Thursday, November 20, 2014, the twentieth day of testimony. Three witnesses today.


First, the 54th witness, Russell Achatz, a friend of Joseph Gentz.
Met JG in the early part of 2010 at a gas station. RA managed a restaurant in St. Clair Shores.
RA gave JG a job cleaning up, a couple of hours, at night.
JG had a hard time concentrating and sticking to the system when not being supervised.
RA believes JG is mentally challenged and compared him to an 8 to 13 year old child.


Second, the 55th witness, Steve Virgona, knew JG for 15 years on and off.
They met while in high school.
In 2010, they hung around more and became good friends.
Their daughters went to the same school.
SV drove JG around a lot. They were roommates for awhile.
In October, 2011, he helped JG move his belongings to an apartment JG rented from bb.
JG talked to SV about a guy, named Bob, who wanted to do "a hit and run on his wife".


Third, the 56th witness overall, Michael Carmody, knew Jane for 3-1/2 to 4 years.
In 2011, he was friends with bb. MC was active in Rotary with bb.
MC had a house next door to the house bb was trying to buy on Kensington.
MC had contact with bb the day Jane was murdered and afterward because he was bb's friend at that time.

Thirteen additional witnesses were waived today.

Court will be held on Friday, November 21st, until 2:00 p.m.

Took me quite long time to make those screen shots / cut them / save them ... upload them ... and then post 'em ...

Even though I am pretty good with that stuff .. but was quite an effort anyhow ...

Wasted time though ...... oh well ... Live and learn ...

This case will be over before we know it though ... :)

Does anyone know the reason why so many witnesses (to be called) have been "waived?" Is it because their testimony would be redundant, or what? Because everyone's in a hurry for the trial to be over before Christmas? Why are witnesses waived? Thanks!

Grammy, I don't know the exact reason/s why witnesses have been waived. My observation is (after seeing a few names of those who were waived) is that they are people who were mentioned within a primary witness's testimony. In other words, at least some of those waived, were named by a witness within their testimony.
Afterwards, the court decided they don't need to call those people to substantiate what the primary witness testified too.
I believe the first time we read that witnesses had been waived I noticed that their names were mentioned already in previous testimony. That may be one reason anyway.

Also, by googling, I found "at a trial, the prosecutor generally does not call all potential witnesses to testify..."

They may have more witnesses lined up but, as a trial proceeds, the lawyers decide all of them aren't needed.

Those waived must be so happy! :great:

Trial Week Seven ~

Monday, November 24, 2014, the twenty-first day of testimony. Seven witnesses testified today.


First, returning witness No. 56, Michael Carmody, bb's former friend from Rotary Club.

bb repeatedly said that Rachel Gillett was a friend.
MC testified, "I came to the conclusion if Bob's lips were moving, he was telling me a lie."


Second, the 57th witness, Sgt. Tuana Powell, with the Special Investigation Section of the Second District Headquarters, Michigan State Police.

Assisted Investigators from the Wayne County Prosecutor's Office in locating a weapon.
They all went to the Buhl Building together where Attorney Ken Magill joined them.
They continued to another building and took an elevator up to a secured floor where David Griem's office was located. DG surfaced and took them to his office and indicated which desk drawer to open to retrieve the .32 caliber revolver.


Third, the 58th witness, Patricia Matthews, Jane's best friend.
A woman represented PM on the stand and read PM's prior testimony from a transcript.
Not sure if a reason was given as to why PM was unavailable to testify in person today.

Earlier she testified she caught bb in a lie. He told Jane he went on a golf trip to Florida in December 2011.
During this time, bb was with his mistress, RG, attending her daughter's wedding in SC.

Another time Jane told PM, bb was gambling on Saturday and would sleep over.

When bb went to Oregon to meet JL to explore a lifestyle partnership deal, he told Jane he was attending a Sanitation seminar.


Fourth, the 59th witness, Deborah Breen, she met the Basharas 22 years ago. She was Jane's friend.

DB heard a bunch of lies from bb after Jane was found dead. She confronted him about the details she heard in the media. She asked him if there was a sex dungeon. He told her the media was trying to make him look guilty and that it was a storage area."There's no such thing as a sex dungeon," Breen said Bashara told her.

DB believes Jane would never have agreed to an "open marriage".

DB was present when bb spoke to his son over the phone. She heard bb tell his son his mother was murdered.

Bashara told DB, "I had to lie." He said his lawyer was telling him what to say.


Fifth, the 60th witness, Loraine Muccioli, a Realtor with Johnstone and Johnstone.

bb began by telling LM he was divorced. Claimed he lived in a home on Middlesex where he lived in one half of the house and his ex-wife lived in the other half.

bb told LM he was going to pay cash for the Kensington house.
bb went to LM's office at 3:30 p.m. on January 24th. Early in the evening on the 24th, Jane was murdered.
bb hoped to close on the house on Friday.
bb called LM and told her his wife was missing so the closing would have to wait.


Sixth, the 61st witness, Eileen Stratelak, she knows bb as their girls played volleyball together.

bb told Eileen she was the last friend to speak with Jane on the phone, January 24th.
Jane told ES that she was going home to relax.
bb told ES not to believe the media reports.
bb told ES he went into his house sometime around 6:00 p.m. the night Jane was missing.

McCarthy asked ES ~ In March 2012 - you still considered bb a friend?
ES ~ "I considered him guilty."


Seventh, the 62nd witness overall, James Krausmann, Krausmann Home Inspection Services.

JK inspected a home on Bishop where he met bb and RG. He thought they were married.
He inspected the house on Kensington on December 3, 2011.

Is anyone else having a hard time reading Amy Lange's blog today? It seems to be in a totally different format and it's just about illegible...font type is smaller and VERY light. I've got a headache from following it since court began today. Anyone else notice big difference, or did my eyes suddenly go bad overnight?! ha!

The Real Estate agent said she was surprised Bob wasn't wearing some sort of a coat or something (cuz of cold weather) ... --- from testimony of last couple of days ...

Trial continues on Monday.

Wow reading WildChilds post above from Trial it appears Bobs issue is kidney? Wonder if it's a kidney stone? I have had one and Oh Man that's pain beyond description. If it is has Bob's Karma begun? LOL

A power outage in downtown Detroit has interrupted the trial against Bob Bashara.

On Tuesday morning, moments after one of the charges against Bashara was dismissed, lights began to flicker at the Frank Murphy Hall of Justice. The power went out at the building. Power has been restored, but the courthouse is closed for the rest of the day.

More than a dozen cases were taking place and more than 1,000 people had to be evacuated from the building within 15-20 minutes...

Bette -- And the judge apparently took it (the power outage) as a "sign" to dismiss the charge. OMG! In any event, it sure will be interesting to see the outcome of this trial. I'm sure as hell not getting my hopes up for life w/o parole... Sure hope I'm wrong.

WDIV update on 4:00 news: Defense has rested in the Bashara case. Closing arguments next Tuesday. Jury gets case following.
