He may be a strong man physically, but is also very weak mentally. I don't think he'll hold up well emotionally in the gathering storm, and I hope that the truth leaks out of the cracks as he breaks apart. Soon.

IMO he's a 🤬🤬🤬. What he has done to his daughters is horrific! I hope he talks but I doubt it. It's all about saving himself.
I just wish he would have told his imposter/body double what he did with Venus. Cause he is singing like a canary to save his arse.

Circuit Judge Paul Stutesman postponed the trial Wednesday following a hearing in his courtroom. Stutesman said this morning that the delay is needed to address a motion that was filed regarding the admissibility of some witness testimony in the case.

Stutesman said he will hold another hearing soon where testimony will be taken from the witnesses so he can decide whether their statements would be admissible at trial.

Based on this article, it looks like there are several big issues on the table that necessitated the delay of the trial - potential change of venue, potential reassignment to a new judge, and hearing on the admissibility of hearsay evidence. It sounds like folks here are most interested in what the testimony couls be.

Based on this report, it sounds like the hearsay evidence includes statements Venus made before her disappearance. As you probably know, hearsay is normally inadmissible because the defendant does not have an opportunity to cross examine the original speaker and the jury has no opportunity to evaluate the credibility of the speaker. The rules of evidence allow certain exceptions to the prohibition on hearsay where there are circumstantial guarantees of the trustworthiness of the statement.

Hearsay testimony might be admissible if it fits one of the following categories:
  • a statement by Venus offered against a party who intentionally or knowingly engaged in criminal conduct that directly caused her death;
  • a statement by Venus relating to a startling event made while she was under the stress/excitement caused by the event;
  • a statement by Venus of her then existing state of mind, emotion, or physical condition; or
  • a statement made by Venus while believing that her death was imminent, concerning the cause or circumstances of what Venus believed to be her impending death.

In a nutshell, the testimony at issue is probably a friend or family member of Venus who will testify that Venus said something that implicates Doug. Typically, if such testimony is to be admitted, the court needs to make sure that the defense has plenty of advance warning so that it can effectively prepare an impeachment or rebuttal.

I'm stunned that this trial is beginning so soon. I had hoped that LE would find Venus' body before trial.

Doug Stewart murder trial on hold as defense attorneys try to have judge disqualified

CENTREVILLE — St. Joseph County Circuit Judge Paul Stutesman has postponed the murder trial of Doug Stewart pending an appeal seeking to disqualify the judge from the case.






The motion said that Stutesman provided the assistance to McDonough following a conference call between the judge, McDonough and the Schroeders on Sept. 22. When the conference call was completed, the Schroeders say, Stutesman’s speaker phone did not hang up and they were able to overhear the judge and McDonough “continue to discuss the case specifically.”

During the discussion between Stutesman and McDonough, the motion said, McDonough “continued to protest having to list his witnesses;” Stutesman gave McDonough direction on how to answer a discovery request by the defense team “in a minimal fashion”; that Stutesman told McDonough he did not believe the Schroeders had any motions and “was seeking an adjournment of the trial,” and McDonough “asserted to the judge that defense counsel plays dirty.”

I don't know if they're still looking, but I still pray she is found every day!

I also pray that all the evidence is able to be played out in the trial so that the truth is known. The defense pushed for a speedy trial and now they're back tracking big time, so I'm pretty confident in my opinion that Doug is guilty.

On the good side, it might give some extra time to find her body. Now that the overgrowth is dying back maybe a hunter will stumble upon her grave.

I updated the case archive album with the 3 news stories of the past couple weeks.

I check every morning for any news on this case. Today, I FINALLY found an article. It's not much...but It's something.

Police ask hunters to be on the lookout for Venus Stewart's body

Anyone heading into the woods is asked to look for a gray t-shirt, pajama bottoms, and Croc-style shoes. That's what Venus had on when she was last seen.
