*Status Hearing (All charges) (@ am session ET) – NC – Hania Noelia Aguilar (13) (abducted Nov. 5, 2018, found Nov. 27, 2018, in a shallow pond more than 4 feet deep off Wire Grass Road outside of Lumberton) - *Michael Ray McLellan (34/now 40) indicted (12/3/18), arrested (11/13/18), charged (5/14/19) & indicted (additional charges 5/16/19) with 1st degree murder, 1st degree forcible rape & statutory rape of a person under 15, 1st degree sexual offense & statutory sex offense with a person under 15, 1st degree kidnapping, felony larceny, felony restraint, abduction of a child & concealment of a death. Plead not guilty. Held without bond. DA will seek DP. In Central Prison in Raleigh. Lumberton/Robeson County
DNA found in car matched McLellan.
Trial was set to begin on 7/22/24 but was continued since he received a new lawyer. No further dates available.

In June, one of McLellan's lawyers filed a motion asking if she could withdraw because she has another job.

The judge granted the lawyer's request to withdraw. However, he urged the defense to move forward, with haste, to get a second lawyer to represent McLellan.

At this time, it's not clear if McLellan has been appointed a second lawyer.

ABC 15 has reached out to the Robeson County District Attorney's Office to learn of any new developments in McLellan's case.

Man pleads guilty to killing Hania Aguilar in Robeson County, sentenced to life in prison with no chance for parole​

LUMBERTON, N.C. (WBTW) — The man accused of kidnapping, raping and killing 13-year-old Hania Aguilar in Robeson County six years ago will spend the rest of his life in prison after pleading guilty on Friday, authorities said.

Michael McLellan pleaded guilty to first-degree murder and other charges and admitted to killing the teen after kidnapping her from her driveway in the Rosewood Mobile Home Park in the Lumberton area on Nov. 5, 2018. His guilty plea also includes charges in crimes involving two unrelated victims that took place in October 2016 and July 2018, Lumberton police said Friday morning in a news release.

“Everyone in the Lumberton Police Department is humbled and grateful to bring justice for Hania, her family and the community,” Lumberton Police Chief Micahel McNeill said in the news release. “This case has shown our relentless commitment and tireless efforts to hold violent criminals accountable for their actions. Before you go to bed tonight, please pray for Hania’s family to begin to heal their broken hearts.”

LUMBERTON, N.C. (WPDE) — A man sentenced Friday to life in prison for the murder of 13-year-old Lumberton girl, Hania Aguilar tried to escape before and after the hearing, according to Robeson County Sheriff Burnis Wilkins.

Wilkins said Michael McLellan used a homemade handcuff key to take off the cuffs while being taken to Central Prison in Raleigh after being sentenced Friday morning.

Sheriff Burnis Wilkins said McLellan’s first attempt came on the way to the courtroom when he had what appeared to be a key made of materials from the detention center’s art workshop that he had hidden in his mouth.

McLellan attempted to escape deputies both before and after Friday’s hearing, according to ABC11, The News & Observer’s newsgathering partner. Robeson County Sheriff Burnis Wilkins told ABC11 that McLellan first tried to escape using a makeshift handcuff key while being driven to court on Interstate 40, but deputies stopped him.

Then, WIlkins said, as McLellan was being returned to prison, he “hit a latch of a deputy’s gun holster and the weapon was released,” ABC11 reported. McLellan briefly took hold of the gun, but the deputy driving “slammed on the brakes” and was able to recapture the gun.

"He was able to hit the latch that undoes the gun in the holster and actually have control of the weapon," Wilkins said of McLellan.

Wilkins said the deputy driving slammed on the brakes.

"[The deputy] has one hand on the gun," Wilkins said. "McLellan has his hand on the actual grip of the gun and there's a struggle for it."

Wilkins said the detention officer in the car took her pepper spray and sprayed McLellan in his face.
