Its no wonder this area has such a high crime rate & that armed robberies are currently happening on pretty much a daily basis. Our LE is so incompetent that they couldn't solve a crime if their life depended on it. So why should criminals around here ever worry about being caught? Ughhhh. I'm so annoyed that the state literally has NOTHING... yet they have been acting all hush hush... with their sealed motions and gag order requests... like they've got a bomb waiting to drop! Unfortunately, I have no faith in justice being served.

Didn't they bring in a bunch of outside agencies for this case? I can see local LE being inept, but with everybody else involved I'm shocked that they were charged with this kind of evidence.

Responsibility lies with the Solicitor's office.

They agreed to move the case forward to a grand jury. Totally their discretion to push back on LE if they don't think there's enough evidence.

DNA screwup is fault of the lab, not LE.

Hopefully CPS will check in on the children once they get out.

Remember LE found guns inside the house? House in disarray. Spoiled food in the kitchen?

I guess on the bright side it appears that a rift has developed between SM & TM. Did the judge rule on allowing SM to go to his grandma's house while out on bail?

There has been too much drama from all sides in this case. Too much theater. It's felt to me that LE got caught up in the community emotion and pressure. I thought the IE charges were an additional side show and would not contribute to successful prosecution.

I think this is a strategy of one victory at a time on the part of the defense. Now that it's been proven in open court that the prosecution never had any direct evidence, I think we'll see a series of motions. This case may never even make it to trial.

I have never thought that LE had what is said it had. I think they have a wealth of circumstantial evidence and that's it. I realize that can be sufficient to make a case and yield a conviction, and that a body isn't necessary for a conviction. But in this case, I think LE got ahead of itself and declared what it cannot fully prove.

My thoughts at first but we have to remember - the judge wouldn't give her room to talk. He interrupted her at every turn. We only have the long winded judge and the 1.5 defense attorney's side.

With no direct evidence that a murder even occurred, why didn't their attorneys argue for a reduction or complete drop in charges?

You got a good point there @TTF14.

I think the defense didn't bother discussing the gag order since bond was granted.

With your statement, I think it's possible that this may be their next move.

You are correct. I didn't watch the bond hearing today so somebody please correct me if I have this wrong.

Prosecution @ bond hearing last year:
"It was one of only ~75 trucks like that in the state. Moorers own one of those trucks."

Prosecution @ bond hearing today:
"It was definitely a truck on the video."

WTH??

My thoughts on this....from a friend of the family...

This thing doesn't look good in my opinion. The state stood there and flat out admitted that they didn't have ANY direct physical evidence. Circumstantial evidence in the form of a grainy video of a truck that looks like his, text messages, horrendous behavior on social media from TM, an affair on SM's side. Threats etc. I still can't see ANY way possible that they could be convicted unless there is something else. I kept waiting for the solicitor to drop the bomb of some evidence. For them to have NOTHING...is scary. I'm curious how it is that they've spent a year in jail on what amounts to no evidence? How can that be? I just kept telling myself that because of the gag order we didn't know what they have..but it must be pretty damning for them to be able to charge them with murder/kidnapping. God forbid any of us ever get arrested on charges like that based on text messages or the fact that our phone talked to another phone at some point. To me...this doesn't look good.

So having said all of that...WHY have there not continued to be searches or more investigations since they had no evidence for an entire year??? My heart is breaking for Terry Elvis and family!

He interrupted her because his responsibility in this hearing was to determine whether or not they should be released on bond, not to allow the prosecution to present and test its case. Innocent until proven guilty, and in the meantime, are the defendants being denied bond under the law - that was the issue before the court. I'm confident the M's did the crime. I've just never felt confident in what LE handed the prosecutor. I think this starts to explain why the time spent at PTL was so brief.
