James Clay Waller will stand trial for the murder of his estranged wife.
Cape Girardeau County Judge Gary Kamp bound Waller over to circuit court late Monday afternoon, following Wednesday's preliminary hearing on first-degree murder and tampering with physical evidence.
Waller is scheduled to appear in court at 9 a.m. Aug. 6 for his arraignment.
James Clay Waller has a new judge in his murder trial and his next court date has changed.
Waller will now appear for his arraignment on first-degree murder and evidence charges on Aug. 13, instead of on Monday. A time for the arraignment was not yet set Wednesday, according to the Cape Girardeau Count Circuit Clerk's office.
Waller stood before judge Benjamin F. Lewis for his arraignment on murder and tampering with evidence charges.
Waller also waived his right to a formal arraignment during Monday's hearing. He will be in court again on October 22, 2012.
A federal appeals court on Friday upheld a five-year federal prison sentence handed down to Clay Waller for making threats over the Internet to the sister of his still-missing wife, Jacque Waller.
Waller will head back to court on October 22. That's when it will be announced if the trial could stay in Cape Girardeau County with an outside jury or possibly move elsewhere.
