Leckie murder case: Supreme Court overturns judge’s ruling to exclude recording Ruud made about daughter’s death

As court cases progress toward trial, they often fall into a delicate dance with the prosecution and defense teams tangoing back and forth with various motions that pull one side or the other to the lead.

Last week, the dance continued in the case against Theodosia-area resident Rebecca Ruud, who is charged with murdering her 16-year-old daughter Savannah Leckie in 2017 and disposing of her body in a burn pile on her off-the-grid farm in northwestern Ozark County.

Ruud is currently scheduled to face a Taney County jury at 8:30 a.m. Tuesday, May 18, in the Greene County Courthouse. Circuit Judge Calvin Holden will preside over the trial.

The push forward came as a Missouri Supreme Court ruling was issued April 6. According to online records, the Supreme Court sustained a writ of mandamus, which translates to “we command” in Latin, meaning that the court has ordered Circuit Judge Holden to allow an audio recording that he had previously ruled inadmissible as evidence due to his belief that it was privileged conversation between Ruud and her attorney.

Now that the audio recording will presumably be allowed as evidence at trial, it helps the prosecution in two ways.

The first is that it may help lace together the other evidence in the case, which is mostly circumstantial.

A virtual meeting was held April 16 between Circuit Judge Calvin Holden, public defenders Kate Welborn and Cheryl Duvall, and the prosecution duo of Ozark County Prosecuting Attorney John Garrabrant and Tony Brown from the Missouri Attorney General’s office in reference to the Savannah Leckie murder case.

During last week’s virtual meeting, the group discussed the issuance of the Supreme Court’s writ of mandamus, which essentially asks Holden to allow the recording as admissible evidence, something the judge had previously ruled was protected discussion between Ruud and her attorney.

The defense team has indicated that they will submit a return to the writ on behalf of Judge Holden, basically arguing against the Supreme Court’s decision by providing case law and other legal arguments to support their argument that it shouldn’t be allowed.

The return is due by May 6. At that point, the Missouri Supreme Court will determine if the writ will be made permanent or ensure that the parties are fully briefed and set a date for argument on the matter.

In light of that development, Holden removed Ruud’s scheduled May 18 trial from the court’s trial docket. The trial date will not be reset until the Supreme Court matter is final.

The Supreme Court should have come back by May 6th - but the article says April 17th.

Bench trial for Rebecca Ruud canceled

SPRINGFIELD, Mo. — A bench trial set to begin Tuesday, May 18, for a woman accused of the murder of her daughter, has been canceled.

According to online records, the cancellation was prompted by a pending appeal of a motion to the Missouri Supreme Court regarding whether prosecutors may use a certain recording as evidence in the murder trial of Rebecca Ruud.

“The court cannot hear this case until a ruling on the appeal of Motion has been made,” the records state. “Counsel to keep the Court up to date with the status of the pending appeal.”
