I am hoping the friend will testify to the contents of the reason of the call. From my recollection the friend was told by Heather why he called and what he said.

I hope that is not considered heresay since it is coming directly from the friend hearing what Heather told her.

I don't see how Bri's testimony can be dismissed as hearsay when allot of the Defense is using the same type of testimony about Heather's "family problems".

Morning friends! :seeya: I hope today brings more answers than questions and that everything is as calm as it was yesterday. I assume there will be more people in the courtroom today but hopefully TM is NOT attending at all since she wasn't there yesterday. Again today, I'm feeling emotional as I am sure a few of you are as well. We have been waiting 2 1/2 years for this and it makes me feel all sorts of ways that this can go either way opposed to just locking them both up and throwing away the key. I can't imagine how the Elvis family is feeling- if you are reading here, you are still in my prayers and I send you all of the virtual love I have today! :heartbeat:

Good point. The defense entire case is the same scenario for anyone they choose to put on stand.

I hope SM gets on the stand and prosecuters snag him badly in a lie. It would be so good to see him fumble.

I think he will chicken out and not get up there.

And also because of the three witnesses yesterday.....if their testimony wasn't hearsay, Bri's won't be either. Unless there's some judicial favoritism going on......I guess we'll see soon.

That's ridiculous. The foreman and the alternates should be chosen just prior to deliberations. Especially the alternates, who may not be paying close attention because of their status - no matter what the judge tells them.

I am not an attorney and have never served on a jury, but I thought alternates always knew from the beginning they were alternates.

I'm on the fence about him getting on the stand. He did do tv interviews and certainly posts enough on FB (even though most of us believe it's TM) that I can see it going either way. I would LOVE for them to catch him in a lie on the stand. How beautiful would it be if he just pleas out mid trial?! Still keeping my fingers crossed he turns on TM and takes a deal for a lesser charge. I can handle that if it means she gets charged with murder and we find out where Heather's body is. I doubt he will never do that though. :facepalm:

I doubt it, too, and I don't think he'll testify. I wouldn't be surprised if the judge himself advised him not to since he went on so long about how SM doesn't have to prove a damn thing.

My feeling is the only way he would turn on TM is if he can give info than will hang her for good, cause ain't no way he would survive is TM ever got out of prison.

I also think if either was going to do it, they would have turned while serving the time in jail.

I bet South Carolina has an "acting in concert" felony charge or something worded similarly. A jury could convict on that if that charge exists and attaches to this case. That would be one way that two separate individuals could be convicted of the same crime.

SC has 'the hand of one is the hand of all law'.
If one sit in the truck while the other did the killing, both would be charged with the killing. Usually the sitter will jump to get a deal to avoid the serious charge.
