I think he really believed he had no choice. I have never said I thought he was right. I just believe both sides deseves to be told. If I truly believed that my childern were being hurt & the court was no use to me. I would save my childern no matter what the cost. Why is it that the man can posted that he knew they were on drugs & I do believe that it is wonderful that he is sober. That is a feat that many addicts can't manage. I appuald him. He deseves all the respect. But somehow the respones to his post is it's o.k. that Tina used. I believe Dan simplely for the fact he is sober & his story has never changed

Yeah, right. I believe him too....he killed his kids to hurt his wife...and he's happy to have done it... now he makes statments to torment her more....not exactly a shining example of fatherhood.

So that dad still hasn't told anyone what he did with the kids? I think he must have murdered them. How do you find someone that is willing to support and raise two children that aren't theirs for years while their father is in prison? Outside of relatives I can't imagine someone willing to take that kind of responsibility. I wish LE would charge him with murder and he would get the death penalty...maybe then he would start talking if they are still alive.

Can you imagine a father willing to go as far as to murder two children that are his flesh and blood just to get back at their mother. It takes a very sick person to be willing to go that far just to hurt another person. This guy doesn't deserve to keep breathing.

I read before that when women murder their children, it's usually done as a sort of punishment to themselves but that when men murder their children, it's done as punishment to their mother. I guess on both sides, children tend to be seen more as an extension of their mother than their father. And the truly sad part is that in order for there to be statistics on this kind of stuff, it must mean that it's not completely uncommon. :(

But I agree, Bobbisangel, I still can't understand what would cause that protective mechanism towards our children to go off-kilter.

I know, most of us would gladly give our lives for our children's lives. I wonder why LE doesn't plant someone who is in prison in this guys cell to see if he can get anything out of him. Sometimes they do talk and even brag about what they have done. There is a case right now on CTV and LE put 3 different guys in the cell with the killer at 3 different times and they got him to talk. They should try it because they aren't finding out anything anyother way. Maybe he would at least brag about how he showed his wife a thing or two.

I think of them often. I pray that this one will be resolved someday so that their mother can have some sort of closure.

Such a sad case. I would hate being in the mother's shoes just knowing that the creep sitting in jail knows where those kids are yet he won't say a word.
Can't they try electric shock or something!!!! Darn, if he was in another country they would get the truth out of him and it wouldn't be pretty.

Ex-wife of man who abducted their children gets letters describing plan to have her killed.

The FBI is investigating a possible murder-for-hire plot in which the jailed father of two missing Independence children allegedly sought to have his ex-wife killed.

The investigation stems from a series of letters written last year by an inmate at the Jackson County Detention Center to Tina Porter. Her children disappeared more than two years ago while visiting her then-estranged husband, Daniel Porter.

The inmate wrote that Porter offered him money to kill Tina Porter — a charge Porter has denied. The Porters were divorced in November 2004.

“He wanted 2 have his brother pay me 2 kill u when I got out,” the inmate wrote in a letter last fall. “He was so 4 real.”

FBI spokesman Jeff Lanza said Tuesday that he could neither confirm nor deny that an investigation was under way.

But The Kansas City Star has learned that the agency has interviewed Tina Porter and this month subpoenaed copies of some of Porter’s recorded telephone conversations while in the Jackson County jail. According to the subpoena, the documents are to be presented to a federal grand jury in October.

Porter, 42, picked up his children, Sam and Lindsey, at their Independence home on June 5, 2004, for a weekend visit. The children, who were 7 and 8 at the time, haven’t been seen since.

He was convicted this year of parental kidnapping with the intent to terrorize his ex-wife and sentenced to 38 years in prison. He is now at Western Reception, Diagnostic and Correctional Center in St. Joseph.

Over the past two years, Porter has told numerous stories about what happened to the children, ranging from saying he killed them to insisting that they are alive and living with a well-to-do family.

Porter’s attorney in the kidnapping case, Tim Burdick, did not return phone calls Tuesday for comment. But Porter denied involvement in any murder-for-hire plot in phone calls to his sister-in-law and mother earlier this year. Recordings of those conversations were obtained by The Star.

“Don’t believe there’s someone in here working with me,” Porter said in one conversation. “If I wanted to kill her, wouldn’t I have mentioned it to you guys? If I wanted to kill her, why didn’t I kill her? Why would I have someone else have to do it? No, I don’t want to kill nobody. Never did.”

Tina Porter, however, said she was shocked when she received the letters from the inmate starting in September 2005.

“This is a contract on my life,” she said. “What really bothers me is how Dan could even think like that.”

She said that she took the letters to Independence police last fall but thought that nothing ever happened. She said Jackson County prosecutors told her that they would deal with the issue after Daniel Porter’s trial in February.

Independence Police Sgt. Dennis Green said Tuesday that he thought a report had been filed on the incident but that he couldn’t discuss it because the case was still under investigation.

Bronwyn Werner, the assistant Jackson County prosecutor who handled the kidnapping case, said last week that no decision had been made yet on whether to pursue the matter.

“We’re still debating about what to do with it,” Werner said.

Frustrated at the lack of action by local authorities, Tina Porter went to the FBI in July.

In the first letter, mailed Sept. 20, 2005, the inmate told Tina Porter that he could help her find her missing children.

He said he was in jail with Daniel Porter and that the two had talked extensively. To prove it, he described Tina Porter’s house, noted personal information about her and even correctly wrote down the combination to a safe inside the house.

“Nobody else knew that combination,” Tina Porter said. “Just me and Dan.”

The inmate was in jail on numerous charges, including the sale of narcotics, resisting arrest and DUI, when he wrote the letters. He was released in January and could not be reached for comment.

In the second letter, mailed Sept. 30, 2005, the inmate wrote Tina Porter that he thought her children were safe and said that if she gave him $3,500 he would help her get them back.

Then there was a third letter, mailed Oct. 18, 2005.

“I didnt hear bac from u, so u must be thinking Im playing,” the inmate wrote. “Im not. I got alot of info if u would also help me please I really can help u. Im gone tell u this much how I got your address and the color of your house cause he wanted 2 have his brother pay me 2 kill u when I got out.”

The inmate then wrote the correct name and address of Daniel Porter’s brother, who lives in north-central Missouri.

“I was apose to contact him when the job was done in get my money,” the inmate wrote. “Im going 2 tell yes your kids are still alive thats why he wanted 2 pay me to kill you so u will not have the kids. Its the truth. I’ll give u the rest if u will help me also. This no game. … So u get bac let me no were we go ASAP. I will find your kids belive me their alive and doing good!”

Daniel Porter’s sister-in-law said Tuesday that she and her husband first heard of the alleged plot last fall when police questioned them, but added that they had nothing to do with it. On the jailhouse tapes, she told Porter that police said he was going to have his brother pay the inmate $3,000 to kill Tina Porter.

“Supposedly, you’re in cahoots with somebody in that jail,” she told Porter. “And that you told them that we would pay them some money if they were able to kill Tina. And I guess this guy’s got complete directions to my house. That’s what they’re telling me.”

Porter replied, “They’re lying to you. Besides, if you was gonna give somebody a reward for killing Tina, wouldn’t I tell you guys? And wouldn’t I first ask you if you’ve got so much amount of money, however it was gonna take to kill her? They’re just trying to get more information.”

Jackson County prosecutors said investigators continued to search for the children but said they’d developed no new leads.

“He’s (Daniel Porter) given a lot of conflicting statements,” Werner said.

Independence Missouri Police state they believe Daniel Porter was going
to kill himself before he was arrested. They found a hose inside his truck
that could have been run from the exhaust to the interior of the vehicle.
"He threw guns in the river &shy; things that were important to him, and quit his job after 20 years," Gentry said.

Police and rescue dogs started searching La Benite Park in Sugar Creek again for new leads in the search for Sam and Lindsey Porter. Nearly 60 to 70 officer and volunteers participated in the search that extended all the way to the Kansas City border.

Daniel Porter goes before a judge and pleads to being a felon in possession of several firearms. Porter admitted to possessing three handguns and a shotgun. The weapons were found July 11th, 2004 in the Missouri River near LaBenite Park in Sugar Creek. Sentencing was scheduled for April 27.

A federal judge sent down a strict court order for Daniel Porter.

U.S. District Judge Ortrie D. Smith stated in an order Thursday he may not grant Porter a lesser sentence on the weapons charge because Porter won't give information on the missing children.

Smith's order also stated the court would even consider in creasing Dan Porter's sentence. Smith cited a federal sentencing guideline to potentially increase Porter's time based on the defendant's reluctance to talk in the case of the missing children.

Porter could face 10 years in prison on the weapons charge and, potentially, further charges in the missing-children case.

Friday May 13th, 2005
Federal Judge Ortrie Smith, while handing down a 10-year sentence on a weapons charge, asked Porter, the father of missing children Lindsey and Samuel Porter of Independence, if he had anything to say to the court.

After a whispered discussion with his attorney Laine Cardarella that lasted about 30 seconds, Porter shook his head and used a tone barely audible to the court.

"No sir," he said.

Porter, a prior felon, was not allowed by law to possess the numerous handguns, rifles and shotguns he admitted to having.

Testimony from Independence detectives Dennis Green, Travis Forbes and Wayne Hartley helped federal prosecutors allege numerous weapons infractions, including his attempt to dump up to 14 guns at La Benite Park along the Missouri River in Sugar Creek.

Divers later recovered six weapons. Judge Smith let testimony stand that Daniel Porter possessed several other weapons, including two turned in by citizens and two more stored in a ceiling at Tina Porter's Independence home.

Even with Daniel Porter facing a 10-year sentence on the weapons charges, Jackson County Prosecutor Michael Sanders is pursuing two counts of kidnapping against him. Those charges could net him a lifetime in jail.

At every step of the way, Porter has waived his chance to speak about the children.

Judge Smith said he was disappointed in Porter's silence.

"It almost brings me to tears to think of the pain those kids must be going through," the judge told Porter.

Smith said Porter's motive for silence seemed to stem from the pain it caused his ex-wife. Smith said the greater consequence was the children being without their parents.

"You didn't just take Mrs. Porter away from them, you took yourself away from them," Smith told him.

Smith's sentence begins today with 120 months in federal custody, and the probability of coming before county prosecutors on the kidnapping charges.

Following the term, Porter cannot have any contact with his ex-wife, and he must undergo counseling for substance abuse and a mental-health screening.

The jury convicted Daniel Porter on two counts of parental kidnapping and two counts of kidnapping-terrorizing, after four hours of deliberation.
As the jury announced their verdict, Porter expressed little emotion. He left the courtroom hiding his face behind a yellow legal pad. He will return to a cell in the Jackson County Detention Center, awaiting his sentencing in April.

Daniel Porter got the maximum sentence Friday for two counts of kidnapping and two counts of terrorizing in the disappearance of their two children.

Circuit Judge Michael W. Manners choked up slightly when telling Porter he will spend the next 41 years in a Missouri prison for two counts of parental kidnapping and two counts of terroristic kidnapping.

Manners said the mystery and uncertainty about the childen has made this case more difficult than some murder cases.

Porter refuses to say what he did with them, where they are, whether they are safe or if they are alive.

Porter, 43, was sentenced to another three years for violating his parole, and after his time in a Missouri prison he will be spend another 10 years in federal prison for a weapons violation.

He did not speak or show any emotion at any time.

Either the kids are dead by his hand or he just doens't care much about them and is willing to leave them with whoever has them. Heck, he is going to be in prison for the rest of his lousy life. I can't imagine hating someone so much that I would do what he has done...if the kids are still alive.

The Independence Police Department on Thursday released age-enhanced photographs of Sam and Lindsey Porter, who have been missing since June 5, 2004. The children were last seen after their father, Dan Porter, picked them up at their Independence home for a weekend visit. Sam and Lindsey were 7 and 8 at the time.

He sent her an e-mail or text message on the same night he took the kids, right? Why do that when he wasn't even due back with them until the next evening? Could he have been trying to get her out of the house for some reason? Then, after she and her sister leave the house to go find the note he had hidden at the gas station, he sends her another message saying they're at some hotel, so she leaves the house again.

Can police tell where those messages came from? Like, where was he physically when he sent them?

Have they thoroughly searched the yard of her house? If he killed those children, he seems like exactly the type of person who would buy them very close to HER, both to implicate her and to torment her. Plus, he said at some point that "they're right there."

If he truly believed that the children were being harmed in some way while they were in her care, why on Earth wouldn't he SAY that - especially to the judge who had to sentence him? That people could understand, if not condone.

I can't fathom any human being who would act that way. Those are his children, not pawns in a game. I don't what he purported the situation with their mother to be, she is still their mother and deserves to know what has happened to her babies.

Those children, are not children to him, they are weapons, weapons to be used against his ex wife. To cause her the most pain. He does not care about anyone except himself. He will never tell anyone the truth about the kids, he is enjoying the manipulation and control. Of his ex, the justice system, the cops, everyone.

He is one sick puppy and I found it "interesting" that they are having a menntal health screening, like no kidding..............the man is disturbed.

As jaded and cynical as I think I am I guess that I still can't wrap my mind around the idea that people can do that. It's bad enough that people can do the things that they do to strangers but doing that to your own flesh and blood just is something that is more than I can even fathom....
