I actually attempted to answer and got that "interesting" "we'll review your post and if it's okay we'll let it go through" or whatever message.

Yesterday I had to prepare and submit a "pre-interview questionnaire" that took me 2 1/2 hours to complete; but I swan it wasn't as detailed as this "quiz." My eyes are crossing!

Here is the MO law concerning assaulting a police officer.

Assault in the First Degree Against Certain Victims

If the victim of an assault in the first degree is a law enforcement officer, corrections officer, emergency personnel (such as a firefighter, emergency room personnel or emergency medical technician), highway worker, or probation and parole officer, the crime is a Class A felony, regardless of what injury does or does not result from the offense.

I don't think that assault of a police officer is an automatic Class A felony.

Here's what I found in the Missouri statutes:

565.082. 1. A person commits the crime of assault of a law enforcement officer, corrections officer, emergency personnel, highway worker in a construction zone or work zone, utility worker, cable worker, or probation and parole officer in the second degree if such person:

(1) Knowingly causes or attempts to cause physical injury to a law enforcement officer, corrections officer, emergency personnel, highway worker in a construction zone or work zone, utility worker, cable worker, or probation and parole officer by means of a deadly weapon or dangerous instrument;

(2) Knowingly causes or attempts to cause physical injury to a law enforcement officer, corrections officer, emergency personnel, highway worker in a construction zone or work zone, utility worker, cable worker, or probation and parole officer by means other than a deadly weapon or dangerous instrument;

Assault of a law enforcement officer, corrections officer, emergency personnel, highway worker in a construction zone or work zone, utility worker, cable worker, or probation and parole officer in the second degree is a class B felony unless committed pursuant to subdivision (2), (5), (6), or (7) of subsection 1 of this section in which case it is a class C felony. For any violation of subdivision (1), (3), or (4) of subsection 1 of this section, the defendant must serve mandatory jail time as part of his or her sentence.

My understanding of the above statutes: MB punching Officer Wilson was a Class C felony.

MB's struggle with Officer Wilson over his service weapon may have been a Class B felony, since the firearm discharged during the struggle.

On a boring Saturday night, with no serious new news (outside of the new witness coming forward) I was wondering if it would be ok to take an informal poll? I was wondering who you initially "sided" with (MB/OW for clarity,) if you opinion has changed and what your tipping point was that perhaps changed your change in direction, either way.

For me, I initially sided with MB and began to lean toward OW after the store video and completely flipped when I learned of the punch in the face.

I'll admit, in the beginning I gave OW the benefit of the doubt because I felt there was more to the story. What sealed it for me was the altercation at the vehicle (even by admission of the family attorney). That was the point of no return IMO.

with a sub specialty of forensic neuropathology!

IIRC, years ago, she testified about COD and MOD per her autopsy in a crim case.
Defense atty (w a doc ready to counter Case's testimony), was doing cross w her about some teensy point about neuropath.
After she answered, he said something like -
Well, that may be your opinion about this, but you're not really that well versed in neuro, are you?

Dr. Case splained to him that she was board-cert in neuropath, which he had somehow overlooked.
IIRC, the doc ready to testify for the defense was not bd-cert in neuro.
I wonder how long it took for atty to get foot out of his mouth.

If they fought over the gun, and if it was pointed towards the officer at some point, and it was shot during the struggle, then it is a class A felony, imo. That would be an attempted murder charge if he had a Sig pointed point blank range at the officer and was attempting to fire it.

I agree, Katy - if, during the struggle over the gun, MB was able to gain enough control over it to purposely point it towards Officer Wilson with the intention of shooting him, then it's a class A felony.

I posted the Missouri statutes so that folks would be aware that assault of a police officer isn't an automatic Class A felony - it depends on the circumstances.

in the first video where they are marching in the street, someone is dragging a baby along with them...good lord why! At the end a couple ppl aren't marching they are just walking in the middle of traffic for the heck of it it appears. It's less than 4 mins long.

If I were driving down that road and saw a group in the road trying to stop traffic, I would think that it's a possible car-jacking. I would not stop.

Okay, now I am confused. According to the Stltoday link the tree worker is the same guy who was interviewed previously who claimed MB felt bad vibes but now the story is that MB did not say Jesus would have his (MB's) back now he said Jesus would have the tree worker's back? Or were there two men with whom MB conversed on way to rob the store of swishers where he counseled Christ and spoke of bad vibes? Because previous interviews about that witness who spoke with MB on the way to the store gave me the impression the two knew one another but the tree worker gives the impression it was a random conversation with a person he did not know.

This medicine is seriously kicking my butt, sorry if this is a stupid question.
