I agree. And I think those witnesses that corroborate the officers story, are probably the ones who were stopped right behind him in their cars. They would have had a great close up view of the initial bums rush and scuffle. And I think they would be ver nervous because they would be very visible to the others, as they were in their vehicles. just speculating. But I don't believe we have publicly heard from anyone who says they were sitting in their car, alongside the action. Not yet anyway.

But who knows for sure if there were people in the car(s)?

IIRC Brady said the car DJ hid behind was empty.

I actually think they should hold the council meetings and let them proceed just the way the last one did.

A la The Art of War . . .sometimes the best way to win is not to fight at all. Those speakers certainly didn't gain any credibility or legitamacy, did they? Let them destroy themselves. ;)

I actually like this idea. But I would make an announcement at the beginning of the council meeting that if there are any threats made, LE will escort the council members out of the building.

JMO OK. I find that to be strange. No immediate incident report, and statements made several days after the shooting....and before the world knew the officer's name, we were treated to strong-arm robbery video. I plainly see from the video that the perp was MB, but connecting that to the obstruction melee on Canfield MAY be a stretch. I suspect that the first officer on the scene TOLD OW that the dead guy was the strong arm robbery perp. That officer was the one looking for the perp and his buddy. I do hope that THAT officer has given under oath statements and that his testimony is available to the GJ. Also in the FPD initial report, it says 4 to 6 shots fired. We heard 10, if the glide video is correct. Curious, here. I do not know all the facts. I have no interest in participation by proxy in a wrongful conviction. I'm not convinced that race was an issue. I just want the truth of the incident to emerge. JMO

Deb found an earlier report than I did. She found the chief making that statement on the 10th, which is just one day later.

I just asked my son about this , because I was surprised the chief would make a statement just one day later, as OW would not have had a lawyer yet. So it seemed weird he would have been interviewed already for a possible murder charge.

My son carries a gun for his job on a naval base, works for homeland security. So I just asked him what was protocol if he got in a shoot out on base.

He said that he thought the officer would have made an initial statement to his superiors within 24 hrs of the incident. It would be taped. A basic description of the incident. But then he would retain an atty and be 'interrogated' by internal affairs. And that interview would be very detailed and lots and lots of questions would be asked.

So the chief was probably going on the info from the initial statement when he spoke on the 10th of August. jmo

I don't think it is much of a stretch to connect the robbery video to the shooting. We can see how aggressive and intimidating MB was. And that was just minutes earlier. He was clearly in an aggressive mode. Contrast with what OW was doing at the time--helping the family with an infant having breathing problems. he was probably not in an aggressive mode at all. And just minutes later he is in a confrontation with MB.

Which one was the aggressor?

Dorian said he asked one of the drivers, of the car he was hiding behind, to let him in. The car just drove away fast he said.

How many of you feel that officer Wilson will or has spoken to the Grand Jury? I think that it's probable that he will or has done so.

I understand why people would use their Fifth Amendment rights against self incrimination when called before a Grand Jury. I just don't feel it's necessary in this case.

Just to clarify, it was St Louis County PD Chief Jon Belmar who outlined OW's account on Aug. 10 at a brief presser.

video of Belmar: http://www.liveleak.com/view?i=60b_1407692122

It was Ferguson PD Chief Jackson who released OW's name and still pics from store video on Aug. 15.

I think he will. I think he will be one of the last witnesses. jmo

I hope he does go before the grand jury. I understand his rights and can see how it might be problematic. But I think it would be easier for the GJ to NOT indict him, if he appears and answers their questions. jmo

There was a DJ version of events that included his begging a passerby to take him away from the scene. I wonder if there's a kernel there. All MOO

The problem I see with OW speaking to the grand jury is their ability to ask him questions like "Have you ever used the "n" word?", i.e. anything they want, case-related or not, which Crump Inc. could use against him. I read that a civil rights charge from Holder's DOJ would only occur if OW had "racial animus" toward MB. Letting a grand jury probe his life history re any dealings with blacks since childhood, which Crump could then twist or amplify, would be a huge mistake imo.

Grrrr... Lost my reply :(

Dorian makes some dramatic statements initially regarding the people in the car. These were later left out of his statements to the media.

Brown and Johnson took off running together. There were three cars lined up along the side of the street. Johnson says he ducked behind the first car, whose two passengers were screaming. Crouching down a bit, he watched Brown run past.

Then, my friend stopped running because he felt the second shot. The first one I felt like he was in shock.
The second shot hit him and he felt it. His hand immediately went in the air and he turned around to the
officer, face-to-face. He started to tell the officer that he is unarmed and that you should stop shooting
me. Before he can get his second sentence out, the officer shot several more shots into head and his
chest area. He fell dramatically in the fettle position. Once I saw that his body animation in it anymore, I
begged and pleaded the car that I was hiding behind to just put me in their car and drive off anywhere. I
don’t care where you drop me off at. I don’t blame them for not letting me in at the moment, because they
couldn’t understand the situation. They don’t know why the officer was shooting at us, so I understand
why they pulled off. In that instant, when I couldn’t see nobody else, I just took off running as fast as I
could and I didn’t stop.

Would officer Wilson's Grand Jury testimony be made public and used in a possible civil case? Will the DOJ have access to the Grand Jury's testimonies?

Very good point.

I don't know, but being a congenital pessimist I certainly wouldn't risk it.

Lets say that officer Wilson decides to not testify before the Grand Jury, they indict him and he goes to trial. Would it be a good idea that he testify at trial or remain silent?

Would the risk of having to be examined by the prosecution be too great?

  • #897
Well you and I may plainly see that is MB in the video but his uncle says it is not. Don't know if that was the pastor uncle or a different one.

even DJ says it's MB & himself on the video

JMO My understanding is that he was invited to tell his story to the GJ but is not compelled to testify, and that he has declined, per attorney advice, which is usually what happens at a GJ. So,his story would only be related to the GJ by whatever documents there are and whatever he told investigators in a signed statement. Maybe I'm wrong, but I do not think that he gave sworn testimony to the GJ. JMO

Link please that says he declined to testify.

If he goes to trial and testifies, anything he testified to at a GJ hearing can be used against him on cross-examination, if there are discrepancies.
