This was from nearly a year ago - AUGUST 2018 - and there was never an update regarding "the conditions of her release".

Question: What ever happened to Brenda McCutcheon, the wife of murdered plastic surgeon Dr. Frank McCutcheon? She was indicted for his murder in 2017, released on bond in 2018 and there's where the story ends (in the news anyway).

My answer: The wheels of justice are turning, but they're not setting any records here.

Real answer: "This case is currently set for trial Jan. 21, 2020," Buncombe County District Attorney Todd Williams said this week via email. "Further comment by this office is inappropriate at this time."

ASHEVILLE - Brenda McCutcheon says she didn't know anything was wrong until she smelled gunpowder in the TV room.

She said she awoke in the night to a sound she couldn't identify and her dog barking. She thought maybe a heavy picture frame had fallen from a wall in the house. She went downstairs, through each room and was in the TV room, where her husband, Dr. Frank "Buddy" McCutcheon Jr., always slept, when the scent hit her.

“Up until that point, nothing seemed unusual," she said. "But at that point I knew something had happened because there shouldn’t have been a gun in our TV room,” she said through tears.

That was her testimony Feb. 11. Almost three weeks into her trial for first-degree murder, the 69-year-old had taken the stand the day before in Buncombe County Superior Court.

In court, Brenda McCutcheon and her defense attorney, Sean Devereux, of Asheville, made an effort to distance her from the financial issues of her husband's practice.

Frank McCutcheon had primary control over expenses while she was a part time worker not listed as a corporate officer at the business, she testified. She said she trusted her husband to pay the appropriate taxes, but tried to fix the problem when she discovered he had not.

She testified that she learned in late 2017 that authorities believed her motive in killing her husband was that he hadn’t paid taxes. Before that, she said, she wasn’t really thinking about the taxes.

The defense also explored the week before Buddy McCutcheon’s death, during which Brenda McCutcheon said the couple kept to their normal routines, despite a recent visit from Department of Revenue agents.

Devereux played a video the couple took of a bear in their yard the evening of July 14. Both could be heard commenting casually as the bear ate from a bird feeder, dug a hole and fled after disrupting a bee’s nest.

Lock took issue with Brenda McCutcheon's choice to run to a neighbor's yard after finding her husband's body, fleeing out the front door past multiple loaded firearms, but not taking any of them with her.

She noted that, when Brenda McCutcheon got no answer at her neighbor's door, she went back into the house where her husband lay dead without turning on any lights to grab a cordless phone and call law enforcement from the dark yard.

"And you went back out the front door and walked past the weapons again,” Lock noted.

When deputies arrived, Brenda McCutcheon testified, they asked her whether there were any guns in the house. She pointed out the ones she knew were there, including a silver one they usually kept in a kitchen drawer, she said.

It was the gun detectives later found in the yard.

The Defense
McCutcheon’s attorneys argued there is zero physical evidence pointing to Brenda. No confirmable DNA belonging to Brenda on a gun found in the ivy outside their Arden home, and no fingerprints. There was DNA detected but it linked to Buddy and two other individuals but not enough to get a match to anyone.

As for the non-payment of taxes, Brenda McCutcheon’s attorneys argued Buddy knew for years his practice was in trouble with the IRS and was delinquent and didn’t pay taxes including corporate taxes.

The defense has presented McCutcheon had been having affairs with nurses over the course of his 30-plus year marriage to Brenda.

The defense argued a back door was left open and there were signs of an intruder, they don’t know who, coming in and shooting McCutcheon at close range in the head while he slept on a downstairs sofa.

Her attorney also argued Brenda allowed investigators to interrogate her for over seven hours and was cooperative with the investigation. In addition, the defense argues no bloody clothes were ever found belonging to Brenda.
