The BCA investigated the 2002 shooting of Mr. Atak in Rochester. They agreed with the officer’s account that it was an accidental mix-up of weapons. No criminal charges were brought against the officer involved.


"Accidental Discharge" which it is being called is equal to "Justifiable Homicide" in some states if done by LAW enforcement. It's the law in some states. MOO

It may be that criminal charges will not be filed MOO. Minnesota does have "Officer Bill of Rights"

Another civil suit would be expected to be settled. MOO

If we look at a surgeon, and he accidentally uses a scalpel instead of a laser, causing a death, would it be malpractice? I do think so.

Yes most certainly, and I'm sure he or she would be sued in civil court.

However, imo, they wouldn't have charges brought forth in criminal court for the death of the patients. Unless it was discovered they purposefully were killing patients.

I've read that there are over 70,000 deaths every year due to malpractice of doctors, and nurses. Etc.

I don't think many if any ever face criminal charges though when they accidently kill patients.

I think because it would be extremely difficult to hit the arm, and because the standard in using the stun gun is to aim :

To use the stun gun, hold the contact probes firmly against the attacker. The best target areas to aim for are on the neck and torso, particularly the under arm, upper shoulders, groin, and upper hip (below the rib cage). These areas are nerve centers and the electrical current will affect the whole body when struck here

She intended to use a taser, not a stun gun.

Watching the Chauvin trial, when they broke for lunch, the Washington Post commentators just said that Crump has been retained by the Wright family and he will be having a press conference outside the courthouse.

I truly dont understand why in the world the City Manager was fired simply because he said she would have due process?

Our country is founded on due process. This is so wrong. Imo

And first the Mayor just said the PC was relieved of his duties, and in the next sentence said he resigned. Why? What did he do wrong?

I'm talking about the PC being held now.

The officer resigned but the Mayor is trying to take credit for it. Oh now he's saying he didnt have anything to do with it.

This is crazy the politicians are trying to take all the credit. Ugh!

He's stuttering throughout because he's making it up as he goes along imo.

The Brooklyn Center City Manager was relieved of his job yesterday.

Brooklyn Center Mayor Mike Elliott said on Twitter that City Manager Curt Boganey has been "relieved of his duties." The decision is effective immediately.

Elliott did not reveal the exact reason for Boganey's dismissal, but the decision follows a Monday press conference where Boganey spoke on whether the officer who shot and killed Wright will be fired. He said the officer will receive due process.

A reporter then asked Boganey if he believes an officer whose mistake cost a resident's life should be fired, and asked what message the city of Brooklyn Center is sending to the rest of the world about the value of Black life.

"I understand and appreciate the comment that you made and why you said it, but if I were to answer that question I would be contradicting what I said a moment ago, which is to say that all employees are entitled to due process, and after that due process discipline will be determined," Boganey answered. "If I were to say anything else I would actually be contradicting the idea of due process."

RIP Daunte...condolences to all who loved you.

As someone who grew up in England, where police didn’t carry guns, and having moved to WA, Aus. where gun crime is rare, I am constantly mind blown by these cases.

I find it hard to accept it was a mistake, she has been in the job for 26 yrs and surely has been in situations like this before and not killed anyone. And anyway, does it being a mistake make it ok, and we’re meant to just move along, nothing to see here...

Might just read for a while I think...

Didn't they say they only have 49 officers in this department?

Some of it's hard to hear, but I thought the Mayor signed a resolution last night mostly stripping the police department of most of the ways they use to try to control protests that may turn violent.

Honestly, I wish he would stay away, but I felt all along it was only a matter of time he'd show up.

I'm more concerned about getting rid of horrible officers like this woman.What a scary thought that a person like this was on the force for 26 years.

Since she shouted taser taser taser before shooting him, I think it's clear she meant to use a taser. I have no doubts about that aspect of the shooting. JMO

ETA: I find this information about her interesting though

In 2019, Potter—who was the police union president at the time—was admonished by investigators for allegedly attempting to conceal evidence after a police shooting that left a 21-year-old autistic man dead.
