen Michaels filed a motion Friday in Oakland County Circuit Court, asking Judge Phyllis McMillen to enforce a request for documents on what transpired at the AG’s Office after the leaked information made its way there. Next hearing on 8/17/22 @ 10am. 8/5/22: Motion filed by defendant. Compel production of file materials.
8/17/22 Update: Galloway appeared for a virtual motion hearing. Galloway’s attorneys were requesting the judge to wave prosecutors’ privileged information & materials, arguing that it’s possible they don’t have access to all of the discovery relevant to the case. The Oakland County Circuit Court judge denied the defense’s motion Wednesday & said she felt confident that the attorneys are in possession of all necessary materials & that they have been for at least one year. The next court date has been tentatively scheduled for 10/12/22 & is subject to change. It is currently unclear exactly what this convening will include. The defense has been asked to file any desired motions regarding evidence suppression within the next four weeks.
8/17/22 Update: Judge Phyllis McMillen denied a defense attorneys' motion for more evidence in the case, believing that all relevant information in the case had been turned over to both legal teams. Galloway's attorney Ellen Michaels had argued she needed access to more documents before she could be satisfied that all evidence had been turned over. The prosecutor called the effort a fishing expedition. Judge McMillen said she found it hard to believe that any more information relevant to the case of a murdered Farmington Hills woman had not been turned over after two years of delays in the trial of Galloway. 8/18/22: Scheduling Order filed re Motion to Suppress Evidence. 8/24/22: Order to hold defendant.

SOUTHFIELD, Mich. (FOX 2) - An attorney for the man accused of murdering a Farmington Hills woman six years ago returned to court on Wednesday for a motion hearing, claiming that her attorney-client privilege has been violated because of information shared to the police.

Attorney Ellen Michaels argued on behalf of Floyd Galloway Jr. on Wednesday in the motion hearing that comes a little more than a month before he's due for trial in the murder of Danielle Stislicki.

Tuesday was the first court appearance since Aug. 17, when his attorneys were denied a request to view more evidence. Judge Phyllis McMillen ruled that all relevant information had been turned over to both the defense and prosecution.

The topic of Wednesday's hearing is regarding privileged information that Galloway's attorney claims was inappropriately shared, specifically a lie detector test that was shared between government agencies.

Michaels argued on Wednesday that information being shared between law enforcement officials had violated Galloway's due process - an allegation that stems from the discovery of several search warrants that had been executed in relation to Galloway.

She argues that her attorney-client privilege was in jeopardy because of a lie detector test that was done and shared with Troy Police Chief Gary Mayer, who then shared it with Farmington Hills Police.

McMillen did not rule on the motion but said she would try to do so by the end of next week, but that could put the trial date of Nov. 28 at risk.

FARMINGTON HILLS (WWJ) -- The long-delayed trial of Floyd Galloway -- the man accused of killing missing woman Danielle Stislicki -- faces a new challenge as the defense tries to have the case thrown out due to a previously leaked polygraph test.

When 28-year-old Danielle Stislicki disappeared in December 2016, Galloway quickly became a person of interest. Shortly after Stislicki was last seen, Galloway took a polygraph test at the advice of his former lawyer.

As reported by WDIV, the polygraph operator then shared the results of the test with his friend -- the former Troy police chief -- who filed the information as an anonymous tip and later passed the information along to the Farminton Hills police chief.

In August 2022, Galloway's defense attorney, Ellen Michaels, filed a motion calling for access to prosecutor files to determine how the information from the polygraph may have been used in the case against her client.

"They were in possession of everything my client revealed to his attorney," Michaels said. She also claimed that the information from the polygraph "was a blueprint for what would probably be the defense of the case."

Oakland County Circuit Judge Phyllis McMillen disagreed and denied the motion, stating that the defense already had all of the files from the prosecution that they needed.

Galloway's attorney has called the sharing of information from the polygraph a violation of due process and that the leaked results have tainted the case so much that Galloway cannot have a fair trial.

After already being delayed for more than a year, it will now be up to a judge to determine whether the trial will go forward at all.

At a court hearing Wednesday morning, defense attorney Ellen Michaels told Oakland County Circuit Judge Phyllis McMillen that the leaked polygraph findings have “tainted the case so much (that Galloway) cannot have a fair trial.”

After hearing arguments from Michaels, as well as Assistant Attorney General Danielle Russo Bennetts who is prosecuting the case, McMillen said she will make her decision by next week. Both sides said they will file with the Court of Appeals if the judge’s ruling doesn’t go their way, but for now the trial is scheduled to start on Nov. 28.

Michaels said if the case isn’t dismissed, all evidence from the Tim Hortons including video and phone records, records from the cab company, Stislicki’s recovered keys and Fitbit, and evidence from a retail store where Galloway is purported to have purchased a comforter after the slaying should be tossed out.

Russo Bennetts argued that it’s “not outside the bounds of common sense” that the evidence in question eventually would have been discovered anyway because of an ongoing and intense search by law enforcement early in the investigation. By the time the leaked information reached Farmington Hills police investigators, 11 search warrants had already been executed.

Besides what reportedly came out of the polygraph test, prosecutors say they have plenty of.other evidence on Galloway, including Stislicki’s DNA and other findings from his Berkley home, additional surveillance video, witness testimony and more.

SOUTHFIELD, Mich. (FOX 2) - The trial for Floyd Galloway Jr, the man accused of killing Danielle Stislicki almost six years ago, will not head to trial this fall as originally scheduled after the judge in the case pushed the case back to the spring of 2023.

The trial for Galloway as pushed back to March 23 by Judge Phyllis McMillen, a little more than a week after the most recent motion hearing. The delay does not come as a surprise as Galloway's attorneys have challenged different pieces of evidence that were obtained from a leaked polygraph test that Galloway took shortly after he was arrested.

Galloway was last in court on Oct. 19, when his attorneys challenged privileged information that was inappropriately shared. Attorney Ellen Michaels argued that information being shared between law enforcement officials had violated Galloway's due process - an allegation that stems from the discovery of several search warrants that had been executed in relation to Galloway.
