We don't know that the family of the elderly couple didn't push for answers. Apparently toxicology results for the couple are back now, and deaths were both due to carbon monoxide poisoning.
Autopsy prior to toxicology left cause of death undetermined.

"“It was just within the past 24 hours that the toxicology reports had become available indicating that there was a lethal level of carbon monoxide, as a matter of fact, 60 percent in their blood level,” Boone Police Captain Andy LeBeau said."

A president of a company that owns a North Carolina motel where three guests were killed by carbon monoxide gas that seeped into their room is facing felony charges.

Damon Mallatere was indicted by a grand jury on Wednesday and faces three counts of involuntary manslaughter and assault inflicting seriously bodily injury following the deaths at the Best Western Plus Blue Ridge Plaza in Boone.

Mallatere's company owns the motel, which is part of an international franchise, where police say a faulty swimming pool heater allowed carbon monoxide to seep into the motel room through a corroded pipe.

IT is so sad. I don't know that anyone would willingly allow this to happen.

I will be traveling with a CM detector from now on.. Who knew they are not required?

The show 20/20 will have an episode on" Imperfect Getways "and one segment covers carbon monoxide in hotel rooms.This must be a repeat.

This is disgusting! It appears to me the ME needs to be charged and sent straight to jail! To come out now and say he knew the couple died of carbon monoxide poisoning, means he lied about their cause of death!

Lying is against the law when serving as a ME and he ought to be stripped of his medical license. He IS the reason this poor boy died and the mom got ill. Wonder how many more people have been ill, just not seriously, by staying in that room? Also, the hotel may have not been renting that room unless they needed it on a sell out night. By not knowing the seriousness of the problem, the Hotel was not alerted.

The hotel has a certain period of time to do repairs cited on inspections. The hotel most likely had failed to meet that deadline. Manager problem or management team who approves the money would be the problem. Therein lies another story! If it was to be a costly project, the money controller, may have said just wait until this spring business is over, use the room only on a sell out basis. There is a university in Boone, so April-May are good months for business. The manager may not be on top of things. Who knows?

Having been in management in the hotel industry, the franchise comes in at specific periods to do inspections. Some owners/management do their own inspections as well. Where this double inspection is done, is where you will find the best and cleanest hotels that are not in the luxury branding. Just an FYI. Am not familiar with this brand, so don't know their structure. Bottom line result is a franchisee has to meet a certain guideline or they will lose their franchise!

Am a bit surprised they don't have CM detectors in the rooms. Now I will have to go look at NC laws. Makes me wonder if this hotel was grandfathered out?

"Requires that all hotels, motels, tourist homes, and other establishments that provide lodging for pay shall install either a battery-operated or electrical carbon monoxide detector in every enclosed space having a fossil fuel burning heater, appliance, or fireplace and in any enclosed space, including a sleeping room, that shares a common wall, floor, or ceiling with an enclosed space having a fossil fuel burning heater, appliance, or fireplace".

I read upthread rooms were available with fireplaces, have no idea what type room is involved in these cases. However, if the room was next to a room with a fireplace, it would need a detector according to this rule.

There is a problem in the state of N. Carolina with medical examiners not being trained and not completing the exams.I will try to find the link.I read this recently, I think it is posted on Websleuths somewhere.
