David Griem named Warren city attorney

David Griem, a high-profile attorney whose clients have included murder suspects Bob Bashara and Stephen Grant, was appointed Warren’s new city attorney by Mayor Jim Fouts.

Griem is to replace James Biernat, a retired Macomb County Circuit Court judge, who is resigning from the city post, Fouts said in a release today.

Fouts is urging City Council to confirm Griem’s appointment.

Griem was born and raised in Warren and served as the city’s attorney in the 1980s, according to a release from Fouts’ office. Griem has conducted over 200 criminal and civil jury trials, according to his resume, and also has represented large corporations.

“Griem’s government and private experience will be a tremendous asset to our legal department and the city as a whole,” Fouts said

He most recently represented Bashara, a Grosse Pointe Park businessman accused in the strangulation death of his wife, Jane Bashara, in January 2012. Nearly a year ago, Griem asked to withdraw as Bob Bashara’s lawyer, citing an irreparable breakdown in the attorney-client relationship.

Griem was ordered to pay $8,000 in attorney and court fees in November after being found in civil contempt of court. He was accused of improperly sharing evidence with Bashara’s family and sending a subpoena to a company seeking work records for Joseph Gentz, a handyman who told investigators he killed Jane Bashara at her husband’s direction.

Griem also said he issued a subpoena seeking Jana Bashara’s cell phone records, but later rescinded the subpoena. A 36th District Court judge said up to the point of the charges, Griem had an “impeccable” record.

Well-known criminal defense lawyer David Griem has been appointed as Warren’s new city attorney.

The appointment, announced Wednesday by Mayor James Fouts and subject to confirmation by the Warren City Council, brings Griem back to the city’s in-house legal staff where he worked in the 1980s.

“Griem’s government and private experience will be a tremendous asset to our legal department and the city as a whole,” Fouts said. “I strongly urge City Council confirmation of this important appointment.”

Griem declined to comment, saying he prefers to wait for the confirmation hearing, tentatively scheduled for June 25.

WARREN — Mayor Jim Fouts has nominated high-profile lawyer David Griem to become Warren’s new city attorney.

The move comes with the pending departure of Judge James Biernat, who has led the city’s Legal Department since January 2011 but this year informed the mayor of his intention to resign.

Fouts announced Griem’s nomination June 12 and said he planned to send his pick to the Warren City Council for consideration later this month.

Griem declined an opportunity to comment on the nomination ahead of the mayor’s formal request before the City Council, which was expected to appear on the June 25 meeting agenda. He did, however, address the opportunity in a letter to both Fouts and members of the council.

“I fully expect to work many more hours over and above the normal work day schedule,” Griem said in the letter. “I have been doing that throughout my entire professional career.”

He also wrote, “My family roots are in Warren. I feel great affection for this city in which I was born, raised and attended high school. I look forward to coming back and doing everything within my power to see that the city of Warren receives the best possible legal services at a reasonable price.”

Griem has worked as a prosecutor at both the county and federal levels. He briefly served as Warren’s city attorney under Mayor James Randlett in the early 1980s.

As an attorney in private practice for more than 30 years — specializing in criminal and civil litigation, according to his bio — Griem represented defendants in many high-profile cases, such as Stephen Grant and Bob Bashara. Griem also defended former Warren City Council President Chuck Busse, who was acquitted of federal public corruption charges in 2003.

Fouts said Griem is “one of the top attorneys in the United States” who is coming back to his roots in Warren, seeking a challenge.

“He grew up in Warren. He’s a hometown boy,” Fouts said. “He’s his own person. He’s very strong-willed. I think we’re going to get a pretty good deal for the money.”

The salary for Warren’s city attorney was $112,117 last year, according to the adopted budget.

In 2010, Biernat opted not to seek re-election as a judge of the Macomb County Circuit Court prior to his nomination as Warren’s city attorney. Fouts called Biernat, “a person of high ethical standard.”

“Unquestioned ethics, and a real decent human being,” Fouts said. “Someone who is a good example of the public trust.”

Bashara smuggled ketchup, sugar and jelly in prison, officials say

Behind his prison walls, former Grosse Pointe Park businessman Bob Bashara has been accused of lying and being in possession of stolen property.

The items taken include five packets of ketchup, six packets of sugar, 11 packets of jelly, four napkins and a spoon, according to a Michigan Department of Corrections misconduct report released to the Free Press.

The items, belonging to the Oaks Correctional Facility in Manistee, were discovered inside Bashara’s wall locker during a cell shakedown June 9, the report said.

Bashara also is accused of lying about how he obtained the items from the prison. He admitted taking them, but said he was given permission to remove them, a claim a prison official said wasn’t true.

“This prisoner had no staff authorization to remove any item,” the report said.

In addition to the June incident, Bob Bashara was disciplined for not showing up for a call-out on May 30, according to another misconduct report. He lost his privileges for five days in connection with that incident.

Bob Bashara is locked and now in trouble for what he did with ketchup, jelly, spoons, napkins and sugar.

The convict's secret ketchup consumption and his desire to horde condiments has him in trouble with prison guards in Manistee, Mich., where he is being held. The Local 4 Defenders have obtained misconduct reports regarding Bashara.

It appears "Big Bob" lost all privileges for five days after it was found he stole a variety of items from the chow hall and then lied to officials about whether he was given permission.

The report was filed June 9. Bashara was cited for possession of stolen property, theft and lying.

On May 30, Bashara also was written up for being "out of place," which means he was not where he was supposed to be at a scheduled time in prison.

"When a man sits in prison and he causes a ruckus in the prison it's going to make it difficult for him to survive in a lot of different ways," said legal expert Todd Flood.

The problems may not affect Bashara's trial, but they could affect his life.

"He's going to be more restricted. He's going to be put into difficult places. He's not going to be able to take care of his defense as well. He's not concentrating on his defense. His life is going to be in turmoil as this goes on," said Flood.

Warren council to vote on Griem appointment

Well-known criminal defense attorney David Griem has made a living by grilling individuals, but Tuesday night, he could face tough questions.

Griem recently was appointed by Mayor James Fouts to head the city’s in-house legal staff recently, a job that pays $112,000. Under the city charter, the selection of the attorney or must be confirmed by a majority of the Warren City Council.

Council members will likely query Griem about his hope to return to the same job he held in the 1980s. In between, he worked as principal trial attorney at the Macomb County Prosecutor’s Office, chief federal prosecutor at the U.S. Attorney’s Office in Detroit, and in private practice representing accused criminals. He also has defended large corporations in tort, contract and business disputes.

In urging the council to endorse his choice, Fouts said that Griem’s government and private experience would be “a tremendous asset to our legal department and the city as a whole.”

Council President Cecil St. Pierre predicted that a majority of the seven-member council will support the mayor’s nomination of Griem.

“There’s really no reason not to adopt his recommendation, because of (Griem’s) background, knowledge, reputation and just a good overall pick,” said St. Pierre, who works as a lawyer

St. Pierre said the passage of more than two decades since Griem tackled municipal law on a full-time basis shouldn’t be a problem for the city. The city charter hasn’t changed drastically since the 80’s, but numerous new ordinances have been passed or amended.

“I believe for him, it’s going to be like riding a bike,” St. Pierre added.

Only the Local 4 Defenders were in court Thursday for a hearing to lay out some information in the upcoming trial of Bob Bashara.

The Defenders learned the trial will likely be long, and very detailed. There's nearly 8,000 pages of discovery and witnesses will be flown in from across the country to testify.

"Mr. Bashara hired a private investigator to search out the "real killer" in the case and that investigator amassed several different witness statements from people. It is my belief that those things are discoverable," said Lisa Lindsey, of the Wayne County Prosecutors Office.

The potential key witnesses include Bashara's former mistress Rachel Gillette and a mystery woman from Oregon. Bashara's son, who currently lives in Iowa, may also be called to testify.

"At this point I'd like to certainly meet with the attorneys on a fairly regular basis," said Bashara.

Bashara asked many questions and was concerned his attorneys may not have enough time to prepare for the trial.

The preliminary hearing for Bob Bashara will be held in September.

Bashara court hearing rescheduled

The next court hearing for murder defendant Bob Bashara was pushed back three weeks Thursday and turned into a conference, according to Wayne County prosecutors.

Bashara’s Aug. 19 preliminary examination was rescheduled as a “pre-examination conference” among attorneys and the judge, and the exam was moved to Sept. 9 in front of Judge Kenneth King of 36th District Court in Detroit, prosecutor spokeswoman Maria Miller said. Bashara, 56, of Grosse Pointe Park, is accused of arranging the slaying of his wife, Jane, 56, a Mount Clemens native, at their home in January 2012.

The change came two days after it was revealed that Bashara, imprisoned for trying to hire someone to kill Joe Gentz, was disciplined for smuggling condiments from the cafeteria at Oaks Correctional Facility in Manistee. A prison guard found 11 packets of jelly, six packets of sugar, five packets of ketchup, four napkins and a spoon inside the wall locker of his cell, according to a misconduct report by the Michigan Department of Corrections.

Bashara also lied to a guard about taking the condiments. He claimed he had permission from a corrections lieutenant, who denied he gave him approval.

Bashara had his prison privileges revoked for five days, on top of another five days for his May 30 violation for failing to show up for the “Law Library callout,” the report says. “Not attending is out of place,” the report says.

Meanwhile, the rescheduled preliminary examination will determine whether probable cause exists to advance Bashara’s case to Wayne County Circuit Court for a trial.
