Van Note defense: No fingerprints link her to crime scene, experts testify

Kimberly Hardin, who works in the Missouri Highway Patrol crime lab, said she examined seven cartridge casings, one live round, a spent bullet and a telephone brought to her by investigators.

“No latent prints were found,” she testified.

Two palm prints were found but neither matched Van Note or anyone in the state’s print database.

On cross examination, Hardin acknowledged that it’s not unusual for no prints of value to be found at a crime scene. She also responded to prosecutor Kevin Zoellner that it’s possible that no print would be found from the lawyers at the front tables in the courtroom.

“And we’ve been here all week,” Zoellner said.

The witness, John Wilson, a 31-year veteran of the Kansas City, Mo. regional crime lab, testified in the afternoon. He says when it comes to crime scene investigation, scientists tend to be more meticulous than patrol officers: they more thoroughly document and collect trace evidence, he argued.

Wilson has significant experience behind his claim: he has instructed classes in crime scene investigation for local police agencies.

The point of contention between Wilson and Prosecuting Attorney Kevin Zoellner was Wilson’s claim—based on bullet paths through the victims’ bodies—that the attacker was significantly taller than Liz Van Note.

During the cross-examination which dragged into the evening hours, Zoellner hammered Wilson’s testimony. But the witness was unrelenting. The two men talked over one another multiple times, and the judge issued out at least two warnings about it, as the court reporter struggled to keep track of who said what.

"I know you do not like my interpretation of the events," Zoellner told Wilson at one point. Wilson replied, ”It is not that I dislike your interpretation, but that your interpretation does not fit the physical facts of the blood evidence.”

The court recessed in the evening, with Judge Hayden stating he expected closing arguments would take place the next day.

The jury has the case in the double-murder trial of Susan “Liz” Van Note.

After a week of testimony, the defense rested Tuesday morning without presenting more testimony. Van Note, charged in the deaths of her millionaire father and his girlfriend, did not take the stand.

The jury deliberated about six hours before reaching its decision, ending a case that had big money, forgery, a missing person, barking dog, a fight in a hospital and a late-night attack at an exclusive waterfront home at Lake of the Ozarks...

Her attorneys pointed to another man, who has since disappeared, as the killer. No hair, blood, DNA or fibers linked Van Note to the crime scene.

Jury foreman Merri Hess said the panel did not feel good about their decision: “We felt strongly that she was involved, but we had to decide on the evidence.

“ ‘Not guilty’ does not mean innocent.”

She said that not a person on the jury felt that Van Note was not involved.

Sounds like the jury struggled with the decision also, probably only had 1 choice to convict on.
