That's a mistake. That is not the retrial. That is the trial for his contempt/violating the gag order. The judge said they'll discuss whether or not this case will be retried.

Disappointed. It must feel like torture for Heather's loved ones. Justice keeps getting whittled away and the guilty parties smile smugly.

Did they poll the jury? I missed it - stupid work stuff!

I am SHOCKED - they made us keep deliberating for over 30 hrs for the case I was on. I am thinking it had to be a one juror hold up? Someone who was just not going to budge. We had 3 in our case - but we finally came to a verdict.

9 hours - and DEADLOCKED and Judge declares mistrial? SMH Guess that's what happens when the judge is daddy's friend and your attorney has a friend on the jury. :(

The way they gave up so quickly leads me to believe the same.....one person who said, "no way, no how. I'm not budging."

I'm just sick!! I had to step away for a meeting and came back to this news. I guess it's better than a not guilty, but it's shocking. I want to know how many hold outs and why! Will this go before another Judge?

I'd like to know the numbers, and I'm hoping the jurors talk. I've been assuming 11 guilty, 1 not guilty, but for all we know, it could actually be the opposite. The sad truth is nothing will bring Heather back.

I am with some of you, one person just wouldn't budge.. Sad, I really thought the verdict would come back guilty.

I am glad there will be a trial for gag order violation. Also the judge mentioned that there was enough evidence for a civil trial as well.

Why does the gag order violation even need a trial? Seems like the judge could make a ruling on that in a short matter of time. It's pretty clear cut.

If they do retry him, I hope the State reads HERE and heeds some of the recommendations of things they should have done/questions they should have asked.

Speaking of sloppy reporting. Am I reading this right or WTH is this? If this is wrong, they need to correct this. 2 Errors I see here

"While Sidney Moorer has been found not guilty of kidnapping in this case, his wife, Tammy Moorer, is still charged with kidnapping, and her trial date has not yet been set. Sidney Moorer also still faces a charge of obstruction of justice for allegedly lying to investigators about making a call to Elvis from a pay phone on the night of her disappearance.

Prior to the jury rendering the verdict Thursday, they listened to four days of testimony from a case that has been two-and-a-half years in the making.
