In the week before the trial, there was a flurry of court filings.
One by the defense asked U.S. District Judge Gary A. Fenner to block prosecutors from showing a video, "A Live C-Section Surgery from First Cut to Last Stitch."
Prosecutors have agreed to not show the video to jurors but do intend to show that Montgomery accessed a Web site featuring that video, accessed other websites with "how-to-do" Caesarean section information in the delivery of a baby, and selected a how-to-do a C-section video for her computer, which wouldn't display it.

I'm thinking the defense is going to have one heck of a time convincing anyone that Montgomery is legally insane because of those bumps on her head when she was young. Way too much planning to be a complete nut case - gonna be hard to overcome the depths of planning Ms. Montgomery employed.

The only thing that does bother me - the prosecution may possibly put Park Dietz on the stand - :furious:

U.S. District Judge Gary A. Fenner granted the prosecution motion to disallow testimony from Ruben Gur, a professor at the University of Pennsylvania. Gur had testified in earlier hearings that previous head injuries contributed to Lisa Montgomery's alleged role in the December 2004 death of Bobbie Jo Stinnett, 23, of Skidmore.

During opening statements Thursday in the trial of Lisa Montgomery, federal prosecutor Matt Whitworth also told jurors Montgomery was concerned about losing child support payments if she lost custody of her children.

The night before Bobbie Jo Stinnett, 23, was killed in her Skidmore home and had her baby cut from her womb, Montgomery told her ex-husband, "I'll show you, I'll prove you wrong, I'm pregnant," Whitworth said.




According to noon news on WDAF (myfoxkc.com) Zeb Stinnet (Bobbie Jo's husband) and Becky Harper (Bobbie Jo's Mother) both testified this morning. WDAF has live streaming news at noon and 6 and are airing reports from the court house.

The insanity plea is never going to fly in this case...but I think this is all the defense had to work with. She did it...they knew she did, so other than pleading guilty, there's not any other options...that I can think of.

There was too much pre-planning prior to her killing and stealing the baby. I suspect this trial will be over pretty quickly and she'll be convicted...which is what should happen, IMO.

This story has haunted me since it happened, and I have been waiting for the trial. I wish there were photos and footage from court. I'd also love to see what Victoria Jo looks like now. I can't believe she'll soon be 3.

No, I do not think the insanity plea will work at all!

Those "conditions" do not rise to insanity, IMO. The defense only has this option though and it will fail.

Six days before Stinnett was killed, Boman had filed for custody of two of the four children he had with Montgomery, according to court records. On Monday, Boman, 43, speculated that Montgomery did not want to admit she had lied about being pregnant to her husband, family and friends in Melvern.

I'm so sorry this poor excuse for a human being has FOUR other children! I am so glad I am not on this jury and have to view those crime scene photos! I don't think I would be able to sleep at night! Awful!

The defense only has this option though and it will fail.

This is how I feel. They have nothing else short of standing in court and saying she's guilty. They've probably told her this is her only shot at getting away with this...which makes me sick. But it won't fly.

I think Montgomery is a very bright woman in a very coniving self centered way - her lawyers in my opinion are of lesser IQ based on some of their claims. Such as today trying to raise doubt about a struggle - knowing full well Bobbie Jo was found with clumps of blond hair in her hands. But I will say this insanity approach is the only approach they can pursue.

Entirely too much planning indeed - no way she can be found legally insane IMO. Her statement to Carl Bowman ("I'll show you!") before she murdered Bobbie Jo is pretty much proof of premeditation, thinking, planning, and also acknowledges that she understands right and wrong.
