Alexis Saborit is expected to stipulate to the elements of first-degree premediated murder and present his mental illness defense Wednesday.
Snippets:
Now, after two psychological evaluations of the defendant, the Scott County Attorney acknowledges the case is headed toward a likely finding of not guilty by reason of mental illness, followed by civil commitment hearings to determine Saborit's future.

On Wednesday, court filings indicate Saborit will waive his right to a jury and hold a stipulated facts trial before Judge Caroline Lennon.
In the two-stage trial for defendants using multiple defenses, Lennon would likely find Saborit guilty in the first phase without any witnesses called to testify. But the mental illness stage of the trial, the only person on the state's witness list is Dr. Andrea Lovett of Morningstar Psychological Service.

Jan. 25, 2023
The man accused of murdering Shakopee resident America Thayer went on trial before a judge Wednesday in Scott County District Court, though he won't likely learn his fate until March.
[.....]
In a mostly empty courtroom in Shakopee on Wednesday, Saborit spoke throughout the proceedings with the help of a Spanish language interpreter. He had waived both his right to a jury trial and his right to testify and instead had a "stipulated facts" trial, also called a court trial, in which a judge decides whether a defendant is guilty — not a jury.

District Court Judge Caroline Lennon, who is presiding over the case, was presented with the evidence, exhibits and arguments. Both the defense and the prosecution then agreed to submit written closing arguments to the court. The state’s argument is due Feb. 8, the defense's argument on Feb. 22 and the state’s rebuttal on Mar. 1.

Saborit’s next appearance in court is slated for Mar. 22. That's later than what would be usual in a trial like this, but due to court scheduling conflicts Saborit waived his right to have a judgment issued within seven days after the end of a trial, as required under Minnesota law, to give the court adequate time to make a ruling. The trial had already been delayed from its initial planned Jan. 18 start date after Saborit contracted COVID-19.
[.....]
Saborit underwent psychological tests last summer at the behest of his defense and in October was found competent to stand trial. His plea hearing was held Nov. 22, 2022.

SBM
Scott County judge Caroline Lennon delivered the verdict via a court order, finding Saborit guilty of 1st-degree murder. According to court documents, the judge found "beyond a reasonable doubt" that Saborit killed Thayer with intent and premeditation.

Lennon said in her decision that the nature of the assault — in which Saborit used a dumbbell to initially strike Thayer before turning to the machete — is enough proof to show intent. The judge also pointed out that Saborit showed off the machete to people known to him prior to the murder, which could be a "inference of premeditation."

Saborit previously waived his right to a trial by jury and to a speedy trial. Instead, the judge decided Saborit's fate in a stipulated facts trial. The trial took place in January with closing arguments occurring in February and March, according to court records.

A review hearing is scheduled for June 1. Saborit's 1st-degree murder conviction carries a life sentence. It's likely Saborit won't have any possibility of parole.

Alexis Saborit, 44, was found guilty in the slaying of America Thayer, 56, in July 2021.

The Minneapolis Star Tribune reports that Saborit struck Thayer with an 8-pound dumbbell while they were in a vehicle near downtown Shakopee, then he decapitated her with a machete.

People in other cars and nearby homes saw the attack. One of them shot a video that appeared to show Saborit pull Thayer's body out of the car into the street then pick up her head by the hair.

Saborit and Thayer were on the way to his court appearance for felony charges alleging that he set fire to their apartment in Shakopee during a confrontation with police and that Saborit attacked Thayer after she told him she wanted to end their relationship.

Saborit fled the scene and disposed of the machete along the way. He was arrested about 1 ½ miles away near the TraveLodge Hotel where he was staying.

County Attorney Ron Hocevar said he was pleased with the verdict, and that he expects Saborit to be sentenced to life in prison without the possibility of parole.

Minnesota has a new court site - not sure that I am liking it very much - but at least you can actually "see" the documents that are filed unlike before. There were 2 attachments, but I am not posting the link as it has my name on it, so I have typed up "what they say".

Sounds like Saborit is going to be released re Order for Release down below?? Is that how anyone reading here think?

July 18, 2023

SHAKOPEE, Minn. -- A man who was found guilty of first-degree murder in the first part of a stipulated facts trial after beheading his girlfriend inside a car, dumping her body and fleeing has now been found not guilty by reason of mental illness.

Because Alexis Saborit pleaded not guilty due to mental illness, the trial comprised two phases: one to determine his guilt, and one to determine his "state of mind and resulting culpability," per the court.
[.....]
A judge in May ruled Saborit did indeed commit the killing, but Monday, a judge found him not guilty by reason of mental illness. The judge noted Saborit's medical history includes a traumatic brain injury, "symptoms of mania in conjunction with psychosis" and a "significant history" of non-compliance with prescribed treatments.

Two doctors analyzed Saborit's case and determined he "was suffering from mental illness to the extent that it prevented him from understanding the moral wrongfulness of his actions during the alleged offense."

The judge found "no deficit in the experts' review of the record or the soundness of their analysis," per court documents.
[.....]
Saborit will be held at the Scott County Jail until he can be transferred to a psychiatric care facility.
