Exactly! Thanks³!

One of the reasons why I think the gag order is just one big smoke cloud to mask the lack of evidence.

If the state does not have any direct evidence then, they need to find it. Quick IMO. That's part of their job!

Furthermore, I think the community deserves it. At least some sort of announcement as to what they are going to do at this point. They can always ask the judge for permission to do so.

I certainly don't feel confident heading into trial at this point.

And, if it comes down to a directed verdict, everyone is going to freak out!!!

You caught that, too? The judges remark about the 'directed verdict'? ....

I have to wonder if in this case that prosecutor should have waited to bring charges or drop them and charge them with something smaller for now until they get more evidence. I would hate to see these guys set free for ever.

As I see it they need t go back to the beginning!
Cell pings Truck sightings ETC ETC and go from there.

dont you all think SM will rat his wife out and TM will rat SM out!
Once they are apart they will fear what the other is up to...
Did he tell?
Did she tell?

Didnt Tammy say yesterday in court when she tried to interrupt the judge that they said she she would be able to go home if she said SM did it?

I think they should have never charged them with her murder till they had what they needed.
what if they get the charges dropped? Lack of evidence!
Double Jeopardy and all!

IMO if they had any evidence at all they would have used it yesterday to keep these smug 🤬🤬🤬 in jail!
And bond would have been denied!

Yes. She said that in response to them saying SM was offered to walk if he would say TM did it. She said 'I was told that, too'...

A directed verdict is verdict rendered by a jury upon instruction by the judge that they must bring in that verdict because one of the parties has not proved their case as a matter of law. The judge has the discretion to take over the fact-finding role of the jury when the evidence is so compelling that only one verdict can be given. A judge in a criminal case may direct a verdict of acquittal when the judge finds the prosecution has not proved its case, but the judge may not direct a verdict of guilty, since that would deprive the accused of the constitutional right to a jury trial

If he is - the media hasn't found out about it.

Which will make for some interesting fodder --- if his release is very quiet as opposed to the media knowing well in advance of TM walking out. KWIM?

Double Jeopardy and all!

If they are dropped that is not double jeopardy. If they get a directed verdict it is. There is a difference. The prosecutor should make sure he has enough of drop the charges for now.

It will make them look like victims! and they are not!
Better to leave them be is my opinion!

(I wonder if TE would agree on this point, that it's better to leave them be, especially now that it looks like there is a good chance they could walk...?)

In a jury trial, a directed verdict is an order from the presiding judge to the jury to return a particular verdict. Typically, the judge orders a directed verdict after finding that no reasonable jury could reach a decision to the contrary. After a directed verdict, there is no longer any need for the jury to decide the case.

A judge may order a directed verdict as to an entire case or only to certain issues.

In a criminal case in the United States, once the prosecution has closed its case, the defendant may move for a directed verdict. If granted, the verdict will be "not guilty". The prosecution may never seek a directed verdict of guilty, as the defendant has a constitutional right to present a defense and rebut the prosecution's case and have a jury determine guilt or innocence (where a defendant has waived his/her right to a jury trial and allowed the judge to render the verdict, this still applies).

In a civil action, a related concept to the directed verdict is that of a non-suit.

This concept has largely been replaced in the American legal system with judgment as a matter of law.
