What's up with this part? I haven't seen this mentioned.

TM called The Tilted Kilt IIRC to vent at the Manager (BS) about HE. I guess SM was there too and they had the speaker phone on.

Oh, you guys, so gloomy. Here's what I saw: the defense attorneys attacked the evidence and tried to prop up their clients' good character. Did the judge interrupt either of them? I think maybe once, when Tammy's attorney was speaking.

Then it was Livesay's turn, and she was moving in for the kill. But the judge interrupted and the guy sitting next to her had to tap her on the arm before she noticed - that's how focused she was. And the judge kept interrupting, over and over again, throwing her off stride. He told her that a "substantial change" was not the only criteria he could use to grant bond, there was also length of time the accused has been held, and basically he said that was the only criteria he was considering today. Just yanked the rug right out from under her. At that point, I kinda knew we were screwed.

We didn't get to hear Livesay's full rebuttal to allegations that the evidence doesn't exist. We heard a little bit of some of it, but not everything she would have said in response to the defense attorneys' allegations. He kept shutting her down, so now the idea that there's no evidence, the officials screwed up, they jumped the gun or whatever, it's just left hanging out there, unchallenged.

I think what we heard today was very one-sided, so I'm not giving up hope. I wish we could've heard the full argument Livesay was prepared to deliver this morning.

Anyway, hitching up my britches and moving on, I am disappointed that today's hearing wasn't a cavalcade of jaw-dropping info like the March 17 bond hearing. Not that it probably should be, but you know what I mean.

The only new info I picked up is that there are two co-workers of Heather's from the Titled Kilt ready to testify about 90 to 95 missed calls from Sidney. One of those co-workers was reinterviewed specifically for this hearing to make sure that their potential testimony has't changed.
BBM: This may be one reason the judge did not allow Livesay to speak. He doesn't want all the information out there. He could, however, have done that far more professionally. IMO, I'd put him in the early Alzheimer's camp.

The judge blamed code 171530.....

SECTION 17-15-30. Matters to be considered in determining conditions of release; contempt.


(B) A court shall consider:

(1) a person's criminal record;

(2) any charges pending against a person at the time release is requested;

(3) all incident reports generated as a result of an offense charged;

(4) whether a person is an alien unlawfully present in the United States, and poses a substantial flight risk due to this status; and

(5) whether the charged person appears in the state gang database maintained at the State Law Enforcement Division.
Interesting. Nothing about 6 months being too long to be in jail. It even specifically says that the court will consider:
(2) any charges pending against a person at the time release is requested; (This is what usually keep murder suspects in jail)

I suppose that the judge feels that if the Ms were only a danger to Heather, then as long as SM is cuffed to the bed, there won't be any other young girls in danger....

Omg, not a laughing matter, but...that was quite funny.

I think these two killed Heather, but I don't think they are a danger to anyone else (aside from just rising tensions in the community possibly leading to violence).

Then they speak to Sidney Moorer again, a third time. Just him and the police. This is at the point when they know about the payphone call. They ask him again, are you sure? Trying to give him an opportunity. You didn't contact this young lady? I did not contact her. I did not contact her.

In fact, by the third time he had told this story, it wasn't just I didn't contact her. It was, they have payphones? They have payphones? That is when the police told him there was a call made from a payphone to Heather Elvis. Are you sure you didn't make that call? Then it was maybe. Then, when they told him well, we have a surveillance tape. That tape shows Sidney Moorer coming out from behind some dumpsters in the middle of the night to use a payphone to call Heather Elvis. It was at that time he said well, yeah, I did call her.

Also, re: the 90-95 missed calls:

The next thing [Truslow] said was that there was 90 phone calls made, and that we made an issue about that at the initial bond hearing.

I don't remember that from the initial bond hearing. :waitasec:

I know it has been said, but I'm gonna say it again. Most murder trials are circumstantial cases. Very rare to have a witness or other direct evidence.

Just look at Drew Peterson. He is serving a 38 year sentence for the murder of Kathleen Savio. Convicted on all circumstantial evidence. :gavel:

I don't recall LE ever saying they had direct evidence. I thought they admitted straight up this was strictly a circumstantial case.

My predictions...TM is going to go crazy if SM is in another county, free and away from her, remember her postings about his family? TM is going to gain about 40 lbs in the next few months and she's not going to be able to stay off of social media. We need to be all eyes and ears and on the look out. There is going to be a really nasty custody battle over the kids. The Caison family is going to start claiming harassment and stalking again. It's going to be an interesting next few months....

I have quite a sardonic humor at times. And logic follows: if one or the other or both killed Heather, even accidentally, then they are a danger. People don't just stop being angry enough to kill. That much anger could kill again, given the right set of circumstances.
