The Robeson County Sheriff’s Office is conducting an internal affairs investigation in reference to a 2016 incident involving the suspect charged in connection with the death of 13-year-old Hania Aguilar.

Robeson County Sheriff Burnis Wilkins said the sheriff’s office was sent reports from the DA’s office that indicated McLellan was a suspect in the 2016 rape.

Those reports were sent in 2017, according to the sheriff.

“I’m not making any excuses on it,” Wilkins said. “There’s a failure in the system somewhere and I’m going to take care of it on our end.”

i know this Hania's page but i've seen this name several times within the site since Sara Graham was also missing from Lumberton. Irony or coincidence, i dont know, but maybe atleast closure... Dental records may determine if remains belong to former Robeson County deputy’s missing daughter :: WRAL.com

I hope many more cases will be solved in Robeson County now that they have formed a special task force. Hania doesn't know it, but she is a hero. Her brutal abduction and murder may lead to solving many other crimes. JMO.

It was an interesting article. The reporter interviewed relatives of MM who were close to him when he was younger. The reporter also mentioned that although many people in MM's hometown know him, few would talk about him. The reporter mentions that MM's stepfather lived on Wire Grass Road, and that MM had lived with his stepfather at that address, according to MM's relatives. The article mentions MM's prison record, and the DNA match for the rape evidence collection kit that was never followed up on by LE.

New Robeson Co. Sheriff on overlooked evidence in Hania Aguilar case: 'It angers me'
In an exclusive interview with the ABC11 I-Team, Sheriff Burnis Wilkins confirms at least two members of the sheriff's office knew about DNA evidence linking Michael McClellan to an old rape case more than a year before McClellan allegedly kidnapped and murdered Hania Aguilar.

"It angers me and I've got to deal with it," Wilkins said. "To know that that happened, to know the reports didn't follow the proper channels, that further investigation wasn't done, interviews weren't done properly -- I have a major issue with that."

Wilkins was sworn-in as sheriff on Dec. 3; his lengthy resume includes positions with the Lumberton Police Department, the NC Department of Public Safety and the U.S. Marshal's Task Force.

"Do I take responsibility for what happened? I wasn't here," Wilkins said. "But I have put it out there publicly -- there's nothing going to be hidden. We're going to get to the bottom of it."

After the 2016 rape, the rape kit was sent off for testing.

In 2017, CODIS -- a federal DNA matching system -- named McLellan as a possible match and immediately notified the sheriff's office.

But a close examination of crime data from the North Carolina State Bureau of Investigation shows that many rape cases go unsolved in Robeson County, about 100 miles south of Raleigh. In the last five years, the sheriff’s office reported clearing 26 of the 86 reported rape cases — 30 percent. In 2015, the clearance rate sank to 18 percent: three cases cleared out of 17.

*Prelim Hearing (@ 9 am ET) – NC – Hania Noelia Aguilar (13) (abducted Nov. 5, 2018, found Nov. 27, 2018) - *Michael Ray McLellan (34) indicted (12/3/18), arrested & charged (12/7/18) with 1st degree murder, 1st degree forcible rape, statutory rape of a person under 15, 1st degree sexual offense. Statutory sex offense with a person under 15, 1st degree kidnapping, felony larceny, felony restraint, abduction of a child & concealment of a death. Held without bond.
Charged (12/10/18) with 1st degree rape & 1st degree burglary (re 2016 rape case). $5M bond.
Was arrested Nov. 13 & charged with second-degree kidnapping, possession of a firearm by a felon and attempted robbery with a dangerous weapon in connection with an Oct. 15, 2018 attack in Fairmont. Held on $2.5M bond. This case is continued to 3/19/19.
12/7/18: Preliminary hearing set for 12/10. 12/10/18: Judge revokes bond (on other case) & denies bond. He appointed 2 attorneys. Next hearing on 12/21.

Suspended WITH pay? Oh goodness, what a terrible punishment. They should be FIRED and barred from working in any branch of law enforcement ever again. A child lost her life because of their ineptitude.
