GUILTY MS - Alexandria "Ally" Kostial, 21, Ole Miss student found dead, Harmontown, 20 Jul 2019 *ARREST* #2

When I questioned 'reasonable bail' I did so remembering a well known case where wealthy parents bailed out their son (had been accused of multiple rapes) who then proceeded to escape to Europe for 7 years or so. During the period when he was on the run, he was allegedly supported by his parents.

I think its a very real risk in this case as well unfortunately. Does LE want to roll the dice that they won't be chasing this suspect around the world if he manges to escape after being bailed out? IDK.

It seems like in the AK case that flight risk could be a very real issue and I'm not sure there is any monetary bail amount that might stop a determined parent from protecting their accused son by facilitating escape.

Here is the link to the Kelly case which took many years to resolve and simply wasted LE time and resources to track this suspect down overseas.

I believe the difference here is that AK (rapist) was eligible for bail for his felony offenses, and I don't believe BT will be granted bail under Mississippi Criminal Code - Chapter 3 Crimes Against the Person. (A lot of tragedy in that Kelly family)...

If the GJ indicts BT for capital murder, no bond is allowed.

At this time, the case is sealed, and the only thing we have before us is BT's arrest affidavit, citing MS Section 97-3-19 which includes: Homicide; murder defined; first-degree murder; second-degree murder; capital murder; lesser-included offenses.

BT was not charged with killing without malice in the heat of passion [97-3-35] which might allow release on bond. No, he was charged with murder. I also expect that the grand jury will likely upgrade the charges with aggravating factors after investigating the over kill by firing eight shots at the victim. MOO

A bond hearing is set for next week for a man charged in the slaying of a University of Mississippi student.

Tony Farese is an attorney representing Brandon Theesfeld, who is charged with murder in the death of 21-year-old Alexandria "Ally" Kostial.

Farese told the Northeast Mississippi Daily Journal that he requested the bond hearing Wednesday after talks with District Attorney Ben Creekmore's office. Farese said he will request a "reasonable bond" during the Aug. 22 hearing.

BBM. I hope the only thing that means is bond was discussed and the DA refused to change stance.

From what I've seen (I don't know how it's done in Mississippi) most folks won't get bond on a 1st degree murder charge. Those who do get bond on a lesser murder charge have to stay in the city or county where the crime occurred and the individual must wear an ankle alarm. His parents live in Texas -- IIRC. Will this affect whether he gets bonded-out? It looks like he's charged with 1st Degree Murder/Malice Murder -- not sure the proper name of the murder charge in Miss.
Please, no bond. He doesn't deserve any kind of break.

I couldn't agree more. The laws look as though it is unlikely.

We shall see, he has a high powered law firm and what the judge decides will say a lot--imo.

This is a heinous crime and it seems they have plenty of proof. He should remain without bond/bail.

Or so I would hope.

Looks like all Brandon's parents/step-parents will be in town for the bond hearing.

"Farese said character witnesses for Theesfeld will take the stand, like his parents. His medical history could also be discussed. Farese said his criminal record is clean."

Give me a break!

It should be disgusting and interesting. IMO, they can't say that he had a rough life, his parents abused him, he was sexually abused as a child, etc., etc. -- the only thing they could say, seems to me, is that his parents' divorce really shook him and that he has never gotten over it. This has made him afraid of any long-term relationship because of what his parents and he went through. So if Ally was pushing for marriage or an exclusive relationship, it threw him into a panic and he did what he did in a temporarily-insane period, therefore what happened was not his fault. He was not in control of his actions, poor boy, and it still affects him from time to time, thereby making it difficult for him to study, go to class, etc, since he is so popular with the girls and this causes him panic and loss of control. He has a clean record, ya know, but as he gets older, it's becoming more difficult to keep it together as he gets older.
That's all I can figure.
I don't know if they can show that he has been and is being seen by a psychiatrist or other similar mental-heath professional -- somehow I can't really see his parents putting that out there, but that is one tack they could take. Or it could have been one big meltdown as well -- the pressure that the scheming <gag> Alex put on him, day after day, etc., <choke> made all this bottled-up anguish blow sky-high that night. Just so sad.
IMO, they can't make him look good unless they make poor Alex look bad however they choose to do it.

Has the place Ally was shot been released? Or the date and time? Has pregnancy been confirmed? I know the case is sealed, but that doesn't stop leaks or info being shared by other people. I've neither read it heard anything...has anyone?
Will facts of the case be discussed at the bond hearing? tia

I like to think and hope that the defense will have a hard row to hoe because the jury will have many individuals who have themselves gone away to college, and know how much of a social change it is, to the point where you're really living an entirely different life than that at which your hometown, etc. friends knew you. Largely because the media hasn't been able to find any Ole Miss students to speak well of him, not that they'd be looking for any; but none of these people seem fooled by BT's BS. His college roommate/housemate wasn't the least bit fooled; and it sounds like a lot of their fellow peer students knew BT as practically the living stereotype of a college "frat boy" movie villain, regardless of whether or not he was in a fraternity. I'm curious to see who they in fact dig up as character witnesses.

Yup. Here comes the Rx induced psychotic episode that he has no memory of.

Hopefully the campus dealers will be subpoenaed by the grand jury to testify that BT was their best customer. MOO

Yes, Ally body was located on Saturday morning at Buford Ridge (Sardis Lake) by police on routine patrol around 10AM -- her body riddled with bullets. All this was in the news prior to BT's arrest.

Once BT was arrested, things went silent and case sealed by end of the week.

The prosecution and defense are able to speak openly in the courtroom. Defense has already met with prosecutor in advance of bail hearing -- sure they've decided between themselves what will occur at bail hearing.

I'm sure bail will be denied but they'll give it their best effort (that money can buy).

I know where her body was found, but is that where she was shot? I have seen posters refer to the park location as where she was dumped.

You nailed the headline following the hearing, squareandrabbet! "BT's BS"

Brandon has had a lifetime of making up garbage to avoid consequences.

This will be no different except for the three high-priced lawyers thrown into the mix.

Locals here have said Sardis Lake area remote enough where 8+ fired shots would not be noticed. If she was shot elsewhere, I guess that will come out at trial.

[Anthony] Farese, along with his cousin Steve Farese and Oxford attorney Swayze Alford make up Theesfeld’s defense team, hired by the family of the Fort Worth, Texas student who’s remained jailed since his arrest in July.

Video at link reveals much info -- BT's four parents will testify on his character.

Attorney reports BT is positive and upbeat and been candid with lawyers.

It doesn't sound like defense are disputing BT shot Ally.

Also reported that BT's sister has returned to Texas given all the attention on this case.

ETA: add Anthony to lawyer Farese team (based on video) link.
