This is interesting.

According to Truslow yesterday, during discovery, the defense learned that TM's Facebook page was hacked and some postings were made [without her knowledge].

...did not know at the first bond hearing was that, there are two individuals right now charged with obstruction of justice for tampering with evidence. Part and parcel of that, was the allegation of these two individuals who are connected with the Elvis family hacking into social media and sending messages purpoting to be Tammy Moorer. (sic)

IMOO, I don't think either of the two charged would have the technical knowledge to hack a Facebook account. But, I do believe that a screenshot could be easily altered and reposted.

Reading a few MSM articles concerning the arrests, I picked out a few interesting points.

"During the course of the investigation, suspect (William) Barrett began posting misleading information on a social media site regarding the disappearance of Heather Elvis, which created a community reaction that diverted investigating officers," police said.

"Also during the investigation, (Garrett) Starnes fabricated misleading information regarding the disappearance of Heather Elvis and then relayed the false information to law enforcement," police said.

This information was then posted to a social media site, causing investigating officers to obtain legal process regarding the information which diverted them from legitimate leads, police said.

Barrett’s case is still pending, according to the Horry County public index.

Donna Elder, the assistant senior solicitor handling the all three cases, said Thursday that the Barrett and Starnes cases likely won't be pursued until after the conclusion of the Moorer murder trial so as to limit any pretrial publicity.

Jimmy Richardson, solicitor for the 15th Judicial Circuit, said a judge dismissed the case during a recently held preliminary hearing because a police officer who was supposed to testify didn’t show up, thinking the case had been continued. Richardson said that in the past, hearings in which police officers didn’t show up would’ve been rescheduled. It’s only recently that judges began dismissing cases outright.

  • Barrett's case is still pending but, won't be pursued until after M's trial.
  • GS's charges dropped because LE did not show up to court!
  • How would the defense be able to use these arrests for a defense if BB hasn't been tried yet and GS's charges have been dropped?

There shouldn`t be any maybes as far as calling in the FBI. It should be Priority. I thought that as soon as I heard that issue brought up.

I wonder if he will get custody of the kids?

Tammy's family has had a year to paint their mom as the aggrieved party in all of this. I wonder if they'd even want to be with him at this point.

Yes, I think they'd be better off away from that family compound, no matter what. I hope they're getting some outside help, but kind of doubt it.

I have wondered the same thing TTF14. Which leads me to wonder if SM is holding out for immunity from all charges to give up what he knows. I wonder this because of little things. 1) SM totally ignored TM in court despite her desperate attempts to make eye contact with him. 2) SM's atty made it clear that a plan had been set up by SM's family for him to have shelter which would accomodate the children, a job with his brother who would put him to work immediately. (and I assume Sm's brother would provide him transportation to/from the jobsite.) 3) per TM's postings on Social Media, she does not care for SM's family. Maybe it would be less likely for TM to cause calamity for SM while he is in his family's environment.

This is just MOO and speculation on my part though.

Did anyone notice if SM was wearing his Disney tie yesterday? I only got a glimpse when he entered the courtroom. TIA

No, lol. In the beginning there was at least one poster that I remember that thought they were innocent. A woman who knew TM from the Disney stuff....A FB friend I believe, in another state. Or was that on a Facebook group about this case?

The poster on here that I remember that knew Tammy from Disney related stuff did not think they were innocent. I can't remember her username.

I am hoping that SM will go live near his family and stay away from TM. Maybe (big maybe) his family can be persuasive enough and convince him to throw her under the bus! I feel he had a part in all this, but TM and maybe others were the mastermind. JMO

You know that SM has to feel guilt about this, Heather would be alive if they hadn't had an affair and the mother of his kids wouldn't have been in jail for murder. I can't help but think it's because of his kids and guilt that he's not talking.

The prosecution begins - "I do have to clear up some of the things they said or I feel I would not be doing my job" - the judge replies "Please do"....She then says that means she will be getting into the facts....and that she'll try to keep it as brief as possible. Again the judge says "Please do..." She keeps talking and the judge is trying to say something more - the attorney next to her taps her arm because she was unaware he said anything -- then the judge says "excuse me" and says he doesn't mean to interrupt her -- then says "You have the floor now. Feel free. You state as much and as long as you feel necessary. Thank you. Thank you vey much I can hear your concern." (10:43)

She then begins and talks about the phone call from SM at the payphone, then the 90 phone calls made to Heathers phone, then the things said by TM. At 17:08 he interrupts her to ask what defendant she was talking about and she clarifies TM. At 18:07 she says she's not going thru all the evidence but "just the points Mr. Truslow made" - (18:25) The judge says "Let me interrupt you...." He then goes into talk about if her witnesses will even be allowed to testify..... He goes on to say "There's not question all of those things you talked about are indicia of somebody that might not be telling the truth but that's not for me to determine today because that's what a petit jury does. The will make a decision as to what - if they were being truthful in their responses. Um, it's helpful to me in determining wether or not a PR bond is important for sure. Because, well it is indicia that they might bot have been as forthright a they claimed they were" He apologizes again and at 21:51 she begins to speak again. He interrupts again at 22:18 to make a comment then she begins again at 22:35. She talks about the video of the vehicle and at 23:01 he interrupts to say "I'm not trying that today...." At 23:45 She begins again. She seems to realize the judge isn't going to allow her 'the floor' as he said - so she tries lumping all the points Mr. Truslow made together "Everything presented at the first bond hearing...." - she says she is able to back each thing up....except for one thing - "the deposit slip" -- she says she made everyone aware once they realized it wasn't what they initially thought it was. She goes on to say there has been NO CHANGE in circumstance since the initial bond hearing. At 25:08 the judge inserts he agrees there has been no change. At 25:33 he interrupts to ell her her this bond hearing is ALL about 'risk and flight' - he goes on and slides in another "mistake" made by the prosecution - and that was about the DNA evidence. At 29:48 she is able to begin again.

In my opinion - she then does a very poor job of talking about them and their flight risk. It was poorly worded - and this is why I believe they went into the bond hearing today thinking that the defense was going to have to prove a "change in circumstance" - and did very little to prepare for the 'risk and flight'. Part of why I believe this is because the judge had made it clear this hearing was not all about change in circumstance but yet she kept going back to that even after the judge made it clear by saying "that doesn't matter". (34:16) The judge interrupted again to talk about how bond isn't to keep someone in jail but to ensure the bond is high enough to have them return to court. He ends (37:59) with "Do you have any direct evidence". She says no and moves on to say the victims family would like to speak.

Is it me or did the judge do some double speak? He says in one breath the information she's presenting is for the jury (like the bond hearing wasn't the time or place) - but then in the last part says it IS important for PR bond - THEN kind of makes it clear he's not interested in hearing it (indicating the only reason she was addressing it was to imply change of circumstance and ignoring that he said there is importance in him knowing these things for a PR bond??

I said it earlier - I believe this judge had his mind made up before anyone spoke what he was going to do - and that just feels wrong. I also found it very interesting that he made the point of bringing up 'another mistake' (for lack of better way to put it) about the DNA. He wasn't letting HER talk about evidence in the case - but yet he brings that up? SMH

OT I privately now refer to this judge as Judge Chamberlain Haller, brilliantly portrayed by the late Fred Gwynne in 'My Cousin Vinny' because they sound so similar. Heck, even the fictional Judge Haller showed respect for Ms Mona Lisa Vito more than Judge Dennis gave to Ms. Livesay. I was born and raised in AL and have lived in NC for almost 30 years so I am familiar with 'Southern Gentlemen' and how they view women, ahem. Nuff said before I go off on a tangent.....:D

For those that think SM will start singing and throw TM under the bus...I couldn't disagree more. In the beginning i was sure that once they separated the two of them that that would happen. But really after almost a year in jail waiting for bond/release....why would one of them begin talking now? Hell, before yesterday I thought it would be SMART for one of them to tattle on the other to make a deal. Now that i've seen the state has WHAT APPEARS to be a thin case, i'm sure they won't talk now. If one of them was going to implicate the other, wouldn't they have done it 11 months ago rather than wait and do it now? I'm guessing that now they'll be back together at one place or the other, so the chances of them talking now seems almost non-existent. Just my .02
