This prosecutor is confident he can go to trial and make a first degree murder charge stick, in which this man killed this baby very specifically by suffocating her.

Yet Brianna's body hasn't even been found.

I can't tell y'all how flummoxed I am by this.

I keep fast forwarding to the trial, pretending her body never was found, and envisioning that I'm this prosecutor, standing up to present my evidence.

And the only thing I can figure I've got is a videotape of this man suffocating this baby and then showing her in a way that leaves no doubt that she is indeed deceased, and not simply unconscious from the suffocation.

Other than that - I don't have a thing.

And on top of that, I've charged this guy with tampering with evidence. Wth? That's a totally odd duck of a charge.

I'm flummoxed, I tell ya. Flummoxed. And headed straight toward a veritable kerfuffle.

For the DA to make that statement definitely indicates, imo, that there is an admission by Morgan since her body hasn't yet been recovered.

It's my understanding that you can't use a confession alone because those of unsound mind frequently confess to crimes they didn't commit.

I posted just an hour ago that attacking or blaming the parents in this case was NOT ALLOWED.

I was serious. These parents have been in the media and have come across as loving, caring parents. LE has said there was NO indication that they had any involvement. LE has asked that the vicious rumors on facebook and topix be stopped.

We are going to abide by that. IF LE or DCS comes out and says these parents were irresponsible or in some way at fault, than this rule will change. BUT UNTIL THEN - there is to be no speculation, trashing, baiting or attacking of the parents.

If you have questions about this, then pm a mod.

In the many, many cases we have followed here, it has been very rare that we have seen parents of this caliber. Allowing a child to play in their yard IS NOT irresponsible. Their pain and suffering was evident.

I believe this is true, BeanE. LE must find some corroborating (sp?) evidence to back up the confession. There will need to be independent evidence, such as a witness, a video, shoe prints, something in order for the confession to stand. The DA has to be able to say - he confessed and his confession is true because his fingerprints, or this video, or that witness, or something like that.

In the article with the neighbor - didn't the neighbor say the wife told her they were taking computers and other stuff out of the house? They may also have something on the computer. :(

Salem, you said witness. hmmmm... could someone have seen the whole thing? And they were scared of him, but finally went to LE?

Is witness + confession enough if they have some other supporting evidence as well?

I am just scratching my head over this one.

Oh my goodness. I just had the worse thought ever. What if he took pictures of or with Breean on that day? I'm with BeanE... I don't understand how you can charge someone with such serious charges based on a confession alone? I feel like Im going to throw up.

Could they have the weapon as additional evidence, i.e. whatever he used to smother her, if that is truly what he did? Perhaps that is what was sent off for testing along with the wheels?

I feel they must have something more than his confession or they would be royally screwing this up to charge him with murder at this stage; surely they could hold him on lesser charges for now, unless they know for certain she is dead.

Beannie I've been kerfuffeled from the start of this one. And it's only getting worse. I thought it was because I really have not been able to just get focused on it...but it looks like it's stumping everyone.

Maybe some of her clothes were in his house. Maybe the tampering came because he removed the training wheels. He could have fought with police when they came calling. jmo

BeanE, the only other way I can think of, is LE has evidence of a non-survivable injury. Morgan may have admitted to smothering her, but there is also evidence that he further harmed her in a way that she could not survive. Perhaps that is the 3rd piece of evidence LE told us about. I hate to be so graphic, but LE may be looking in several places.

Well let's say you had a pillow or a plastic bag. It could have saliva or vomit on it. If there is something that can be present in saliva or vomit only after death maybe.

But I think that alone won't give you COD - suffocation. I think it would just tell you the pillow or plastic bag touched the person thus acquiring the saliva/vomit transfer after death.

I just don't know on this one. It's so specific on the suffocation. What would tell you someone was suffocated to death without even needing an ME's exam? All I can think of is video or witness. It would have to be a really solid witness or a really clear video too.

Well if he admitted to suffocation AND they have a bag/cloth/pillow with her DNA, saliva, skin cells, etc...I guess that could be it, but it still does not seem to add up to the murder charge just yet...very confusing. And I am really desperate to know A. how they found him and B. just more about him...

Except that they're saying, very specifically and publicly, and knowing they have to go to trial, that he caused her death by suffocation.

If that prosecutor isn't absolutely sure, he's already lost his case, and this guy will walk. And the prosecutor knows that. But he went public to the world with it.

I sure would like to know what Jeff Ashton thinks of this one.

Have they said if there was any sexual molesting before killing her? I can't understand how a father of 3 with no prior record would just randomly kill a 3 yr old. I was thinking maybe he hit her with his car and that is why the training wheels came off and he got scared and took her with him and then smothered her. This case is strange.

But the murderer frequently has the victim's clothing or belongings, and they destroy them and mess them up to disguise them or get rid of DNA, and they don't get charged with tampering. I don't remember any cases where the murderer was also charged with evidence tampering, no matter what crazy stuff they did.
