From Anna's post, ty btw. They have talked about it but this is the first time in writing I've seen that they will seek the dp.

Dunklin County Prosecutor Stephen Sokoloff says he will seek the death penalty against Morgan.

Well this should be good news. Sharp is the original judge and will be familiar with the proceedings to date.

Get on with it.

No explanation of WHY?

Nothing. Just "Oh hey we wait another 9 months"... I just don't get why they need 9 months.

The only place I saw news on this was KSDK, so the media couldn't care less.

Have we ever heard anyone venture into a hate crime? I have not seen it said except in comments, lots of speculation.

Maybe part of the reason for the 9 months is because the jurors are coming from Phelps county. Hopefully it will go on that date. jmo

Maybe so, but they have known the jury was coming from Phelps Co for more than a year now.

Yeh, but they have their own trials also, plus it is a little far away from Dunklin. Might need a larger jury pool to get people able to go that far. Also at least one defense attorney is from Columbia,Mo. He may have some other trials. He is a public defender. From what I understand, they have been pretty swamped.

I've wondered if this was a hate crime since the beginning, I'd like to know the same thing.

I don't know how anyone can look at another human being - and especially a little child! - and have hate like that because of her race, but... It happens, unfortunately. :(

Poor Breeann and her family. Waiting almost another whole year for justice. I wish them nothing but peace, and I so hope her mom, dad and brother are being surrounded and upheld by friends and family through all this. :rose:

I meant to link this a few days ago, but this is when they announced the DP for Morgan. That is why they delayed the trial (supposed to be Dec 10, 2012) the first time.

I feel they weren't able to get DNA or evidence of rape due to B's body not being found soon enough. Same with Celina Cass' case. imo

They were able to at least add this charge below. I do believe it could be both a hate crime & sexually motivated.

I'll always wonder why that house burned down. Was it a habit in the family or it was needed to be burned down by an outsider etc... Either way, it's gone for some reason or another as the defense & prosecutors were trying to set dates in court to view it. Amazing...

Good point. I always wondered if it was burned down by someone "for" the victim, but interestingly, Kevin Morgan (Shawn's brother) house burned down the day before Shawn's house burned down.

Kevin was arrested in Dec 2011 for using Shawn's money after being granted power of attorney.

I thought at least 5 burned down houses owned by the family? In years prior to the last two of SDM's and his brothers? I'm sure it's posted here a while back.

During the time SDM's court doc was being updated, the talk of the home & whoever were documented to view or visit, on his court record. It burned, end of story. Use the link above to read the documents to MO casenet.
