one thing about the neighbors account- she said the daughter got the school bus every morning somewhere i read that on here - what 18 month old gets on a school bus????

not Cesar's child...the neighbor's child goes to school...

Is anybody else here worried about the fact that the sheriff keeps talking about the suspect in terms assuming that he is the perp, he is quilty, instead of saying "alledged" suspect. I mean, we all know he is quilty but this could hurt the case, grounds for change of venue, etc.

It's a given that a person is 'innocent until proven guilty.' IMHO, it shouldn't hurt the case against the suspect if the sheriff talks as if he's guilty. After all, when LE goes after a perp, it's because in 'their eyes,' the suspect did the crime. It's up to the pros to prove it.

A panelist on NG pointed this out last night that the sheriff, while he was sure he was good at his job, was talking and telling too much. I tend to agree and I think that he is giving the eventual defense atty alot to work with...

There were two sightings. One was thye night of the 10th about 6:30 PM when she saw the couple arguing and was trying to hear. Then the next morning at around 6:30 Am

right, the neighbor said Cesar was gone at 8 am that morning, when his daughter left for school.....Cesar fled some time betw 6:30 am & 8 am...

She claimed it, took alot of abuse and harassment, claimed it with family, authorites, suffered greatly from the consequences of the assault, and obviously he had some kind of motive to kill her. And it wasn't a soft kill, there's pure rage, vengenance and evil at work here.

I believe her. What a shame, her own murder will cause this to be questioned even further. The rape will hopefully be on the charges in the prosectuion. We don't even know if there's not a hospital report and visit for a rape kit exam, do we? The way maria was on top of everything concerning this assault, i believe she may have went to the hospital, won't that be something.

Was just going to post about the possibility of a rape kit. That is mandatory if Maria went to the hospital after the rape. So why the delay in Cesar have his day in court on that charge?? Is it normal for the military to take 8 MONTHS to hold a hearing on an officer's allegations against another officer?

right...if Maria didn't go to the hospital after this assault, then her claim of rape would be "he said - she said"......like i said, i don't think we'll ever know for sure.......

eta...course if there's no physical injuries, it could also be a "he said - she said"...especially if the two were still on friendly terms afterward....don't get me wrong; i think rape is a horrible horrible crime, but let's face it...the charge has been used against men for years, when it didn't actually happen....

Unfortunately the legislators here haven't adopted the law here.

wonder why he would use the lie about her cutting her throat???...if he was going to lie, why not say she shot herself??...very strange about the throat cutting...hmmm

If that was the case, then it would explain why there had been an 8 month gap between Maria filing the charges and Cesar (which we no he hasn't) having to be facing that charge in front of either JAG or outside the military setting. (Which is probably not applicable if it happened on base).
