Anyone got a clue how soon a trial date would be set... are we talking weeks or months for such a decision?... and will there be an attempt for a change-of-venue (out of Durham), or any other major delays? And with death penalty off the table will there be a plea-bargain attempt, or has that already been tried and failed? I wonder how many people pertinent to this case even still live in this (very itinerant) area? What a mess....

No, have never heard of any evidence that he knew of Faith nor traveled in any of her circle of friends. One of many oddities about him as a suspect, and why for 10 yrs. he was on no one's radar.

Just one more thing, is it common for a defense lawyer to want to go to trial before getting all the evidence? Maybe I am misunderstanding or don't have the data, but the news story said both sides ready to schedule a trial, but finalizing discovery. Isn't that turning over the evidence? How likely, again back to the odds, that the defense lawyer has an answer for 39,000 pages of discovery? Or does the defense lawyer only have to answer one question and he has the answer?

I’m sure the state will offer a plea. It speaks volumes to me that for the last 3 years Miguel has been in jail. Don’t you think they would have offered a plea by now? Miguel would surely take a plea, no? Why drag it out so long? If Miguel hasn’t taken a deal yet, to me, Miguel wants this to go to trial.

This is playing out like every single case ever where the suspect is actually guilty. He's changed attorneys multiple times, and is in no rush for trial. Why not? Jail is better than prison.

I like the way you think. Sounds like, to me, defense can PROVE BEYOND A REASONABLE DOUBT, that Miguel is NOT, the murderer. JMO. Could he have been in room? Maybe. Why would someone rape and murder a person and then leave their DNA/prints in all the RIGHT places and nowhere else? JMO

Exactly. Also, to stay in town after committing such a horrific crime?! Not sure of his “status” but I would think someone trying to get legalized/citizenship would NOT want to be on any government radar. He had 9.5 years to hightail it back to his country. He stayed.

I don't think you understand some key facts. Might want to go to the North Carolina courts portal here: Register of Actions

The defense wasn't continuing anything. He had a public defender for three years. The DA didn't release the discovery until June 28. At that time, look at the filing, the DA said it was ALL the discovery. Now from the news, we see that it's not actually all the discovery. Private attorneys came on the case August 29. That's normally a lot of money, up to a million, and this guy is broke. He didn't win the lottery, he cannot play from jail. So it's something else. Big clue as to what it is the first time the private attorneys are back in court, they say let's go to trial.

It's the opposite. The DA is the one saying there is so much evidence and delayed movement. The private defense attorney, who was a prosecutor in the very famous Eve Carson case, says let's go to trial as soon as he gets the chance. There's no way he has reviewed all that evidence. The DA says they haven't looked at it all, even though they have had it for a decade.

If his previous attorneys pushed for a speedy trial, this would have happened years ago. This is scheduled to last a week. It's a slam dunk.

Again, the DA didn't give discovery to the public defender until the end of June 2024. Question for you since you seem a legal scholar: Can a case proceed to trial if the defense has no discovery?
