Solicitor affirms there is NO DIRECT EVIDENCE at this time. (just to review: "direct evidence" is eyewitness testimony, confession, or video of crime being committed). However, this may also mean no DNA evidence? (I don't know)

Elvis parents are speaking to judge.

Terry Elvis talking to judge about the massive amount of threats they've received from defendants, defendants family. Has not stopped though has slowed down. Terry Elvis believes they are a threat to the community. Younger daughter has been threatened numerous times and T.E. does not think it will stop until this case goes to trial.

Debbie Elvis speaking. Asking judge to please consider the safety of their family. Saying how T.M. came to H.E. missing page and disparaged Heather, arguing with community, inciting community to anger, facebook war, 'fantasy world' on facebook, inciting. They brought screenshots if judge wants to see examples. The community has finally started to get quieter and they are worried this will start back up again (slander by TM family is inciting the community).

Terry Elvis talks about SC victims bill of rights... tells judge it "has not teeth to it" and he hopes the judge will find a way to put some teeth into it.

OMG...solicitor just admitted they have NO DIRECT EVIDENCE...just an abundance of circumstantial evidence. This case is done!

LE says they have SM on video using pay phone then, SM says he did
90 phone calls made to HE
2 voluntary witnesses from Tilted Kilt employees
someone is about to get their beat down
unable to retrieve messages from mobile phone
came from SM's phone
M's on speaker phone with Tilted Kilt employee
not going to address everything

Judge interrupts - bond statute - provides info on statute
based on time Defendant has been held after 6 months
our responsibility to determine factors - hearing beforehand to make determination before jury heres testimony
not concerned with evidentiary stuff
no question to determine today

disingenuous to say [by Truslow] that it is a truck driving down the road
touched on phone calls
SM not be truthful
just for the court - did a file folder on everything
money was a mistake - everything short of that came out of discovery
no substantial changes from first bond hearing
flight risk because they are not tied to community
jump up and move without anyone knowing

I'm thinking the judge may grant defense motion for bond.

That's is my interpretation too, Madeleine.. From his comments, I believe this Judge would have given Charles Manson a bond..
Imo, HE, the Elvis Family, and the Horry County, SC community is about to be Nifonged by Judge Markley Dennis..

What can the judge do though? If there is NO DIRECT evidence...can they keep them incarcerated for more than a year now simply because TM is a bad person on facebook? I don't see the state's case going well..and i'm a friend of the Elvis family. I can't believe they have NOTHING. This sucks!
