Also, if one of the suspects grabbed Sherry's shoe, his fingerprints would be on it. That would make it easy to identify someone who has an extensive criminal record.

I'm still having a hard time coming up with a possible motive. Sexual? Robbery? I don't believe it was a hit and run....never did.

Maybe it was a thrill kill. I was even thinking last night about the possibility that they almost hit her, but didn't and they were just angry that she stepped in their path or something so they pulled over and snatched her. Or maybe they almost hit her and she flipped them off or something and that made them angry enough to pull over and grab her.

I don't know. By the way, I am NOT blaming Sherry for any part in this. Just want to make that clear. But I don't know what the motive might have been.

It is kind of amazing that LE was able to find these guys almost immediately,it seems.
You would think two guys who had split up, wandering around the country with no money, one without a vehicle, people like that can be pretty hard to locate. It makes
me think that the tipster knew at least one of these guys and where he was.

This says that they left CO earlier this month, so it was after the holidays (if this report is correct).

Another thought...
In my previous post I asked if a smear of blood from a defensive wound was the evidence LE found on Sherry's shoe. Could that have led LE to Waters? Since he had a prison record, his DNA would be in a national database?

That is a thought but I thought it was said that an anonymous tip lead them to the suspects?

WoW so Agg kidnapping in Montana can carry a death penalty sentence!!! IMO this is HUGE!! Because as I'd brought up
Previously in my concerns for their not helping to locate Sherry's body they already were facing some tough charges(Agg kidnapping).. But this was prior to my knowing the charge is worthy of death penalty and so all the more reason that either or both of these two men would be falling all over themselves attempting to have Sherry's body found to prove them innocent of aggravated kidnapping and rather that it was an accident gone wrong.. If it were an accident Sherry's autopsy would easily and clearly show what occurred and whether it matched with consistencies of Initial accident.. That would be of great help to these two in many ways obviously!! Number one being taking the death penalty outta the picture!!

They're not doing this!! They're not falling all over themselves attempting to help locate Sherry's body EVEN WHEN FACING A CHARGE THAT CARRIES A PENALTY OF DEATH!!*

That is HUGE IMO and its extremely telling IMO that both know that Sherry's body and an autopsy completed on her body WILL NOT SHOW INJURIES CONSISTENT WITH AN INITIAL ACCIDENT.. But rather will show the much darker and horrific truth of her murder!! Guaranteeing them that ticket with a fast pass included straight to death row!!!!

I could see the dp for agg kidnapping resulting in death, but according to this, Montana only has the dp for this (if I'm reading it right):

Montana - Capital murder with 1 of 9 aggravating circumstances (Mont. Code Ann. § 46-18-303); aggravated sexual intercourse without consent (Mont. Code Ann. § 45-5-503).

Authorities have started extradition procedures against two men held in North Dakota in the kidnapping of a Montana teacher now presumed dead.
Richland County Attorney Mike Weber says he expects a hearing within the next 30 days on whether to extradite 47-year-old Lester Vann Waters, Jr. and 22-year-old Michael Keith Spell.

I live in an area that has lots of bike and jogging paths, and I have driven with people and ridden with people and let me tell you there are plenty of people that just can't stand people on bikes or joggers that are in the road, just sayin

I have the thought the same thing.
After reading waters rap sheet it would not surprise me for him to do that,I thought of it again yesterday with the news that it was his vehicle (ford explorer)so probably he was driving.

So actually, it is even a death penalty crime in Colorado, where they CAME from. Ironic.

AND aggravated assault by a "persistent felon" might fit too, if she's dead they assaulted her.

I wonder how they determine what a "persistent felon" is? Just how "persistent" do you have to be? :waitasec:

It is very cold something around -11 and -25 with the wind chill........I belive with this weather anything they come accross will MOST DEFNITLY be PRESERVED(my opinion)
Just the thought of her being out in the cold today just makes me sad, I wish someone would find her. She deserves to be back with her family.

Are you getting snow too? we are getting burried in snow in WA state... the snow will hinder things won't it?

Thank you for the weather update! It makes me sick to think of Sherry lying out in the freezing cold somewhere, but the only consolation I find is that the extreme cold will likely preserve her and the evidence.

Yes we got snow not alot but enough to hinder the search as more is on the way, But the cold is the worst. Hopefully with some warmer weather comeing by weekend(if you belive the weatherman, LOL) more people will get out and search. I know they said they just want the landowners to search there land, but almost every neighbor knows there land aswell. :( sad, to sit on your hands, when you have the drive to help.

There's several different ways to have an ex cousin-in-law but the most direct would be to marry, then divorce a woman whose cousin was C McC.

I changed the name to initials since this person really isn't directly involved in the crime.

This is just speculation but it sounds to me like Spell married and is already divorced.

Or the cousin-in-law could have been married to his sibling. I don't know about other places but we don't claim in-laws past the immediate family. My cousins are MY cousins, not my husband's, and vice versa. I don't call his cousins my cousins-in-law. Never met most of them, and I've got a few he wouldn't claim even if they were his, KWIM? :floorlaugh:

Those courtroom videos have convinced me that both suspects are equally culpable in whatever happened to Sherry. Next to the courtroom guards, both men look puny. I think it took participation from both men to subdue Sherry, who was tall and athletic. The shoe that was left behind is proof of that. Likely, one man grabbed her foot while she was fighting off the other man, and the force pulled off her shoe. LE found evidence on the shoe. A smear of blood from a defensive wound? Mud or grease from one suspect's hand?

FIRST, I want to apologize to Sherry's friends that have to read this post; if it were my friend I would be upset, but it is some thoughts I have about her abduction. Where were they for those six days and was Sherry alive for several days after she went missing. It was definitely too cold for a sexual assault outside, they had to have gone somewhere. Are there gas receipts, motel receipts or another person involved?

Could be.
They could also have intended on raping her, but she fought back and it made them angry so they killed her to keep her from ID'ing them.
Or they could have hit her with the vehicle and then decided they shouldn't leave her body out in the open.
I hope once they get them back to MT, they'll force them to lead them to where they put her body. Her family needs closure, and she needs to be laid to rest with some dignity and respect.
