Yeah, I thought that was funny. He hardly makes a statement without making some kind of reference to his own recollection (or lack thereof). He isn't that stupid. If he were older, I'd understand. But he is too young and too smart to be that forgetful.....and LE (as well as Ms. Stubbs) is well aware of that.

He was coached very well on how not to answer a guestion and if pressed, how to answer it with doubt sitting on top of it.

Do you think the judge has access to the files and info gathered by the CPD? I thought the investigation evidence/info was kept from everyone (except the DA of course and the suspect once s/he's been named as one).
I don't know, SG. I assumed the judge could ask LE for notes on the investigation since she is having to make such a big decision. But, maybe I'm wrong.

And he did a VERY good job of following K&B's instructions. He didn't miss a beat. I think the one big slip up was allowing himself to walk right into the lion's den with the Celine line of questioning. I think that one came out of the woodwork.

True that. Brad hasn't even been named a POI or suspect and they are demanding all documents, interviews, witness lists, etc. in the case. It looks like the defense is actually running scared. That may not be the impression they intended to create, but it's how they are looking.

K & B doesn't need this stuff if he is innocent - all they need is for a LEO to come in and testify Brad has been cleared. Obviously that has not yet occurred after 3 months. The judge will not have access to it either at this point since it is an ongoing investigation. The only thing Ms. Stubbs has from LE is an affidavit which states there are inconsistencies and that Brad has not gone to the LE offices to give a formal statement regarding the murder. They are barking up a tree they can't climb.

Thanks, RC. I admittingly don't know a whole lot about the legal system. I've learned something. I guess it doesn't hurt to ask, though...as far as K&B are concerned.

I had a nice little chat this afternoon w/one of Cary's finest (who looked about 19 yrs old) when I got stopped today for speeding :eek: :frown: (my first time ever having a moving violation). Anyway, I told him that lots of folks are following 'that' case and are wondering when 'you know who' is going to be arrested. He smiled and said he wasn't allowed to comment on any of that. I told him that we've been mentioning/talking about JA Young and cheering him on through an online forum and perhaps he'd like to pass that along. He laughed and said he would do that.

(yes I still got a ticket...didn't even try to talk my way out of it).

{btw, anyone know how to deal with a speeding ticket in NC? PM me if you have good info about that.}

Just my opinion Reddress, but this request for documents relating to an ongoing investigation is about as serious as their request for the autopsy report before the July 25 hearing. The big deal there was they wanted everyone to think the autopsy report would somehow clear Brad. This is the same illusion. They know they are not entitled to records of an active investigation, they are doing damage control by asking for things they will never be granted for obvious reasons. As for the judge - she made it very plain in the phone conversation with Ms. Stubbs and Ms, Sandlin that the only thing she asked of LE was if LE had a way of collecting the children safely. They know this judge has no information from LE so they have nothing to refute except for what has been collected by Tharrington Smith.

But here is a good example of the games being played - keep in mind that Ms. Sandlin objected to Brad answering if he would go to the CPD offices to give a statment to help in the investigation and Ms. Sandlin had Ms. Stubbs call the judge for a ruling.

Note that in the deposition given by Brad - there is not one single mention that he was requested to give a statement but could not do it because it conflicted with the deposition schedule - not once, but yet you have to call a judge to get a ruling after Brad says he has cooperated - baloney ! :crazy:

Well clearly you are a person who believes that the guilty should pay their dues to society, so if you were speeding, you should just pay the fine and pay the insurance company.

The fine is not a problem, and I'll be paying that. What I don't know is how one deals with a point on their record and if there is driving school or not here as an alternative. In CA I know drivers can go to 'school' to avoid a point on their record; that's where I spent most of my driving years so I was familiar with the setup there. :blowkiss:

And...you should be thrilled that the CPD is sticking to their NO COMMENT policy! That serves Brad well that they will not say anything to anyone at anytime unless it's within a legal setting and approved by the Chief of Police and the DA. That's the way it should be handled everywhere. (IMHO)

I'm not sure where you are, but if in NC, you can ask for a prayer for judgement and as long as you are not caught speeding again for 2 or 3 years, you will not receive points on DL or insurance. :blowkiss:

I think it was Momto3 who told me this a few weeks ago. She said that the CPD is known for being very tight-lipped about their cases and they will absolutely not ever talk about any case to anyone...not one word....other than those official PR statements that don't really say anything.

The cops never comment, they are banned from doing so...not just in the Cooper case, but on ANY case. And they comply with those orders. Unlike the kind of leaks one sees coming out of other police forces and the larger ones (like L.A., NYC and others for instance), little Cary PD is run differently and they will not talk. That makes me happy (even though of course I'm curious about the evidence). But nope. Not gonna happen.

Yes, their dedication to silence is a benefit to the guilty and the innocent, until such time they are proven niether guilty or innocent. They are to be comended for following policy.

Lets clear up something before it gets way out there.

Gary Lane Beard is the pest control gentleman born in 1958. The RSO posted here is for Gary Lee Beard born in 1953.

Check out the wake county property records for these two and you will find they are very different people and the Gary L Beard who wrote the affidavit is not the felon sex offender or whatever.

You appear to be correct. Not sure where you got the year of birth for Gary Lane Beard but definitely different middle names. Thanks for clearing that up. Now if people would start publishing their DNA signatures, these close calls with mistaken identity could be avoided. :bigstick:

DO not use your "prayer for judgement" unless you passed a stopped school bus, speeding in a school zone, or drag racing. I'll walk you thru it if it is only speeding. Who do you think had 2 kids on the court schedule last month??:mad:

You couldn't talk yourself out of a speeding ticket with a cute CPD?
