Kimora Hodges, 23, is charged with felony murder and first-degree child abuse in the July 2022 death of Kyrie Starks, 22 months old, who died a week after being hospitalized for a head injury.

Part of a murder defendant’s statement to police has been thrown out by the state Court of Appeals because a Roseville detective continued questioning her despite her request for a lawyer.

Approximately the final third and potentially most damaging part of Kimora Hodges’ nearly three-hour statement to a detective was ruled inadmissible by the appeals court in a recent 2-1 opinion that overturned Macomb County Circuit Judge Diane Druzinski.

After nearly two hours, Hodges, who at times wept during the interview, said: “I need a lawyer or something. I need a lawyer.”

However, Houstoulakis, who at that point was alone with Hodges continued questioning the defendant who made admissions.

In the circuit-court evidentiary hearing held regarding the statement, Houstoulakis testified “he did not feel like defendant was asking for a lawyer at the moment” and “asserted he attempted to clarify whether defendant wanted to end the interview by asking her whether she wanted an attorney or wanted to proceed with questioning,” according to the opinion.

But the two majority judges, Thomas C. Cameron and Anica Letica, countered those claims.

In his minority dissenting opinion, Judge James Robert Redford says the entire statement should remain in the case against Hodges.

Redford says Hodges “re-engaged the topic” of the incident, and Houstoulakis “twice more “asked defendant if she did not want to talk anymore. Defendant continued to speak about the underlying incident and affirmed that she wanted to talk.

The case is scheduled for an Aug. 14 status conference.

Hodges is being held in lieu of a $250,000 bond.

In a civil matter, Hodges, in response to a custody action filed by the father of her child, consented to give up custody, according to Macomb Circuit Court records.
