That makes it unlikely that Laurean would be prosecuted under the federal fetal homicide law passed in 2004 during the height of attention to the California trial of Scott Peterson, who was accused of murdering his pregnant wife, Laci. The law makes it a crime to harm a fetus during the assault of a pregnant woman.

The military could seek charges at the same time as civilian authorities, said Scott Silliman, a former military lawyer who is now director of the Center on Law, Ethics and National Security at Duke University. But a joint prosecution is not recommended by the military's manual for courts-martial, Silliman said.

A rape kit would only prove that his semen was in her vagina. I'm sure there was more involved than just rape, possibly bruises, etc. while she was trying to defend herself.

A rape kit would not prove that he was the father of the baby. Only a DNA test can prove that.

I thought she had filed charges earlier, that's why she was being harassed on base and had to move.

They are marines and they have guns.

CE the reason he did not say a gun is because they would then be able to check ballistic as to when it was last fired.

I don't think that there was a rape kit ... otherwise there would be no need for the statement about the paternity of the child possibly proving her claim.

I understood that she didn't report it immediately either so there wouldn't be a way of proving rape or not.

JDB, that's not true. Neither my husband or brother had guns while serving. I can't imagine why a personnel clerk would be issued a firearm.

Maria filed charges in April 07 didn't she? That was the reason for the protective order against Cesar that was reniewed very 90 days.

i don't know....why make up a lie about her cutting her own throat?....i know he couldn't very well say she beat herself to death, so why not lie & say she shot herself instead....at least that would be more believable...that's all i'm saying...
i think it's still possible he DID cut her throat, but with the body being burned, there's no way to tell....maybe she didn't die quite as fast as he wanted her to, so he beat her afterward.......just speculating as to why he would even say she cut her own throat....

That makes sense to me SuzieQ. I have been wondering why he would leave a note like that and to take complete blame makes total sense. The wife probably talked him into it, saying something like if you don't say it was just you who did this then no one will be there to raise our daughter.

The ME is looking at her burned remains. Blunt force trauma would be recognizable because of skull Fx but maybe all flesh and soft tissue is burned off her neck? Or it could be that CL thought they wouldn't be able to tell what the COD was so he just put that she sliced her throat to absolve himself of her death.

That's what I thought. Sooo...the only way that Laurean would be proven a liar would be if his story was if he denied sex with her at all. That's what he probably did. If he had said that they had consensual sex, proving that the baby was his would not be the issue; thereby, no need to kill her.

I mean, what are the chances that a girl would get pregnant from one time? I'm sure that it was his worst nightmare, all the way around.
