Found Deceased MS - Jimmie "Jay" Lee, 20, University of Mississippi student, drove away from apartment, Oxford, 8 Jul 2022 *MISTRIAL - Hung Jury*

“Prosecution for the offense of tampering with evidence must be ‘commenced within two (2) years... after the commission thereof... The indictment in this case was not returned until February 7, 2025, more than two and one-half years after the alleged tampering offense,” Sellers wrote. “Therefore, prosecution of Count II is barred by statute of limitations.”
But it's in regards to the body, right? So maybe because it was just found the argument can be made that it's a new charge? I hope.

Herrington’s hearing ahead of a retrial was originally scheduled for this Friday, Feb. 21, but Herrington’s attorney had a conflict. The bond hearing is now set for Feb. 27 in the Lafayette County Courthouse.
The state is expected to announce during the hearing if it will seek the death penalty

But the wording is “from commission thereof”. The prosecution has already posited that the murder occurred on 7/8/2022. Therefore, two years have passed from commission thereof.

Just my interpretation.

We have seen the family support TH in getting out before. I’m sure any shot they have in getting him out will be taken.

MOO.

Ok. Thank you.
We will see.
RIP Jay!

Earlier this month, a new bond hearing was set for Sheldon Timothy Herrington Jr. was scheduled for this Friday; however, according to court officials, that hearing will now be held at 10 a.m. on Feb. 27 in Oxford.

Herrington was arraigned on the new charge. He pleaded not guilty and did not have an attorney representing him at the time. Attorney Kevin Horan represented Lee during his trial but is no longer Lee’s attorney for unknown reasons.
Hmmm. no slam dunk this time on reasonable doubt because now they have a body. JMO

Here we go.
I wonder if this charge is tossed, would he be free to be on bond as he was previously until trial happens again?

I think that since the underlying crime here is one that has no statue of limitations (Murder), that the courts will find an exception to the rule.
Been doing a little digging on this.

Very interested to see how this plays out. He was already out on bond with the murder charge. The tampering charge allowed them to bring him in. It’s all technicalities at this point.

I hope in the end it will finally lead to justice for the family.

Special Prosecutor Gwen Agho also revealed during Thursday’s hearing that the bonnet Lee was wearing the last time he was seen was found with his remains. She also says moving blankets and duct tape were also found

Tampering charge dismissed due to statute of limitations (as I suspected). However, TH in jail until trial date of 10/13/2025.
Wish they could have found him sooner but am glad that they did.
Hopefully with the evidence potentially gained from having his remains, we won't have to worry about this being an issue and he will get max penalty.

According to court records filed on Monday, May 19, Herrington cited extensive news coverage and public scrutiny via social media posts as reasons for his motion for a venue change.

Herrington argued that he would not be able to receive a fair trial in Lafayette County due to "the amount of pretrial publicity and the local knowledge of the persons and events involved."

"The information that has been publicized online and in newspapers has been severely prejudicial to the Defendant to the extent that the potential jury pool in Lafayette County has been irreversibly tainted," the filing reads.

According to court records, Herrington's new trial date has been set for Oct. 13, 2025, in Lafayette County. The court designated Dec. 1, 2025, as a back-up trial date in the event a conflict arises.

Herrington’s lawyers are pushing to have the case moved out of Lafayette County. They say it’s the only way to ensure their client receives a fair trial.
