• A hearing for Bob Bashara’s former lawyer David Griem is scheduled for today (before Chief District Judge Kenneth King at 12:30 p.m. Friday, Oct. 12.) in 36th District Court in Detroit. The hearing is to determine whether Griem violated a protective order by sharing evidence and also because Griem issued unauthorized subpoenas to gather evidence about Joseph Gentz and other material.

• Gentz’s arraignment is scheduled for Tuesday (at 9 a.m. on Oct. 16.) in Wayne County Circuit Court. He is charged with first-degree murder and conspiracy in the slaying of Jane Bashara and waived his preliminary examination last week.

• Bob Bashara’s sentencing for pleading guilty Thursday to solicitation to murder is scheduled for Nov. 20 (at 8:30 a.m.).

Experts: Plea is gamble

• Legal experts and those close to the case said the plea was likely made because prosecutors had a strong case.

• Kriger declined to comment after the hearing.

• Family members of Jane Bashara, who was found strangled in January, declined to comment Thursday.

"We're aware of what happened, and we don't have any comments," her sister, Julie Engelbrecht Rowe, said.

• Bob Bashara's mother also declined to comment.

• Gentz's attorney, Susan Reed, previously said her client would be willing to testify against Bob Bashara if he is charged in his wife's killing. Reed could not be reached for comment Thursday.

• Wayne County prosecutors are not sharing details — if any exist — related to admission of guilt by Bashara and the punishment guidelines they are recommending.

DETROIT — A day after Bob Bashara pleaded guilty to soliciting the murder of his handyman David Gentz, his original attorney David Griem is to appear in court for a show cause hearing.

Griem was accused of disclosing information from Bashara's murder-for-hire case, in violation of a protective order, with Bashara's mother; and he is now accused of by Susan Reed, Gentz's attorney, of issuing a subpoena for a nonexistent case, The Detroit News reports.

The show cause hearing goes before Chief District Judge Kenneth King at in the 36th District Court at 12:30 p.m. Friday.

A clerk for King could not provide any further details about the hearing as of 10 a.m. Friday and said the case file was likely unavailable and in possession of the judge with the hearing time so near....

Former Bashara attorney to face judge over evidence-sharing

Detroit — The first attorney Robert Bashara retained after his wife was killed is scheduled to appear before a judge Friday to explain why he violated a court order by sharing evidence with his client's relatives.

David Griem represented Bashara after his wife Jane Bashara's body was found Jan. 25 in her SUV in an alley on Detroit's east side, but asked to withdraw from the case because of an unspecified breakdown in the attorney-client relationship.

Griem and co-counsel Christina Utley were allowed to withdraw, and Bashara retained Mark Kriger as his new attorney — but not before prosecutors informed 36th District Chief Judge Kenneth King that Griem had shared evidence with Robert Bashara's family after King had issued a gag order in the case.

Griem admitted to King that he shared the evidence with Bashara's mother and another relative.

In a separate matter, Griem also admitted he sent out paperwork bearing the title "The People vs. Robert Bashara," when no case yet existed.

King is scheduled to rule on whether to discipline Griem at a 12:30 p.m. show cause hearing...

Bob Bashara plead guilty to hiring a hitman to kill Joseph Gentz. Genz is the handyman accused of murdering Bashara's wife, Jane, back in January.

Prosecutors are after seven years in jail while the defense hopes for closer to four years.

Former Bob Bashara attorney David Griem accepted responsibility in court for violating a protective order in the Bashara case and will face a sanctioning hearing on Nov. 26 in 36th District Court in Detroit.

Griem apologized to the court and the Wayne County prosecutor for violating the order that prohibited information from being shared with any third party.

In another case, Griem also accepted responsibility for filing a subpoena for a non-existent case involving handyman Joe Gentz.

The former attorney for Bob Bashara — the Grosse Pointe Park man who has been called a suspect in his wife's murder — today admitted responsibility to civil contempt of court charges.

David Griem was accused of improperly sharing evidence with Bashara's family and issuing unauthorized subpoenas. He was initially facing criminal contempt of court charges but pleaded responsibility to civil contempt of court.

Griem is due back in court Nov. 26 for a hearing about possible sanctions.

Neither Griem's attorneys nor an assistant Wayne County prosecutor would comment after the hearing.

Griem no longer represents Bashara, who pleaded guilty Thursday to a charge of solicitation to murder Joseph Gentz. Gentz, a handyman, told police he killed Jane Bashara at Bob Bashara's behest.

"Your honor, as someone who has been an attorney for over 35 years and takes his obligations as an attorney serious, I'm particularly embarrassed to be in this situation," Griem said to 36th District Chief Judge Kenneth King at today’s hearing. "I had notice of the protective order in this case and I did, in fact, violate it. I did not intend to violate the order, but I did not pay attention to the details, and it was my obligation to do so."

Griem also admitted he improperly issued subpoenas seeking information about Gentz, who has been charged with first-degree murder in Jane Bashara's death. Griem filed a subpoena to a company seeking Gentz's employment records. At the time, Bashara had not been charged, but the subpoena listed the case as People of the State of Michigan v. Robert Bashara.

Legal experts told the Free Press that state law has no provision allowing a defense attorney to issue a subpoena without a pending case.

"I did not intend to cause improper subpoenas to be issued, but I erred as to that matter also," Griem said today.

He apologized to the court, Wayne County prosecutors and to Susan Reed, Gentz's attorney.

"Finally, I want this court to know this is not the way I practice law," Griem said, adding that he has spent time reflecting on how he made these mistakes. "I never want to make such a mistake again."

Bob Bashara’s former attorney, David Griem, pleaded responsibility Friday to civil contempt of court charges.

Griem had originally been charged with criminal contempt of court for allegedly handing over evidence to Bashara’s family members – a direct violation of a court order.

“I am in this situation because of my own mistake,” Griem told the court. “I did in fact violate it. I did not intend to violate the order, but I did not pay attention to details. It was my obligation to do so.”

Griem apologized to the court and Wayne County Prosecutor’s Office.

“This is not the way I practice law,” he said.

A sanctioning hearing is set for Nov. 26.

Griem’s hearing comes one day after Bashara pleaded guilty to trying to hire a hit man to kill the suspect who is awaiting trial in his wife’s death...

Bashara strategically planned guilty plea while in jail


DETROIT -
Bob Bashara has been sitting in the Wayne County Jail but he hasn't been idle.

Bashara, who pleaded guilty this week to trying to have a suspect in his wife's murder killed, has been busy spending a significant amount of time meeting with his attorney and talking on the phone in his jail cell.

As the Local 4 Defenders previously reported, Bashara was blowing up the phone talking with a woman in the S&M community. The woman on the outside has been helping him tie up loose ends in some of his real estate deals.

Recently, those close to the case say all Bashara has been talking about on the jail phone, which is a recorded line, is working to get his deal done. He pleaded guilty Thursday to trying to have Joe Gentz, who is charged with murder in Jane Bashara's death, killed. Gentz also is Bob's former handyman.

The Defenders have learned investigators have been keeping close tabs on Bashara in the jail. They knew he was desperate to have this part of the investigation resolved. He called to his attorney, family members and friends for help in striking the deal. The behavior has exposed what some have called a frantic man who needed some control. Entering the guilty plea on his terms was part of the plan.

If Bashara, who is called a suspect in his wife's murder, is actually charged for Jane's death, how does the defense handle this admission of guilt?

"If he gets charged with the homicide case on Jane, it's, 'Hey listen, I wanted the man that killed my wife put away and I wasn't going to wait for the justices to do it," said Local 4 defense expert Todd Flood.

As part of an agreement with the Wayne County Prosecutor's Office, Griem on Friday accepted a finding of civil contempt, avoiding a possible ruling of criminal contempt.

Addressing King, Griem admitted violating the judge's order but said he did not do so intentionally.

"I did in fact violate it. I did not intend to violate the order, but I did not pay attention to the details when it was my obligation to do so," Griem said. "I apologize to this court."

He added later: "This is not how I practice law. I've spent a great amount of time reflecting on how I came to make these mistakes, because I never want to make this kind of mistake again."

King accepted Griem's statement and scheduled a sanction hearing for 9 a.m. Nov. 26.
