Still Missing MI - Danielle Stislicki, 28, Southfield, 2 Dec 2016 *ARREST* #16

Once in a while I have had occasion to drive by the apartment complex where she lived and a terrible sadness washes over me. I hope this Defendant goes to trial and is convicted. I feel for her parents- this has been such a long slog of 8 years--- and counting---without justice for their precious daughter.

OAKLAND COUNTY, Mich. – The U.S. Supreme Court will not rule on tainted evidence in the Danielle Stislicki murder trial.

In August, the Michigan Attorney General asked the U.S. Supreme Court to rule on whether evidence should be included in the murder trial. The U.S. Supreme Court has denied the request.

Oakland County and the state appeals court have already ruled in favor of suppressing the evidence. The Michigan Attorney General’s Office was hoping the U.S. Supreme Court would rule differently, but the appeal was denied.
 
The evidence that has been excluded from the trial:
  • Danielle Stislicki’s Fitbit, keys, and telephone.
  • The testimony of persons working at Tim Hortons.
  • Surveillance footage and phone records from Tim Hortons.
  • Surveillance footage from a gas station near Tim Hortons.
  • Information from the Green Cab company.

I thought the judge also said the attorney general and her assistants have done wrong doing and they need to remove themselves from the case. I think the judge wrote about that. When that happens will their inadequacies cause a delay to the trial ?
 

hmmm... this article has a different court date...

Galloway’s next appearance in Oakland County Circuit Court is scheduled for Feb. 26. A trial date is pending.

I do see that date on my post #150 above - first it was 2/26 than changed to 2/19 than again changed to 2/12/25. Wonder if the reporter didn't read the last line on the court site. It does say "Scheduling error" - I am going to go with the 2/12/25 date. :)

*Pretrial Hearing (@ 1pm ET) - MI - Danielle “Dani” Stislicki (28) (last seen Dec. 2, 2016 leaving work around 5pm of parking lot of MetLife office on Telegraph Road, Southfield; her Jeep Renegade was found outside her apartment in the Independence Green complex in Farmington Hills; When Stislicki’s parents arrived, they found her vehicle in its normal spot-just eight feet from her door. Her purse, ID & credit cards were found inside her vehicle. Her phone, a Samsung Galaxy Core Prime with a rose-gold case & keys were missing. They contacted the police & initiated the first missing person report. Her belongings & her cat were still in her apartment. Police weren’t sure if she drove the Jeep to her apartment or if someone else did. Still not found) - *Floyd Russell Galloway, Jr. (29 @ time of crime/32/now 37) charged (9/11/19) & indicted (3/4/19) & arraigned (3/6/19) & re arraigned (9/19/19) with 1st degree premeditated murder. Plead not guilty. Bond denied-Held without bond. *Oakland County
Galloway pleaded guilty of the rape of a woman (6/27/17) in 9/4/16 to assault with intent to cause great bodily harm, assault with intent to commit sexual penetration & kidnapping. He was sentenced on Dec. 8, 2017 & his earliest release date is June 26, 2033.
Trial was set to begin on 3/28/24 but was cancelled due to appeal. Appeal was denied [9/21/23]. Now Appeal to Supreme Court . [COA364083-closed on 7/10/24]. Appeal [COA372374]. Appeal denied [11/15/24].
Oakland County Circuit Court Judge Phyllis C. McMillen was reassigned [12/15/24] to Judge Michael Warren presiding.

11/15/24 Docket update: Criminal Case: Opinion filed deny defendant motion to dismiss/Order. Defense Motion to Dismiss for deliberate intrusion is denied without prejudice. Oakland County Circuit Court Judge Phyllis McMillen has declined to dismiss a murder charge against the man accused in connection to the 2016 disappearance of Stislicki, but said the Michigan Attorney General's Office needs to appoint an "untainted" prosecutor to the case. McMillen denied Michaels' motion in a written ruling issued Friday, but said Michaels could refile it if prosecutors do not appoint an untainted prosecutor to handle the case after the parties figure out which evidence should be suppressed for the trial. Attorney General's Office spokesperson Danny Wimmer said a new prosecutor inside the AG's office will be appointed to handle the case after the evidence suppression motions have been handled.
