Cody Wayne Johnston is charged with deliberate homicide and tampering with physical evidence in the death of his girlfriend, Nicole Waller. Johnston was arrested on Monday afternoon in Sidney, Montana and will make his initial appearance in Richland County District Court on Sept. 9.
Waller, 31, was last seen on Feb. 14, 2013 and the following day her Ford Expedition was found abandoned along U.S. Highway 2 near Poplar, northwest of Sidney.

Johnston’s trial has been moved to the week of Oct. 17...

Phone records show that Johnston called his supervisor at 7:47 a.m. Feb. 14, 2013. During the conversation, Johnston said he was going to take a personal day... A co-employer said that Johnston called him Feb. 15, 2013, and said he had some things going on but if anyone asks they were working together the previous day.

Court records state that the location of Johnston between the hours of 9:31 a.m. and 12:29 p.m. on Feb. 14, 2013, is unknown due to Johnston turning off his cellphone. Waller’s cellphone was also turned off during that time frame.

A new judge has been appointed for Cody Johnston’s trial in Sidney. Johnston is facing the charges of deliberate homicide and tampering with physical evidence.

After District Judge Gregory Pinski recused himself from the case, District Judge Elizabeth A. Best of the Eight Judicial District will preside over the case.

It took just over two hours Thursday for a jury to find an eastern Montana man guilty of killing his girlfriend in 2013, according to a Richland County District Court clerk.

Cody Johnston, 36, was found guilty of deliberate homicide and tampering with evidence at trial. The trial was anticipated to last eight days, but a verdict was pronounced after just three days of testimony.

"It's extremely difficult, it's a small victory," said Waller's sister Carmen Keibler.. "we still don't have Nicky, we cant give her a funeral. All we have is to know that he got convicted. A lot of mixed emotions today. I'm heartbroken because this is a man my family knew, a person that has a wife and kids. It's destroyed a lot of lives, not only for my family but also his family."

While the jury reached a guilty verdict last week in the Billings murder trial, the family said this is still not the outcome they had hoped for.

Nicole's body was never found, even though the jury came back with a guilty verdict for Cody Johnston.

So now they are turning to social media to possibly find some closure. They hope the Facebook page "Find Nicole Waller" will help bring Nicole home.

Though a conviction means that Nicole is legally dead, the family is choosing not to hold a memorial service until the body is found.

After 36 days, Cody Johnston will finally learn the severity of his murder conviction in a sentencing date set for 9 a.m. Jan. 17.

A jury found Johnston guilty on Oct. 20 of deliberate homicide and tampering with physical evidence in regard to the Feb. 14, 2013, disappearance of his former girlfriend, Nicole Waller. The jury deliberated only about three hours before the verdict was announced.

Cody Johnston sentenced for the murder of Nicole Waller

Cody Johnston will spend the rest of his life in prison for the murder of Nicole Waller.

The Sidney Herald reports that Johnston was sentenced on Tuesday to life in prison, with another 10 years for tampering with physical evidence.

Johnston was sentenced by Judge Elizabeth Best of the 8th Judicial District Court.

Waller’s body has not been found.

Waller’s sister, Carmen Keibler, approached the stand for a statement prior to sentencing. In a letter addressed to her late sister, Keibler underlined the hardships her family has faced since Waller’s disappearance, and the pain Johnston still causes them by not disclosing the location of Waller’s body.

“It all seems like one nightmare after another,” the letter read. “I hear your screams, your pleading voice calling for help, knowing I’ll never be able to get to you in time. Cody will always have a hold on us. We will never have closure and never have a headstone to visit, but you will always be remembered — forever and always.”

Keibler also read statements prepared by Waller’s mother and father that detailed the family’s personal struggles since the disappearance, and pled for a maximum sentence to bring justice for Waller.

“Cody has shown no remorse,” Waller’s father’s statement read. “Someone who would kill a sick a weak person would definitely kill again.”

Waller’s daughter, Ashland Johnson, stepped to the stand to address the court next.

“I always tried to protect my mother from her boyfriends because I was afraid something like this would happen,” Johnson said. “She would ask me, ‘why can’t you just let me be happy?’ I tried to let her be happy with Cody, but now I feel I could have saved her. I feel like it’s my fault.”

The national television show Dateline NBC will feature an episode about the homicide case of Kalispell resident Nicole Waller.

The two-hour episode is scheduled to air Sunday, May 21 on Montana’s NBC affiliates.

Not sure if this lines up with the var, but remains were found in Richland Co., 14 minutes from Fairview back in August, which are possibly human. No updates yet, but I think it may be Nicole. Based on Renee Arcand seemingly being a rule-out, this suggests the remains are, in fact, human.
