After seeing how skinny she is...my wife is considering the "jail diet". It's quite amazing the transformation!!

A directed verdict is verdict rendered by a jury upon instruction by the judge that they must bring in that verdict because one of the parties has not proved their case as a matter of law. The judge has the discretion to take over the fact-finding role of the jury when the evidence is so compelling that only one verdict can be given. A judge in a criminal case may direct a verdict of acquittal when the judge finds the prosecution has not proved its case, but the judge may not direct a verdict of guilty, since that would deprive the accused of the constitutional right to a jury trial

But if the judges directs the jury to do anything, then was no jury trial, either. They were STILL deprived of a jury trial. It's only OK to be deprived of a jury trial if it's in the defendant's favor? It's why the law is so defective sometimes....

Seems to tell me he's not coming home to her, she wouldn't need to visit - she would just need to pick him up.
Since SM was originally supposed to be going to his family to live, she might have been letting him know that her mother's house would work for bond for him as well, checking to see if he had changed his mind about living with his family and wanted to live with her and the kids, if not, would he be sending her and the kids money to live, or arranging for days/times for him to see the kids. I get the feeling they didn't get to talk much while in jail....

I keep searching the news sites and am dying to know if SM has bonded out yet or not. Can't find anything on it. Anyone know how to figure it out? For those of you that might get grossed out easily...just imagine tonight after almost a year without.....

Just remember --- there was never any ABSOLUTE about SM going back to berkely county. His attorney simply stated that was an option he had - to show the court there would be some stability if he bonded out. To try and show he could live somewhere other than in Horry County where all the uprisal over this is....all the details of him living down there and working for his brother, etc was said to show that SM wouldn't be a flight risk - that he had a plan in place etc ....(That same attorney said the kids could "go back to public school in Berkley County" inferring they weren't in public school in HC because of all of this ---- when we all know that M's kids had been homeschooled for years before this!

The judge didn't make it so that plan had to be followed - so SM is open to do anything he wants to do now. He may never have WANTED to go to his grandmothers house and stay in Berkley county! He may have been WILLING to do it if the judge made him...... We may never know for sure - but time will tell. She's only been out a day.....

Just saw on the local news that there was some type of snafu with his paperwork so it may be tomorrow until he is out. That HCSO page for J. Reuben Long is odd. It shows them both still incarcerated if you type in their name. But when looking at TM's charges it shows the bond amount for each charge...which ends up equaling the 100k bond amount. So it's been updated with the amount of the bond...but not showing her release. Oh well...govt right?

Well, I am going to make a guess that IF he SM does go back to the compound with his wife (TM) that LE will be busy responding to the compound for 911 calls of fighting, domestic abuse, and all that goes with it! Just a guess. But then who knows, maybe SM has agreed to be handcuffed again then all would be well...LOL

I think we have a bit of a power struggle going on. Caison will post bond for him if he goes home to TM and doesn't communicate with his family or his family will post bond if he goes to Berkeley County, anyone else think so? TM couldn't wait to visit him to show off her new look. It's cold here and she's walking around in short sleeves.

Seems he wants them and honestly I think they would be better with him.
Tammy makes my skin craw.

I agree, they would be better off with SM and his family. PC, scares me as much as TM and the rest of her family.

I remember all that TM said about SM's Mom and family on that Dis board. IMO, she turned SM against them, but in the end who still loves and supports him ... I hope one day we get to hear them speak of Tammy and the pain she put them through.

Sorry this was in response to Hoppy hit the wrong button and didn't quote the post.


I looked at this plan from the SMs defense was a plan for SM to get bond (not TM since he was only representing SM). Since TM has bonded out too she can go back to homeschooling them.

Jail must have been Good for her!
I am shocked that she is out on bond.
IMOO.

I want to know what kind of makeup she uses right now!

According to Truslow, SM has been offered employment by his brother. AFAIK, no word on where Tammy will reside. Upthread, PeterThomasFan pointed out that the Moorer home was within the five mile no-go zone of the Elvis residence, so I don't think she would be allowed to live there or at her Mother's. It seems like Sidney's plans included his children, but not Tammy. I wonder if she will try to weasel in where he will be living. It will be interesting to see what happens next. Just wish Heather could be found.

Can you imagine living with that nightmare after she's been locked up for nearly a year? No wonder he hasn't bonded out - he'd probably rather stay in prison.

"Monckton feels the biggest challenge for the state will be taking the evidence they do have, and making it line up just right. "If A goes to B, and B goes to C, and C goes to D, and there can be no other path but that," Monckton added.

He said the challenge for the defense would be to prove the opposite. Monckton noted, "to show that there is no evidence, it's pure speculation."

Monckton says if the state cannot get over the point of speculation, the defense could ask for a directed verdict. "Then, the judge will be put in the position that he's going to have to grant a directed verdict which would be a directed verdict of not guilty," Monckton said.

If this case went to a directed verdict, that means a jury would not hear this case, and it would be solely Judge Dennis making that decision.

Also - FWIW and in case anyone is wondering....

Unless something different was put in place for them - "visiting" at J Rueben consists of checking in - being taken back to a room where there is a phone/video screen. You pick up the phone and you see the other person talking to you (they have the same set up as the visitor). Visiting times are set -- Inmate visiting times:

Monday, Wednesday and Saturday 8:30 a.m. - 3:15 p.m.

For the moment I'm going to fantasize that this is all a set up for TM. What better place for her to slip and say the wrong thing than in a jail visit with her co defendant husband she hasn't had access to for almost a year? I can dream can't I? :happydance:

I did a Google search on this judge and saw a couple things that made me think he might be considered defense-friendly. One web page was ranting about this judge giving someone who had several shootouts a light sentence of less than a year and the judge dismissed other charges against the perp. The judge's performance at the Moorer bail hearing already made me think he's liberal towards defendants as well as has a massive ego that requires preening and lecturing when the camera is on. Something about him made me distrust him and I don't normally feel that way about judges.

I don't have a problem with any judge ensuring the state meets their burden under the constitution, and they should do exactly that. But I do have a problem if the judge has personal, political, or ideological leanings and/or if a judge's need for ego gratification and being in the spotlight creates an unfair and additional burden. This judge discussing evidence at a hearing, where he said not 10 min before wasn't the time or place to discuss evidence, shows he is a FlipFlopper. Also, the fact that he told the state to take their time, then interrupted them to tell them they 'have the floor,' then interrupted again to wax nostalgic about the past is another example of this behavior. I distrust FlipFlopper types whenever I encounter them.

If I were in the County Solicitor's office I'd be researching past cases this judge has litigated, talk to other Solicitors who have had to try cases in his courtroom, look at the history of which side prevailed at trial, and figure out what this judge's deal is and do this well before May, because there is something that needs to be researched there (IMO).

Concerned their case may not be as strong as we had thought. Remember how Casey and Jodi changed looks for the trial? I wonder if this isnt what is going on with TM? Her attorney may advised her to lose weight and get to looking as good as she can since the victim was so young and pretty. Maybe to counteract jealously? jmo
