The Cary Police present their felony cases to the Wake County Grand Jury every other Monday for indictment.

The schedule is:

7-28-08
8-11-08
8-25-08

Looks like the earliest we will see an arrest is Monday evening, 7-28-08.

You know your client is the A #1 suspect (just not named) and he DID kill his wife.

And I'm sure he'll have a perfectly logical explanation as to why he was purchasing some type of cleanser at 4 o'clock in the morning.:rolleyes:

Can a lawyer know for a fact a client is guilty (ie. I did kill that man.) and represent him as innocent? I thought they had to ease around that whole "honesty" issue and pretend the elephant did not exist so they could do the circus of a defense strategy. Am I mistaken on this?

Thanks JTF!! Glad Im not crazy- today anyway.. ARe you sure that they present felony cases exclusively as opposed to a standard arrest warrant and DA filing and can you provide the source of reference- I have truly never heard of that before..

I mentioned on this morning also that on Fox this morning one of the producers who is in Cary told Jaimie Colby that the police might have be looking at more then one person.


Yes you did, page 5. I took it to mean a separate suspect rather than an accomplice. I don't know about you guys but I sure would like to know all I can about that. Maybe there is a SO in the area and evidence of a sexual assault. Possibly another person with motive also.

No, your correct. I believe the term without looking at my LSAT notes is "direct admission of guilt.." If you tell your lawyer you are guilty of what you are being accused of, he cannot and would never- malpractice and possible disbarment. Their initial consult usually weaves the tale from the Client in an effort to avoid that.

I am not 100% sure they can know for a fact that their client is guilty but I would think that they can..after all, it is the prosecutor who HAS to prove guilt beyond a reasonable doubt. It is the defense's job just to raise reasonable doubt in just one juror.

Yep.
In Wake County NC, (I live in Raleigh...Cary is 5 miles and in Wake County), the GJ meets on Monday and Tuesday, every other week....RPD and area city police on Monday and WCSO on Tuesday.

Hard to say what will happen on the 25th. I have a feeling he will contest it but then again, he may enter into a Consent Agreement of some sort. I believe it was Calgary123 that said Brad avoids confrontation and would walk a mile around it (or words to that effect).

I do remember words like "partially clothed" being used to describe Nancy after she was found. This didn't seem to make sense since a t-shirt, shorts, shoes & socks would be called running clothes, imo. So, maybe it is someone else besides Brad, but why would LE say this wasn't a random incident and the public didn't have to worry?

Im sure your right about the scheduling, but I am asking about the fact of whether they exclusively present felony cases via GD- that is unheard of that I am aware. Thanks for the help in clarifying!

Only felony indictments in NC are initiated by a grand jury.

Ok, thanks, but it is not mandatory, correct? The DA makes the call as to whether to seek indictment or standard filing of charges and arrest warrant, right?
ie: I kill 3 people at the piggly wiggly on Sat, I'm a free person until the GD conveins?

What about attorney-client privilege?

They do not have to disclose the reason for refusing to take a case or for removing oneself- conflict in the representation compromises ability to defend client, the end. He can never be forced to testify except in the event the "client" advises of an act he "will" be doing the atty knows is a danger.. paraphrasing

The cops can make an arrest anytime.
They can get a GJ indictment after the fact.

However, in this case, they will get the GJ indictment first , imo.

Actually no, they have to provide a prob cause warrant for the arrest, filed through the DA, the DA decides or "signs off (actually collaborates with LE as to the specific charges) " for an arrest or to seek GJ indictment. I think it is fair to say it is not very common to wait for a GJ indictment in a capital murder case, by the time they are seeking it, it is usually due to the fact that the case is not that strong for prosectuion, OR to subpoena someone that is refusing to cooperate or a hostile witness, etc.. to name a few reasons. Also GJ testimony is SEALED, as opposed to open court. Thanks for taking the time to clarify your post, I appreciate it.

Actually, why are you arguing Blink ?

As I said, NC, uses the GJ for felony indictments.

That is a fact.
