A jury was sworn in Friday after three days of selection in front of Judge James Biernat in Macomb County Circuit Court in Mount Clemens.

Assistant Macomb prosecutor Therese Tobin said Montaldi inflicted the severe injuries because they are inconsistent with a fall. The girl suffered multiple skull fractures, bruises on her face and torso, and tears in her vaginal area and anus.

Tobin noted that Montaldi called his girlfriend about 6:30 p.m. but never called 911.

The trial is scheduled to continue Tuesday.

I CANOT fathom that any of those jurors are going to believe this guys story! I mean, come on. But they believed Casey Anthony, so who knows. I hope these jurors have more common sense.

Awww, shucks. Maybe. I worked for BlueCross BlueShield for a number of years. I was on the phone all day calling doctors, hospitals, billers, heck even collection agencies. I have my phone harrassment skills perfected. lol

I hope at some point they will say how this baby is doing now. I hope she has recovered and can lead a normal life. And I hope this dirt bag gets what he deserves, his high powered attorney won't save him. :(

That was one of the first things that caught my attention early on- he calls his girlfriend at work, she comes home and SHE calls 911. Right. With that info, I'd convict of all charges right then!

So he says he was "embarrassed" that he fell down the stairs with the baby so he made up the story about the dog. If I were a juror, I'd be so insulted with this crap story. This high-powered, highly paid attorney can certainly come up with something better I think. Like he was in the bathroom and a rapist entered the house and did it. Or the baby did it to herself. Hmmm. Seems like the only likely story will be the prosecution's case.

Trial in child sexual assault and beating case to resume
The trial for a Mount Clemens man and former medical resident accused of beating and sexually assaulting a 13-month-old girl in December 2010 is scheduled to resume today in Macomb Circuit Court.
David Tyler Montaldi, 33, faces two counts of first-degree criminal sexual conduct and one count of first-degree child abuse. If convicted, he faces up to life in prison.

:seeya: OHHHH, DT-you should have put a little more thought into this...if this is your idea of what will create reasonable doubt...well. I think they should have gone with some kind of drug related episode.

I wonder if this man's blood or urine was tested?

This case almost brings me to my knees.

A snip from Belinda's story-
Sheriff’s Deputy Jason Haywood, the first or one of the first police officers on the scene, testified that Montaldi admitted he had been drinking alcohol, and prescription drugs were found in the home.

A preliminary Breathalyzer test indicated Montaldi’s blood-alcohol count was .063 percent, below the level of legal intoxication but within impairment.

Oh how did I know-huge mistake of the DT not capitalizing on this one...I wonder if the DT finds this client so distasteful they chose a strategy that would gtee a conviction.

Montaldi's trial continued today with more testimony. From who, I'm not sure, haven't been able to find any articles yet, but I'll keep looking.
I can't see how anyone could not find this "man" distasteful. Every time I run across a picture of him when I am searching I feel like throwing up. But Rabaut defends LOTS of disgusting people, so who knows if he separates himself from what his clients do, or not. I KNOW Montaldi is going to prison, I just know it. The sentence for 1st degree CSC in Michigan is any number of years up to LIFE. You know what we are all hoping he gets.

The laws need to be changed where anyone that sexually abuses an infant should be charged with attempted murder. So sick of these monsters running around hurting the most innocent of our race.

Montaldi originally said his 200-pound English mastiff sat on the child. His attorney, Michael Steinberg, said Tuesday that Montaldi now says his dog knocked the child from his arms while he was standing near stairs.

The girl suffered multiple skull fractures and other injuries.

Montaldi remains jailed without bond pending a March 28 court appearance.

Belinda, his jury selection started last week and the trial started this past tuesday however only a brief mention of this trial has been reported. It is beyond me why a freak like this is not being documented further, except that he comes from a family of doctors. That is why I posted earlier today about him being called one of the worst the judge had EVER come across from the March 2011 article. Melissasmom, has wrote & called all of the local media and still next to nothing reported.

Or the news just doesn't want to report on it...
It is possible that since the child survived the child's family doesn't want it reported on every step of the way.
Maybe the family doesn't want all the details out there... just the final verdict to protect the child?

They would still probably need some influence to successfully get their way... but it is possible it's coming from their side.

or an effort from both families...who knows. However, this 'man' needs to be in the spotlight so that society knows who and what he is, and he is not forgotten because he will do this again, given the chance. jmo

I haven't posted on this case in a few days, sorry. There was just nothing to post. All I can find is the information from the court dockets. That system is down today, so I am not sure if testimony is wrapped up or not. I will check again later.
I can understand if maybe the family doesn't want the details published every day. Or maybe the media just doesn't care, who knows. :(
I am going to try to find a direct phone number or email to the reporter who wrote the most recent article. If I can locate one I am going to contact him. It would be nice to know if the baby has recovered ok. I hate to feel like I am intruding on this family's personal tragedy, I just would like to hear that she is well.
If I hear anything, I will let you guys know. :)
