Per Jodibug: Kurt Valentine, AB's attorney, called no witnesses, although given the opportunity. Jodibug is wondering whether or not AB's family was given the opportunity. Another thing that was revealed today was that AB's grandmother was present when AB confessed.

Teen To Be Tried As Adult In Olten Killing

JEFFERSON CITY, Mo. -- A 15-year-old girl accused of killing 9-year-old Elizabeth Olten as she walked home from a friend's house will be tried as an adult, a judge ruled Wednesday.

The girl charged is Alyssa Bustamante. She will face her first court appearance in adult court Wednesday afternoon.

In October, Olten disappeared as she was walking home from a friend's house near Jefferson City. A few days after she disappeared, Bustamante led police to Olten's body.

Police said they found Olten's body in a wooded area where she was last seen in St. Martin, Mo.

Since being arrested, Bustamante has been housed at the Prenger Family Center.

I would hope they would save anything they had to say for the murder trial if there is going to be one. I would think the prosecution would use the grandmother's testimony.

If I heard correctly, the grand jury is already in progress. I think that is what they said on KRCG 13

Yes,they did say the grand jury is gettin in on it,,and maybe they'll take it from local,(from what I understood) and put it into grand jury jurisdiction,,(or however ya spell them big words)

The grandmother may be testifying at the grand jury right now. That is if I heard correctly on the news.

Amanda, I had previously bookmarked your photobucket page, but I just now really looked through it -- THANK YOU for preserving some of those online accounts and blog entries!

One item you have in there, and I'm not sure of the original source, but apparently KRCG has thoroughly investigated AB's background and family history. They stated that if AB is ruled to be tried as an adult (and she has!!!) they will be sharing the information they have obtained.

I don't follow this case as closely as I'd like so I'm a little behind. But from what I'm reading it sounds like Alyssa has actually confessed to the crime? Or are the police just going off of her diary entries?

I think grand juries are called by the prosecutor. They just recommend if something should go to trial based on evidence. Maybe just a little sompin, sompin, to force a plea. jmho

Her attorney, Kurt Valentine, never once tried to imply that she was innocent. He referred several times to the "acts she committed".

His only "defense" was that "you can't put a 15 year old girl in Dept of Corrections, they won't know what to do with her" and that we don't know that she "can't be rehabilitated in five years, it may be possible and we have to try".

He said that charging her as an adult is giving her a death sentence (which would be fine with me!) because she won't be adequately protected in the Cole County Jail or in DOC (cry me a river!).

He also said that she has tried to commit suicide since her time in Prenger, by ...... cutting herself with her fingernails. (now who thinks that was a serious attempt???)

He said that even though Alyssa has had almost DAILY counseling sessions since September 2007, if we just kept her in treatment at the youth center then maybe the counseling would work before she was 21 because "you can't just throw away a child because of the crime they committed".

blah, blah, blah.

Kids are easier to rehabilitate than adults. This just proves to me that she is way too dangerous to be let out into society. Right there, out of her own attorney's mouth.

FYI the pic that was tweeted of the "crowd outside the courtroom" by KOMU was actually a pic of the reporters from local news agencies outside after the certification hearing, and someone else on Twitter called them on it as being misleading, so I assume they removed it

This woman is a wonder. I hope everyone appreciates her as much as she deserves.

I was totally disappointed that we didn't get a chance to see the family members who were present. I wanted to see Mom and Grandma. I SOOOOO wish I could make it back this afternoon, but had enough trouble getting the morning off, and have a class this afternoon. But I trust Jodibug to let us know everything that happens.

If Valentine has been dismissed from his duties to represent her as a juvinile, who will be her representation this afternoon, I wonder??
