Dearest Hania Noelia was in the 8th grade when she was ripped from her family and friends. I think of her mother this time of year-- knowing she never got to watch her child graduate high school, and go away to University. Today, Hania should have finished her first year of college and coming home to her family for the summer. Instead, this family still awaits justice. :mad:

Another trial delay for man accused of killing 13-year-old Lumberton girl in 2018

The trial of a man charged in the abduction, rape and brutal killing of a 13-year-old girl in November of 2018 has been delayed a second time.

Michael McLellan appeared in court Thursday for a status hearing. He was set to be tried on July 22.

However, one of the lawyers filed a motion asking if she could withdraw because she has another job.

Robeson County District Attorney Matthew School opposed the motion saying it's been nearly six years since Hania Aguilar's death.

Scott told the judge Hania's mother and family have patiently waited in all that time and are ready for McLellan to be tried.

The judge granted the lawyer's request to withdraw. However, he urged the defense to move forward, with haste, to get a second lawyer to represent McLellan.

UGH - is right... I think the judge should NOT have granted that motion to withdrawn - come on - 6 years!! Just does not seem right... especially for Hania's family!! :(

I shall check in next week - and maybe there will be his new hearing date in July.

Edited to add - I noticed they mention a Thursday hearing - so moving him in my notes to 6/6/24.

This is so beyond unacceptable, getting another lawyer and starting over will probably be another year or more.

Justice delayed is justice denied. Hania mattered. :(

Six years and counting!

It's simply additional injustice for Hania's family.

I've said it before that I find it very sad no big names a la South Carolina legal fame have ever come forward to express support for this family.

I dunno. Maybe it's not a big headline -- black defendant, and the victim a little brown girl living on wrong side of the tracks?

[I make this post on the date of another exclusive for Sherri Papini-- serving as a reminder that justice is not equal]!

Hania did matter! I see a child murdered for nothing more than getting up that morning and being ready for school. Being ready 5 minutes too early. MOO :mad:

*Hearing (All charges) (@ am session ET) – NC – Hania Noelia Aguilar (13) (abducted Nov. 5, 2018, found Nov. 27, 2018, in a shallow pond more than 4 feet deep off Wire Grass Road outside of Lumberton) - *Michael Ray McLellan (34/now 40) indicted (12/3/18), arrested (11/13/18), charged (5/14/19) & indicted (additional charges 5/16/19) with 1st degree murder, 1st degree forcible rape & statutory rape of a person under 15, 1st degree sexual offense & statutory sex offense with a person under 15, 1st degree kidnapping, felony larceny, felony restraint, abduction of a child & concealment of a death. Plead not guilty. Held without bond. DA will seek DP. In Central Prison in Raleigh. Lumberton/Robeson County/Superior Court
DNA found in car matched McLellan.
Trial set to begin on 7/22/24.
Superior Court Judge James Gregory Bell presiding. Robeson County District Attorney Matthew Scott.

*Charged (12/10/18) & indicted (1/7/19) with 1st degree rape & 1st degree burglary. $5M bond. Revoked (12/10/18). 2016 rape case/Superior Court

*Charged (2018) with 1st degree kidnapping, 1st degree force sex offense, statutory sex offense with child, larceny of motor vehicle, felonious restraint, abduction of children, concealed/failed to report death of child, 1st degree forcible rape & statutory rape of child. Robeson County

*Charged (10/15/18) & arrested (11/13/18) with 2nd degree kidnapping, possession of a firearm by felony & attempted robbery with dangerous weapon. (10/15/18 kidnapping case in Fairmont). $2.5M bond. 2018 kidnapping Robeson County

6/6/24 Update: One of the lawyers filed a motion asking if she could withdraw because she has another job. Robeson County DA Attorney Matthew School opposed the motion saying it's been nearly six years since Hania's death. Scott told the judge Hania's mother & family have patiently waited in all that time & are ready for McLellan to be tried. The judge granted the lawyer's request to withdraw. However, he urged the defense to move forward, with haste, to get a second lawyer to represent McLellan. His lawyer, Harold "Butch" Pope said he already had another attorney in mind. The North Carolina Office of Capital Defense will appoint McLellan as a second lawyer in this death penalty trial. At this time, it's not clear when a new trial date will be set. McLellan’s next court appearance is scheduled for early July & an update is expected regarding his new legal counsel.
6/6/24 Update: Next hearing on 7/8/24 am session for all cases.

Very doubtful since the Court just approved the withdrawal of one of his former attorneys who had a new job. I believe this will most likely be a status hearing, and perhaps his new attorney will be named. JMO
