Bashara's lawyer warned by judge over investigative subpoenas

Detroit— Wayne County's chief circuit judge on Friday admonished Robert Bashara's attorney for improperly sending out investigative subpoenas.

Robert Bashara's attorney, David Griem, sent out investigative subpoenas seeking cellphone records from potential witnesses in the case. Those subpoenas were titled, "the People vs. Robert Bashara" — even though no such case exists. Bashara has not been charged in the case.

Wayne County Chief Circuit Judge Timothy M. Kenny on Friday ordered Griem to send a letter to the cellphone company withdrawing his requests for information.

"Court rules don't permit the investigative subpoena efforts you're making," Kenny said.

Griem claimed the subpoenas were sent in error, adding that he would address the issue today.

But Susan Reed, attorney for handyman Joseph Gentz who is charged in Jane Bashara's murder, said she did not believe Griem's explanation.

"I'm disturbed, and I'm not satisfied with that explanation," she said. "I want to pursue what happened and the intent behind this because I'm concerned about what he's trying to do to my client."

Lisa Lindsey, assistant Wayne County prosecutor, also said she did not believe Griem's explanation.

"I'm having a hard time with how the (subpoenas) made it out with a fictitious case name," she said.

Along with a first-degree murder charge, Gentz is also charged with conspiracy to commit murder — meaning prosecutors believe he did not act alone. Wayne County prosecutors have named Robert Bashara as a suspect in court filings.

Days after the murder, Gross Pointe Park Police Chief David Hiller said Bashara was the "only person of interest" in the case....

(WXYZ) - Bob Bashara’s attorney had to face a judge today to explain why he issued a subpoena which legal experts say violates the court rules.

Judge Kenny said the court rules do not allow Griem to send subpoenas for cases that don’t currently exist.

“I bear the weight of responsibility for my office. In hindsight, I would have not authorized my office to go forward with a subpoena, but I did,” Griem told Judge Kenny.

Griem says he was trying to get records from one of Gentz’s former employers. He admitted he also sent a subpoena to a cell phone company. Judge Kenny asked him to withdraw that subpoena as well. Griem has not gotten any of the records he was seeking. But he has filed a motion with the court of appeals. That motion is currently under seal.

Ribbons, Flowers, & Balloons for Jane's Birthday


"On this lovely morning by a pretty pond in at Patterson Park in GPP, friends and acquaintances of Jane --- brought together by J4J.forumotion --- gathered to remember her on her birthday with her favorite songs, a touching poem, some stories, the release of dozens of purple balloons, and more than a few tears.

Taking in coffee cakes and mimosas, we toasted Jane and reflected on how much she would have enjoyed the fete. After everyone arrived, Migraine read a poem with a theme of unjust loss and hope. Listening to Motown tunes, we penned loving thoughts on streamers later attached to balloons.

While socializing, a gaggle of balloons suddenly broke loose, as though Jane was saying “can’t wait for those kisses to arrive.” Finally the remaining dozen or so decorated balloons with streamers were sent skyward, accompanied by an emotional singing of Happy Birthday to You."

Justice 4 Jane Hosts Private Memorial Birthday

An anonymous group that has formed to support the continued investigation of the January strangulation death of Jane E. Bashara held a private memorial birthday celebration Friday, when she would have turned 57.

Jane E. Bashara would have tured 57 years old Friday.

Instead of celebrating herself, an anonymous advocacy group—Justice 4 Jane—held a private memorial celebration in her honor.

Bashara's violent strangulation death in January unnerved her neighbors, friends and residents throughout the Grosse Pointes. Her death and the criminal investigation into it became the focus of national media outlets who descended upon Grosse Pointe Park, often staging large trucks on Middlesex for days at a time.

Justice 4 Jane announced its creation earlier this month, revealing that the organizers do not want to be recognized individually in hopes of keeping the focus on solving Bashara's homicide case.

The group, which includes, friends, community members and crime victim advocates from across the country, had originally planned to have a candlelight vigil in memory of Jane Bashara on Friday. They have put it off until later this summer.

A spokesperson for the group said via email Friday that instead today the group held a private memorial birthday celebration. They released balloons and read a poem in her memory.

The group has been selling lawn signs, tree ribbons, wristbands and more, with the proceeds to be donated to some of Jane Bashara's favorite charities. Lawn signs and tree ribbons can be spotted throughout the Grosse Pointes, including across the street from the Bashara house in Middlesex.

Jane Bashara's husband, Bob Bashara, who has been named a "person of interest" in her death, still lives in the house. He has not a part of the Justice 4 Jane group, organizers have told media...

“In hindsight, I would not have authorized my office to go forward with a subpoena, but I did,” Griem told Judge Kenny.

Griem suggested that his assistant was to blame for the subpoena.

“I bear the weight and responsibility for my office,” said Griem.

Griem told the judge that he was trying to get Joe Gentz’s employment records from Tranor Industries in Detroit.

The judge, prosecutors, and Gentz’s attorney all questioned why the subpoena would bear the title “People v. Robert Bashara” when there is no such case.

The subpoena also had the wrong court address on it: it listed the Coleman A. Young Municipal Center – which houses the civil division of the court. The criminal division is inside the Frank Murphy Hall of Justice – a totally separate building.

“I’m having a hard time understanding when you filed your… motion as it relates to the handwriting sample, it made it to the right place. And then all of a sudden when they’re issuing subpoenas, with no case number on it, with a fictitious case name, it ends up with the wrong address and phone number,” said Assistant Wayne County Prosecutor Lisa Lindsey.

Joe Gentz’s attorney, Susan Reed, told Judge Kenny she was very disturbed by what Griem did.

“I’m not satisfied with the explanation. I intend to on behalf of my client pursue this to see exactly what happened and what was the intent behind this,” said Reed.

Larry Dubin is a legal ethics expert at the University of Detroit Mercy Law School. He says the judge could decide that Griem crossed the line with the unauthorized subpoena.

“There’s an ethics rule that says you’re not supposed to engage in any type of proceeding, that is frivolous, that is w/out merit,” Dubin told 7 Action News Investigator Heather Catallo.

Griem also told the judge that he issued a second subpoena for cell phone records.

Judge Kenny asked him to write a letter withdrawing the subpoena.

Griem has also filed a motion with the court of appeals but that is under seal, and it’s not clear when the court will issue a ruling.

Griem did not return calls seeking comment today.

Attorney David Griem, who represents the husband of a slain Grosse Pointe Park woman, said his office made a mistake in sending a subpoena seeking employment records for Joseph Gentz, the only person charged in the murder.

But after a hearing before Wayne County Circuit Judge Timothy Kenny today, Griem said he was trying to preserve evidence. He added he anticipates his client, Bob Bashara, will be charged in the murder of his wife Jane Bashara, who was strangled in January.

“Bob Bashara is out there,” Griem said. “We’re treading water together while the sharks circle us.”

Griem said he issued another subpoena to a cell phone company seeking Jane Bashara’s cell phone records, but he said Kenny told him to direct the company not to comply. Griem said he sent a letter rescinding the subpoena.

The first subpoena said Gentz worked as a “diesetter” for Ronart Industries, “which was subsequently purchased by Tranor Industries LLC.”

Griem said he still plans to seek Gentz’s work records.

“We are searching for the appropriate vehicle in order to go after those records,” he said.

If Gentz’s attorney can strike a deal with the Wayne County Prosecutor’s Office, Griem said he expects Gentz will testify against Bob Bashara.

“He’s bait,” Griem said of his client.

Griem has filed a motion with the Michigan Court of Appeals against prosecutors for what he has called their unconstitutional use of investigative subpoenas. A spokeswoman from the prosecutor’s office previously told the Free Press “and we are strictly precluded from speaking about it.”

Griem said he couldn’t discuss the motion, but believes the court could issue an opinion next week.

It was a war of words which has put a new twist on escalating tension between prosecutors and Bob Bashara's attorney, David Griem.

A subpoena has Griem in some hot water with a judge.

"He did it improperly," said Local 4 Legal Expert Todd Flood. "He doesn't have a case so he doesn't have the authority to do so."

Flood, a veteran attorney, said Griem is called into question for sending out subpoenas called "The People vs. Robert Bashara."

"He doesn't have any subpoena power," said Flood

Griem can't issue subpoenas if Bashara is not charged

"There is no matter of Bob Bashara in the court system, so (Griem) doesn't have the power or authority to send subpoena," Flood said....

Bob Bashara got into hot water over a dumb legal move.

Wayne County Circuit Judge Timothy Kenny admonished Bashara's attorney David Griem for issuing unauthorized subpoenas in the the Jane Bashara murder case even though his client is not charged. For now, only handyman Joe Gentz is charged, but Bashara is a person of interest.

WXYZ reported that legal experts said Griem can't issue a subpoena if there is no case against his client. Griem wanted employment records of Gentz.

Griem blamed an assistant in his office for issuing the subpoenas, but said he ultimately should take responsibility.

Judge Kenny asked him to write a letter withdrawing the subpoena, WXZY reported.

Given snarky Griem's improper subpoena issue, should BB be seeking new legal representation--further delaying the process?

Side note: Elated with the Jerry Sandusky verdict. Hope this snake spends the rest of his days locked up. Little consolation for his many victims but pray this gives them peace at some level. One more sick perp off the streets. Justice was served and trusting the same will happen for Jane in due time.

This forum is in place who TRULY seek justice for Jane Bashara WITHOUT accusation. The intention is to try bring those who knew and loved her some spiritual peace while waiting for justice. It is also a place for friends of those who knew her and geographically-distanced family to gather to console and support. Each day we cry, mourn and sometimes, smile when remembering a beautiful memory of a wonderful woman and human being. This has been a devastating loss.

There are many places with judgment, sensationalism and unknowledged nay-sayers. This is not one of those places. This is a safe haven for those who attempt to find a minute or two of reflection and peace amidst this terrible storm. Jane would have preferred it that way.
