FBI: Man charged in connection with murder of North Carolina teen Hania Aguilar

Fairmont police said that on Oct. 15, McLellan pointed a gun at a woman, tried to take her car, and demanded money. He left the scene without hurting the woman. Officials said he turned himself into police Nov. 13, eight days after Aguilar was kidnapped.


Agents announced early Saturday morning that Michael Ray McLellan, 34, was being held at the time of his arrest in law enforcement custody for another attempted kidnapping case.

McLellan is charged with a number of felonies, including first-degree murder, first-degree forcible rape and first-degree kidnapping.

Investigators received new test results Friday, which identified McLellan as the suspect in Aguilar's case.

Officials said McLellan will have his first court appearance at 9 a.m. Monday.

Hundreds attend emotional funeral for slain Lumberton teen Hania Aguilar
On Saturday, a crowd of 900 to 1,000 stood as Hania Aguilar's mother, Celsa Hernandez, spoke about her loss, as well as her gratitude to the community during this tragic time -- which has now spanned more than a month.

During the funeral at Lumberton Senior High School, many people wore purple, which was Aguilar's favorite color.

The funeral service program was titled "Remembering Hania: Honoring the Lessons that God is teaching us through her."

The program had photos of Agular playing the violin, her dog 'Pedro' and one of her smiling.

“We are not here to say ‘Goodbye’ to Hania. We are here to say ‘Until later'," one speaker said at the funeral.

Suspect accused of killing teen girl Hania Aguilar has tried to kill, injure others before: Police
Authorities confirmed Saturday that a North Carolina man has been charged with killing 13-year-old Hania Aguilar, and court records indicate that the suspect has a lengthy criminal record involving theft and violence. Court documents indicate that the suspect’s criminal history spans back almost 20 years.

Attempted Robbery, Kidnapping
On October 15, 2018, McLellan allegedly attacked a woman on Pittman Street in Fairmont, North Carolina. According to Fairmont Police Chief Jon Edwards, the suspect approached the unnamed woman while wearing dark clothing and pointed a gun at her.

Court records indicate the suspect was charged with second-degree kidnapping, attempted robbery with a dangerous weapon, and possession of a firearm by a felon.

Assault and Shooting
In 2005, McLellan was accused of shooting a woman three times on New Year’s Eve, according to The Robesonian. He snuck into the home of Teena Lewis, 21, where he held her at gunpoint, beat her, then shot her. After punching her numerous times, McClellan shot Lewis in the torso twice and the leg once, according to police.

In 2007, McLellan was convicted of first-degree burglary and assault with a deadly weapon “with intent to kill or seriously injure.” He spent nine years behind bars and was released in 2016.

Assault on a Child
According to the North Carolina Department of Public Safety, McLellan was convicted of misdemeanor assault on a child in 2000. In 2004, he was convicted again of one misdemeanor account assaulting a child.

Breaking and Entering
In February 2018, McLellan was arrested and charged with breaking and entering and larceny of a motor vehicle. He was released in June 2018. Four months later, Hania was dead.

Man accused of killing Hania Aguilar was on parole at time of her death
On Nov. 13, McLellan was arrested by Lumberton police on outstanding warrants for second-degree kidnapping, attempted robbery with a dangerous weapon and possession of firearm by a felon, records show.

Bail on those charges was set at $2.5 million.

On Wednesday, McLellan was charged with first-degree forcible rape, first-degree burglary and robbery with a dangerous weapon from an incident that happened on Oct. 20, records show. No details were given.

Bail on those charges was set at $5 million.

McLellan is being held without bail on the new charges and is scheduled for a first-appearance hearing Monday in Robeson County District Court.

The SUV in which Hania was taken was found three days after her abduction in a field off Quincey Drive in Robeson County, about 11 miles south of Lumberton. McLellan, at the time of Hania's abduction, was staying at a residence off Alamac Road, which intersects with Quincey Drive, according to reports.

There were purple balloons, flowers and bows in the gym since purple was Hania's favorite color. The funeral service was held in English and Spanish with musical performances.

Some of her friends spoke on the podium, saying she is now in a place where "nobody can hurt you."

Hania's father, Noe, was denied a temporary visa to attend her funeral from Guatemala but a letter from him was read aloud. "Rest in peace, my princess," it said.

Hania's mother, Celsa Hernandez, cried over her little girl's casket and brought up her murderer. "Whoever took my daughter's life, he took my daughter's life, not her happiness," Hernandez said.

Marines placed Hania's casket on a horse-drawn carriage as she was taken to her final resting place at Meadowbrook Cemetery in Lumberton.

Man charged in slaying of abducted NC teen hours before her funeral
SaVon Maultsby, the middle school’s principal, recalled Hania’s loving smile.
“When I look at all the outpouring of love and support for Hania every day, I am reminded that her life’s journey is really about the people who she has touched,” she said.

Classmates remembered Hania’s perfect attendance in the fourth grade, and her interests in music, science and soccer. She dreamed of becoming an architect and liked to bakes cookies and pastries, they said.

“There aren’t any magic words that will heal the hurt that our school community feels,” Maultsby said.

Hania’s grandfather and a maternal aunt received temporary visas to attend the funeral, according to the attorney.

Aguilar said he last saw his daughter in 2005. He said they spoke on the phone and her mother talked to him about their daughter and sent photos. Salem said Aguilar had lived in United States and moved back to Guatemala when Hania was an infant.

Aguilar said he’s not sure what he will do Saturday at the time of the funeral.

“Maybe I’ll get lost somewhere,” he said. “I don’t know how I will deal with it. I’ll either stay home or take a long walk alone.”

According to Fairmont Police Chief Jon Edwards, McLellan, wearing a mask, approached a woman as she pulled into her home on Pittman Street and pointed a gun at her and demanded money. The woman recognized his voice and called him by name, and, according to Edwards “he removed the mask and talked to her in a way to attempt to play it off with her.” Edwards said he did take money from the woman.

McLellan is said to be a Fairmont resident, but he has a home on N.C. 41, according to Edwards.

McLellan, of 513 Marvin St. in Fairmont, is being held without bond.

Authorities did not say how they linked McLellan, who was being held in Robeson County Jail on an unrelated kidnapping charge, to Hania's case.

Judge denies bond for man accused of kidnapping, raping, killing Hania Aguilar - WWAY TV
A judge today denied bond for a man accused of kidnapping, raping and killed a Lumberton teenager last month. Meanwhile no decision has been made yet on whether he will face the death penalty.

Michael Ray McLellan, 34, showed no emotion during his first court appearance as the judge read through his charges, which include with first-degree murder, first-degree forcible rape, statutory rape of a person under 15 years of age or younger, first-degree sexual offense, statutory sex offense with a person 15 years or younger, first-degree kidnapping, felony larceny, felony restraint, abduction of child and concealment of a death in the death of Hania Aguilar.

In Robeson County Court this morning McLellan asked for an attorney. The judge said McLellan will likely have two attorneys.

District Attorney Johnson Britt said that because he is leaving office later this month, he cannot decide whether this is a capital case. Instead, he will leave the decision whether to seek the death penalty up to Matt Scott, who won November’s election. Britt, though, said that based on McLellan’s previous record, the death penalty could be a possibility.
