Wow, they've already declared a hung jury and a mistrial. Said it was 6-6. Seems too fast to give up though. Hope there's a juror interview on this one.

I will reiterate my complaint that this was a poorly run trial. That judge should be fired!! And the prosecution should be fired. And the defense should be fired. (although, admittedly it was the judge who should have kept them in line.)

The testimony wasn't focused on clear evidence. It was allowed to wander wherever it wanted to. Shameful and embarrassing for that County.

Just a week after a Pontotoc County jury was hopelessly deadlocked in his capital murder trial, a Virginia man has asked the court to set bond.

Jeffrey Spence, 67, of Saltsville, Virginia, has been held without bond since he was arrested in November 2023, charged with the shotgun shooting death of his daughter’s boyfriend. According to the motion filed Monday in Tippah County Circuit Court, he has been incarcerated for 676 days.

The motion argues that since the jury was deadlocked in a 6-6 tie, “the proof is not evident nor is the presumption great” that he committed the crime. Defense attorney David Hill said that since half of the jury found the evidence insufficient to convict Spence, then he should be entitled to bail.

The decision whether or not to grant bail will be up to Circuit Judge Kelly Luther.

The judge declared a mistrial, telling the district attorney and defense to look at their calendars for possible dates in early 2026 for a new trial.

Jeffrey Spence is in court for the second time on charges related to the death of Kirby Carpenter. Carpenter was dating Spence's daughter when he allegedly killed him in Mississippi. Prosecutors say the father took belongings of Carpenter and placed them in bank boxes. His defense claimed that he was not in the state when the incident occurred. The first trial ended in a mistrial.
