ACLU sues to obtain Mike Brown shooting report; sues over recording issue

The suit asks a St. Louis County judge to order the release of the records. They also ask for attorneys fees and costs and a civil penalty for the violation of the law.

The ACLU said Wednesday that they'd made a similar request of Ferguson, but had not yet received a response.

Also today, the ACLU filed a separate federal lawsuit against St. Louis County, Ferguson and Highway Patrol Superintendent Ronald Replogle, seeking to bar them from trying to prevent the news media and public from recording law enforcement actions.

Plaintiff Mustafa Hussein was identified by the ACLU as a journalist with the Argus Media Group.

Officer Darren Wilson arrested Christopher Brooks on Feb. 28, 2013, after catching him and another man allegedly packaging marijuana to sell while sitting in a car in Brooks’ grandmother’s driveway.

The officer took control of Brooks’ wrist and arm, but he “was resisting all control and refused to follow all commands given,” Wilson wrote. The officer called for backup because he said the situation was “growing increasing hostile.”

“In recognition of outstanding police work while investigating a suspicious vehicle call,” Jackson told a packed city council chamber seven months ago. “Acting alone you struggled with one subject and was able to gain control of the subject and his car keys until assistance arrived.”

We interviewed Dawne Marshall Sunday night. A few hours before she'd discovered three scorched patches of sidewalk and broken glass outside the store, the result of what she believes were Molotov cocktails that rolled off the restaurant's sloped roof.

"Well they started surrounding him. I'm sure there were cuss words thrown back and forth, and when we finally got my husband back in here they were all at my windows, pointing at my husband and saying, 'We're going to get you.'"

On Saturday the restaurant received a flood of fake pizza orders over the phone.

The social media attacks on Faraci Pizza continued over the weekend.

The bottles were located on the southwest corner. the bottles were both charred as if they were set on fire, and had paper wick located inside of the neck of one of the bottles. The ground where the bottles had been smashed was completely charred as if it was on fire at some point.

"Wilson is compromised as a witness," said defense attorney Nick Zotos, who opposed the request by Prosecuting Attorney Robert McCulloch's office to shift the drug case to a panel that meets behind closed doors.

The assistant prosecutor, who did not publicly identify himself in court, did not indicate during Brooks' hearing why the county wants to shift the case to the grand jury. A McCulloch spokesman said later that he was not familiar with the case.

The suit seeks a permanent injunction from U.S.District Judge Catherine Perry, which would prohibit police from enforcing such a rule.

Lawyers for the defendants, St. Louis County and the Missouri Highway Patrol, were expected to present their side later this afternoon, beginning with testimony from county Police Chief Jon Belmar.

The plaintiff is Mustafa Abdullah, an ACLU worker who attended the protests to advise people of their rights and to act as a legal observer.

Officials set up a free speech zone on the south end of West Florissant, where protesters would be able to lawfully congregate.
