With the Grand Jury is the hearing just the DA/State presenting evidence or are Defense atty's allowed to be present?

I'm used to seeing preliminary hearing with both parties present so Grand Jury process is not familar. Sorry in advance for the question to those that are familiar.

Or, do they have to wait for Grand Jury to come back with charges before doing bail?

Or is State fearful of flight risk and that is why suspect hasn't had bail hearing?

From what I gather, the defense made no motion for his bond hearing as was reported in between the time BT was adding more lawyers to his defense team.

Later, co-counsel Tony Farese alleged that DA filed motion to hold BT without bond before his initial appearance, before the agreement to not hear the bond hearing until a later date.

I don't think any interference here except BT's lawyer's getting organized. Defense wanted bond hearing at later date. It all happened within a matter of 3-4 days.

The Lafayette County Sheriff’s Department announced Wednesday at 12:09 p.m. that no bond hearing has been scheduled for Brandon Theesfeld.

“The bond hearing will be held when the defense attorney files a motion for the bond hearing,” the statement, attributed to Chief Investigator Alan Wilburn, read.

Local attorney Swayze Alford is representing Theesfeld. According to Alford’s law office website, his clients are “often referred to him for his experience in divorce, DUI and criminal defense work.”

MEMPHIS, Tenn. — A motion has been filed to hold Brandon Theesfeld without bond in the murder case of Ole Miss student Ally Kostial, District Attorney Ben Creekmore said Thursday.

That means Theesfeld would remain in jail until the next court hearing, which will not happen this week. Creekmoore says the case will be turned over to the grand jury.

Unlike a preliminary hearing, held in court with the defense side present, the grand jury does not make its decision in the context of an adversary proceeding. Rather, grand jurors see and hear only what prosecutors put before them.

(Prosecutors technically have an obligation to present “exculpatory” evidence—evidence that suggests that a defendant might not be guilty—though there is not much other than the prosecutor’s conscience to enforce this rule.)

Nope. Don’t forget that grand jury does not convict, they indict the suspect. Also, unlike a preliminary, prosecution is not required to establish probable cause with a grand jury.

No bail hearing rests squarely on defense shoulders.

What makes it even harder to stomach is if you just look at these two kids on paper, their worth is so disproportionate. She's a model student with her whole life in front of her, he's a burned out slacker going no where. Gotta teach our daughters (or gay sons) that nothing in life is worth hitching your wagon to someone even 10% as douchey as BT because at best, it'll make you miserable and at worst, it gets you shot.
 
This has probably been answered and I just missed it. I have worked in the legal system for many years and should know this, but I always thought cases went to grand jury because there was some question about sufficient evidence to indict. Am I wrong about that?
I thought the same. Haven’t seen anywhere that he was being held on an open count of murder....maybe they will decide another murder charge if she were indeed pregnant.

Thought regarding his choice of "You Dropped A Bomb on Me" as the song he mentioned. Apparently he was dropped by his fraternity during pledging (no link for that...read it on here somewhere), but does anyone know WHICH fraternity he was pledging? Reason being...the Sigma Nu chapter at my school used that song as "their" song and even had a dance to it. (I may have done that dance many times, but that's a story for another day.) They used that song because the pilot of the Enola Gay (that dropped the bomb on Hiroshima) was a member of the Sigma Nu fraternity. Not sure if that was just the chapter at my school or if all chapters use it.

Probably a stretch, but that may explain why a song that old was in his thoughts.

Edited to add: Just read that he MAY have pledged Beta Theta Pi which would make all of this irrelevant. Maybe it will win you a prize in a contest of useless trivia.

It was revealed earlier that BT is a fan of incarcerated rapper "Tikashi 69" who BT allegedly modeled the photos below. BT posted them to his social media.

Certain lyrics from the song "She dropped a bomb on me" have also been attached to rappers, gangsters, etc. that are in prison including Tikashi 69.

Actually, it's the narc/sociopath that hitches his/her wagon to our daughters and sons. They are frauds, and seek to associate and be connected to the respected, loved, and model student here as a means to elevate themselves.

The narc/socio introduction is masterful, and initial love bombing is pure manipulation in the greatest sense. And victims spend most of the relationship trying to get that charming, interested, attentive, person back.

Narc/socio also won't like your friends, or want to be around them as they are afraid of being exposed.

I've no doubt that Ally walked away more than once during the last 3 years only to be reeled back in by BT's false, manipulating self. Countless quotes how BT took advantage of Ally, and led her on -- apparent to everybody but Ally. He was a powerful drug to her.

In addition to teaching our sons and daughters to stay away from the disordered, it's very important to make them aware of the tell tale signs of narcissism before they begin dating.

Most recent case I can think of was TN high school student Emma Walker shot while she slept after breaking up with her boyfriend. Her parents working to make signs of unhealthy relationships HS curriculum.

He very well might not have even joined a group. Many drop out during the pledging process. Since I haven't seen any pics of him wearing letters, I would think there is a good chance of that. JMO

I do not believe for a second that any family seeking justice for a brutal murder would want anything sealed and certainly not this early, in what no doubt might be a protracted process of litigation.

We don't know who ordered the seal and why but we do know that the press were having difficulty even getting the charges confirmed from LE. Charges so far as I'm aware in most jurisdictions are a matter of public record. Perhaps this isn't the case in Oxford or Mississippi as I haven't had a chance to look? Or do the press routinely have to use Freedom of Information to confirm charges with LE?

Its interesting that prosecuting this case you wouldn't lead the charges with double murder rather than your suggested path of AK murder and then plead? Why plead at all if the facts are as strong as they appear to be here?

Fact pattern appears clear: Victim died a violent death with 8 gunshots to the abdomen and was left abandoned. Victim was found w/i 8 hrs of death I believe and given the nature of the crime the autopsy would have been expedited (or I hope it would have been). This point is unclear though as someone in the prior thread said there was a 'back up' with the coroner and a backlog existed so we don't know when it was completed.

So, assuming coroner was delayed by 7 days or so its likely the process is now done and pregnancy confirmed as well with additional tests such as DNA and tox pending. A surprising number of basic DNA tests can be completed w/i 24 hrs while much longer waits for more complex testing is the norm.

This isn't a case where the body was impacted by decomp and the elements and victim ID was in question. The body was fresh, ID existed and so when body was found the autopsy could proceed quickly with no issue.

Still no additional charges when the information exists to do so. My original question was why not?

Facts of the case look relatively simple so not sure why so many folks seem determined to make things more complicated than they are? Suspect was arrested quickly too so its not like we have a manhunt on our hands. About the only positive thing I have to say in all this is that there has been no bond yet and the suspect remains in jail.
Having everything sealed is the usual process when investigating a crime and for the principals who will be preparing for prosecution and defense.
If it does go to trial -- and I am confident that it will -- a jury will have to be chosen, witnesses, etc., will testify, etc., so all things must be kept close due to those factors. Certainly the press will have to be prevented from trying this thing in the media.

Her parents, I would think, would not want anyone to see the autopsy evidence, and **** that he is, the defendant has a right to a fair trial -- and his attorneys will do their best to burn whoever lets any details be known to the public. That's why details, evidence, who will testify, etc., -- everything must be kept under wraps.
So we wait...
